Eric DeHays - Local Waste Services Eric DeHays of Local Waste Services thanked Council for allowing them to provide trash removal, recycling and yard waste for the community for the last 4 years. Mr. DeHays informed that Council Local Waste is in the process of converting their fleet over to compressed natural gas trucks. The new trucks will produce almost zero emissions, and allow the company to reduce fuel costs with natural gas in lieu of diesel fuel. Local Waste is in the fourth year of a five-year contract with Groveport. As a member of Consortium 2, there is a provision in the Consortium contract that provides for a two-year extension. Most of the other members of this consortium City of Groveport Page 1 City Council Meeting Minutes December 15, 2014 have already signed this extension. Local Waste would like to continue to have Groveport's business. He wanted to know if Council and residents are happy with the service. Council Member Hilbert relayed her satisfaction with the service. Mr. DeHays hopes to have Groveport added to the list of members signed up for the extension by the end of the year. Law Director Shannon advised Council that Joe Durham, Groveport's Special Counsel, indicated to Mr. Shannon there is a limitation that is set forth in the Ohio Revised Code as it relates to this potential extension. Mr. Shannon has not had the opportunity to research this matter fully and plans to talk to Mr. DeHays regarding the extension. In response to Council Member Hilbert's question of what Council needed to do to proceed, Mr. Shannon advised action is not necessary since Council had already passed legislation authorizing the contract. Council authorized all the terms of the contract. If one of the terms of the contract is an extension, and the Administrator believes it is in the best interest of the City to go forth with said extension; as opposed to going through another bid process; she could do so. The City's rates are fixed through 2015 with a 16 cent per month increase for the following years. Council Member Cleary inquired if Mr. DeHays can foresee any changes in state or federal regulations for trash disposal that could increase the rates for customers. Mr. DeHays is not aware of any changes forthcoming. Mr. DeHays will follow up with Mr. Shannon in the near future. b. Tina & Mike McMannis - 79 Shaffer Dr. Tina & Mike McMannis of 79 Shaffer Drive addressed Council regarding the Exel warehouse construction site. They, along with three neighbors, are concerned with the massive 300,000 square foot warehouse being constructed right behind their approximately 1,100 square foot homes. At the start of the construction when workers were moving earth for two straight weeks there was nothing but vibrations and noise, especially the beep, beep, beep of equipment in reverse. This past summer, the City's inspector came to their home to inspect the new roof installed on their house. Mrs. McMannis took the opportunity to speak to him regarding the issue and he more or less said there was nothing they could do. She asks Council to consider that Groveport has no restrictions on construction work hours. Since this summer, they have been dealing with the problem from early in the morning until dark. Then they received a letter stating they would be working through the night. Mr. McMannis stated when they attended a Planning & Zoning meeting two weeks ago, they were told Exel had asked to work through the night and the Planning & Zoning Commission refused the request. Exel had told them there wasn't any legislation that prohibits night work, so they would obtain an attorney City of Groveport Page 2 City Council Meeting Minutes December 15, 2014 to fight the Planning & Zoning Commission's decision. His biggest concern is after the warehouse is done. Mr. McMannis stated there are many dock doors that face their property. He does not know how many semi-trucks will be there or Exel's hours of operation. He does know they are zoned for hazardous materials, which is not very comforting. Mrs. McMannis commented the only thing that separates the four small homes on their side and the four facing their houses from this massive warehouse, is a grass covered hill. They attended the Planning & Zoning Commission meeting because ARCO Construction had applied for a variance and it was their only opportunity to speak out. The McMannis' moved to Groveport in 2002. The industrial park was approved before they moved to the community, so they could not have fought it then. Construction on the Mcgraw-Hill and Kubota warehouses began shortly after they moved into their home. Mrs. McMannis is not against business, she does not know Mcgraw-Hill or Kubota, but their warehouses are further away. Exel is actually (there is no other way to put it) in their back yard. They have installed new siding, windows and doors on their home and if they put their house up for sale today, all potential buyers would see is the warehouse in their backyard. The variance she referenced earlier; giving them the only opportunity to speak; deals with the landscape barrier. They don't believe any landscape barrier is going to take care of the noise generated from this warehouse because they hear the beep, beep, beep of any type of semi, forklift or construction equipment in reverse. The variance was to not plant trees between the Exel warehouse and Kubota, instead plant additional trees between the residents and Exel. Every spring she and her neighbors have to complain about the grass not being mowed on the mound. Previously she would call a contact at Duke, who owned the property at the time and he would contact his landscaping contractors. It is no longer owned by Duke, this year the new owner had to be notified. She realizes the City has to go through a process to get the grass mowed. A lot of the trees died and the City had to force them to cut them down. The City gave them a time limit to replant those trees. That deadline was December 1st. Now, the matter has to go before a judge to determine the penalty. Now that it is wintertime, they will not be able to plant the trees. The residents on Shaffer Drive don't think a landscape barrier is ever going to be sufficient to abate the noise. They think there needs to be some kind of permanent sound barrier installed between the warehouse and their homes. The McMannis' came to ask Council for help on this matter. Ms. Hall commented on a conversation she had with Mrs. McMannis regarding the construction of the warehouse. Mrs. McMannis felt the overnight work was not as bad as the earth moving and vibrations. That work is done during the work day. Administration worked with Exel on the issue of the overnight work on the concrete floor. Administration permitted the nighttime hours because it City of Groveport Page 3 City Council Meeting Minutes December 15, 2014 involved a specific type of concrete work. Building Official Stephen Moore addressed Mrs. McMannis' concerns of the hazardous materials in the building. An industrial park is going to have hazardous materials and these types of materials are allowed in our industrial parks. The City's building code regulates how the types of materials are stored and handled, as well as the fire code. Mrs. McMannis reiterated her concerns with the barrier. Mr. Moore explained that mound was put in per Council's requirements when the property was originally zoned. The barrier is an 80' wide buffer with a mound with plantings. If Council had not required that buffer it would have only required a maximum of 30' wide with less trees. That buffer is the largest in Groveport between a building and residential area. Law Director Shannon advised everyone of the due process of the Franklin County Municipal Court - Environmental Division, the City can use as a recourse if compliance with the City's code is never met. As to any other type of buffer, there is a difference in the construction noise versus the noise they make conducting their normal business. No restrictions can be made to the hours in which they can operate their business. Ms. Hall assured the McMannis' this Council takes a lot of initiative to try to provide for their residents. Council replaces the community sidewalks, provides the recreation center, swimming pool and parks with revenue generated from the industrial parks. VII. Mr. Stevens is seeking Council's approval to park on the hydrant side of the street in front of the houses on his end of Dorchester Street. The photographs show semi-trucks, pickup trucks, school buses and large dump trucks City of Groveport Page 8 City Council Meeting Minutes December 15, 2014 traveling on the street. The pictures show ample space for the larger vehicles to navigate through the parked vehicles. Staff clarified for Council Member Dildine, if this Ordinance were to pass it would affect both Section 3s shown on the map. Mr. Dildine commented the other Section 3 is more congested with houses and vehicles. One lot can be built on the same side of the Stevens' home and two lots can be built on the opposite side. Mr. Dildine had driven down Dorchester Street five times in this past week, twice today, at various hours of various days; once driving a fire truck. Mr. Dildine expressed his concerns with vehicles parking on both sides of the street when an emergency could occur at any time. Council Member Hutson commented on the gas line in the easement where nothing could ever be built. Mr. Stevens commented he has an issue with mowing the lot next to his house. Mr. Dildine asked Chief Building Official Stephen Moore who is responsible to mow the easement. Mr. Moore clarified the easement is part of Mr. Stevens' lot, therefore making its maintenance his responsibility. Mayor Westcamp suggested to allow this Ordinance to go to a third reading even though it has emergency language. The Ordinance will then be voted on in January 2015, getting the Stevens' through this year's holidays. Council Member Hilbert inquired of Mr. Moore if Mr. Stevens could put another driveway into the easement section of the other lot. Mr. Moore explained the City Subdivision Regulations only allows for one curb cut per lot and it is all the same lot that has an easement. Council could make an exception for another curb cut but City Ordinance does not allow people to park in the grass. An area would have to be paved for parking or they could apply for a variance to use gravel. Council will further discuss possible solutions to accommodate the residents on Dorchester Street. Mayor - Lance Westcamp Mayor Westcamp stated this was the best group of Council Members he has worked with over the years. He thinks that can be seen with the ordinances that went through tonight. He is looking forward to 2015. The Mayor's vote was not needed once in 2014 to break any tie vote of Council. He wished everyone Happy Holidays. B. Administrator - Marsha Hall Administrator Hall thanked Council for passing all the legislation tonight. It will allow Administration to move quickly in 2015. It has been a wonderful year. Director of Law - Kevin Shannon Law Director Shannon advised Council in regards to the Local Waste extension, there is a statutory provision right on point in the Ohio Revised Code, Title 37. It states a municipal corporation can enter into such a contract for waste hauling services, not to exceed five years. If there is a provision right on point in the Groveport City Charter, as it relates to this matter, the Charter; under "home rule provisions" could trump Title 37. If there is nothing in the City Charter, the Groveport Codified Ordinances will need to be researched. If there is no provision in either the charter or the codified ordinances, the ORC applies. Mr. Shannon will check with Whitehall. He will be researching the matter and speak to Mr. DeHays. F. Council Members - Ed Rarey, Jean Ann Hilbert, Donna Drury, Ed Dildine, Shawn Cleary & Becky Hutson Council Member Hutson thanked everyone for her first year on Council, it has been a pleasure serving the community. The Administrator has made it very easy. She wished everyone a Merry Christmas. Council Member Drury commented Groveport's Administration is the greatest in all of Franklin County. She wished everyone a Merry Christmas. Council Member Hilbert wished everyone a Merry Christmas and thanked Administration for making Council's job so easy. She thanked Clerk of Council Ruthanne Ross for doing a great job this year. Council Member Rarey wished everyone a Merry Christmas and a Happy New Year. He thanked the City's Administrative staff for all the efforts they put forth and the opportunity to work with them. Council Member Dildine commented it has been a great year, he looks forward to next year with what is coming down the road. He wished everyone a Merry Christmas and a Happy New Year. He reported his shift of thirteen firefighters will be adopting a family for Christmas. Council Member Hilbert inquired on Chris Tomlison, an employee who lost everything in a house fire. Ms. Hall reported Chris had attended an open enrollment insurance meeting last week. He was talking to Brenda Lovell, Personnel Coordinator, when someone from Medical Mutual heard them talking about the fire and his situation. This morning Medical Mutual presented Chris with a $1,000 check. Clerk of Council - Ruthanne Sargus Ross Clerk of Council Ruthanne Ross commented she was thankful to have worked her first year with one of the greatest Councils Groveport has had in session. She wished everyone a Merry Christmas and a Happy New Year. H. Standing Committees None IX. Other Business Madison Trustee Gary McDonald thanked Council for the job they have done this past year. He learns a lot attending these Council meetings that he takes back to his trustee meetings. X.
