Call to Order by Mayor Westcamp at 6:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Stephen Moore - Chief Building Official, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence The Mayor asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call A motion was made by Council Member Drury, seconded by Council Member Dildine, to excuse Council Members Rarey and Hilbert from the meeting. Chief Building Official Stephen Moore - Updates Chief Building Official Stephen Moore updated Council on the roof collapse at Innotrac, on Port Road. Workers have started the cleanup so the engineers can look into the cause. Welding inspections of the north and south walls of the roof; both of which have the same detail as the collapse and are still intact; have revealed some defects in the welds. They are doing some shoring to secure the remaining section City of Groveport Page 1 City Council Meeting Minutes March 9, 2015 of the roof and the building in general. At this point no one is allowed in the building other than the workers who are trying to get the building safe enough for the tenants to remove their merchandise. The tenants will be using a portion of one of the spec warehouses as a temporary site for business. Mr. Moore, the structural engineer and Madison Township Fire Marshall Rick Stelzer went through and created safety zones within the building; areas where no one could go, as well as, the areas safe for the workers. The small companies with inventory located in this building have been given safe areas for access to pull their merchandise from the building. The fire department had a fire watch on the structure because there was no fire suppression at the time. The building needs to be heated before the fire suppression can be up and running. It is difficult to heat a building with a big hole in the roof, although measures are being taken to try to hold in the heat. Wednesday there will be a meeting to look at where the building is as far as safety to allow the tenants back in to remove merchandise. No one will be allowed into the building until the structural engineer advises Mr. Moore that the building is safe enough for people to enter. Any questions and/or concerns from residents, or the community in general, can be directed to the Building & Zoning Department. Innotrac, a third party logistics company, has been good to work with; the structural engineer has done a good job keeping Mr. Moore updated and the contractor who will oversee the reconstruction has also been good to work with on this matter. All involved have come a long way in one week to get the building back to where it is at this point. Objects being remove from the structure will be placed in the parking lot for inspection by the investigators. Mr. Moore anticipates a report detailing the results of the investigation. Council Member Dildine asked who is doing the investigation. The structural engineer is with Jezerinac Geers & Associates Inc. Mr. Moore stated there could be several investigations being done by insurance companies and other interested parties. Jezerinac Geers has hired security to make sure no one goes in and out of that space. The City required they create a single entrance at the rear of the building. It has been a very well-coordinated and secured space. Mr. Dildine asked if there are any other buildings designed and constructed during the same time that the City needs to inspect. Mr. Moore commented the owner of this building owns the building behind it, which was built around the same time by the same construction company. The engineers will be going in to inspect that building. Mr. Moore advised Council they will start to see tree clearing on the Schottenstein property (NorthPoint Development) along the south border by Honeywell. City Engineer Steve Farst has reviewed the area and the department has issued tree clearing and floodplain permits. There will be construction equipment visible on Rohr Road; City of Groveport Page 2 City Council Meeting Minutes March 9, 2015 with the construction entrance, approved by Franklin County, on Pontius Road. Their sediment and erosion control plans have been reviewed and approved by the City's Building and Zoning Department. The developer is still on schedule to start construction on the building in May 2015. b. Eric DeHays - Local Waste Services Eric DeHays with Local Waste Services thanked Council for the opportunity to speak to them. Mr. DeHays wanted to thank the community for the business they do in Groveport. There is an extension provided in the contract. Law Director Kevin Shannon, Administrator Marsha Hall and Mr. DeHays will be meeting to get the contract finalized. VII. Ordinances and Resolutions A. 3rd Readings ORD. 15-009 AN ORDINANCE APPROVING THE RECODIFICATION, EDITING, AND INCLUSION OF CERTAIN ORDINANCES AS PARTS OF THE VARIOUS COMPONENT CODES OF THE CODIFIED ORDINANCES OF GROVEPORT, OHIO AND THE DECLARATION OF AN EMERGENCY Sponsors: Drury Law Director Shannon requested Council consider making a motion to amend this Ordinance as to two specific chapters. 1. Chapter 313.01 Traffic Control Devices and 2. Chapter 339.2 Use of Local Streets; Local Permit and Conditions. This is to address any future issues that could come about at any site as it relates to vehicles that exceed a gross weight of 5 ton or larger. The City currently has on the books a failure to obey a traffic control device. If by chance a development should take place, such as on Rohr Road, and a truck does not obey the traffic control device; whether a sign or a concrete barrier and they head toward town; this amendment includes the penalty provision. If such a vehicle was involved, the offense could be an unclassified misdemeanor. An unclassified misdemeanor under Ohio law is not a jailable offense, however, it does have a fine of up to $1000. If trucks heading into town becomes a problem, the City now has the means to effectively take care of it, opposed to a $150 fine and court costs with a minor misdemeanor offense. Mr. Shannon explained the code still separates anyone driving a standard motor vehicle or a pedestrian who fails to obey a traffic control device. They City of Groveport Page 3 City Council Meeting Minutes March 9, 2015 are still subject to a minor misdemeanor offense. However, if you are driving a type of vehicle as the City has defined in its traffic code as a heavy commercial vehicle, and they violate the code; the penalty can be anywhere from a $0 to $1000 fine and court costs. There is also a provision, though rarely used, saying the offender can get up to 500 hours of community service. This provision has been put in Chapter 313 under failure to obey a traffic control device - 313.01. With this Codification Ordinance before Council now, staff has taken the opportunity to make these changes to this code section and the code section dealing with the truck route. If trucks violate the truck route section code, offenders are subject to an unclassified misdemeanor as well. Council Member Dildine asked if the stated offenses carried points against one's driving record. Mr. Shannon advised a failure to obey a traffic control device is a two point offense. The failure to obey a truck route is not a two point offense. Staff is taking the opportunity with Ordinance No.15-009 being before Council tonight; that deals with changes from 2014; to act on this immediately. However, as there are only four Council Members present tonight, first Council will need to consider allowing the amendment to Ordinance No.15-009 to include the changes to Section 313.01 and Section 339.2 of the City of Groveport Traffic Code. Motion carried by the following vote: Excused: 2 - Hilbert and Rarey Yes: 4 - Cleary, Dildine, Drury and Hutson Law Director Shannon advised Council he would normally request a motion from Council to adopt as emergency legislation. This Ordinance has had its three readings and has emergency language. However, in order to be passed as emergency legislation, it requires five positive votes. If the Ordinance receives four positive votes tonight and passes, it will not go into effect for thirty days. Council Member Cleary commented the City will have plenty of signage asserting this change to the traffic code. Administrator Hall stated the City will have larger signage, make sure the signage is in the correct locations, and exhibit some alternate language on the signage to include the fine, to let it be known what the consequences are if one disobeys the signs. This is a concerted effort citywide. Ms. Hall commented the thirty days gives staff time to order and install the signs. Mr. Grebus was a very influential in the City of Groveport and the Village of Groveport. He will be sadly missed by many of the residents. Mayor Westcamp thanked Suzie Price for advising him of Mr. Grebus' passing. B.
