Call to Order by Mayor Westcamp at 6:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence The Mayor asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call Present: 6 - Shawn M. Ordinances and Resolutions City of Groveport Page 1 City Council Meeting Minutes May 11, 2015 A. 3rd Readings ORD. 15-020 AN ORDINANCE AUTHORIZING THE GROVEPORT SPECIAL OLYMPICS OHIO COLLECTION FOR CHARITABLE DONATIONS TO THE SPECIAL OLYMPICS OHIO Sponsors: Rarey Law Director Shannon requested Council to consider making a motion to amend this Ordinance to include in Section 1. That Pursuant to Groveport Code Section 371.06 and other sections, the Groveport Special Olympics Ohio is hereby granted permission to solicit contributions at the City intersections of Main Street at Hendron Road, Main Street at College Street, and the traffic light on Main Street at Kroger on Saturday, June 13, 2015, from 10:00 a.m. to 3:00 p.m. for donations to the Groveport Special Olympics Ohio. That is the statement of the amendment. Section 2. and Section 3. remain the same as to the City's standard language. Clerk of Council Ross read by title Ordinance No. 15-020. The motion carried by the following vote: Yes: 6 - Cleary, Dildine, Drury, Hilbert, Hutson and Rarey ORD. 15-022 AN ORDINANCE AMENDING PART FIFTEEN - FIRE PREVENTION CODE OF THE CITY OF GROVEPORT CODIFIED ORDINANCES, CHAPTER 1519 , FIREWORKS, SECTION 1519.06, SEPARATION DISTANCES FOR PUBLIC DISPLAYS, AND THE DECLARATION OF AN EMERGENCY Sponsors: Hutson Attachments: ORD. 15-022 Fire Code Chapter 1519- Fireworks Exhibit A.pdf Law Director Shannon requested Council to consider making a motion to suspend the rules as to the three readings and the effective date so the Ordinance can be in effect by the 4th of July Celebration. This update is necessary because in the Codified Ordinances of Groveport this code is the enforcement code for the police department where individuals are seeking to shoot off fireworks. There is also a cross reference concerning certain distances for exhibitors firing off fireworks. The City's Codified Ordinances conflict with the State Fire Code the City adopted in 2011 as to appropriate distances. Madison Township Fire Chief Bates spoke to Mr. Shannon on amending Groveport's code. The safest approach was to delete any references to distances in Groveport's code because it is adequately covered by the State Fire Code. Staff is asking for emergency legislation so the City can have this on the books immediately. Clerk of Council Ross read by title Ordinance No. 15-022. This Ordinance was referred to the Committee of the Whole. This Ordinance was referred to the Committee of the Whole. IX. Reports A. Mayor - Lance Westcamp Mayor Westcamp thanked Council Member Drury for the idea of reading the Proclamation to honor Older Americans Month at the Senior Center last week. There were 89 senior citizens who participated in the event. Council can be proud the facility was full for the occasion. Mayor Westcamp informed Council of the resignation of Greg Keller from the Board of Zoning Appeals. The Mayor recommended to Council the appointment of Scott Clinger for the vacancy on the City of Groveport Page 5 City Council Meeting Minutes May 11, 2015 Board of Zoning Appeals. A motion was made by Council Member Hilbert, seconded by Council Member Dildine, to appoint Scott Clinger to the Board of Zoning Appeals. The motion carried by the following vote: Yes: 6 - Cleary, Dildine, Drury, Hilbert, Hutson and Rarey B. Administrator - Marsha Hall Administrator Marsha Hall referred Council to the submitted parade registration form and rules. Staff had reviewed a number of area parade rules online (Violet Township; Reynoldsburg, Ashville, Canal Winchester, Bexley, Lancaster and Upper Arlington). All except Bexley allow distributing candy from walkers; none from vehicles. Currently Groveport does not have a separate set of parade rules; instead it is asked that participants not throw candy from moving vehicles. Staff has come up with a new set of parade rules for the 4th of July Parade; submitted to Council in their agenda packets. The rules specifically state candy and/or any handouts must be handed to the crowd by walkers to the side of their vehicle. Chief of Police - Ralph Portier Chief Portier reported with today’s storm coming in so quickly, the department was able to alert the community by using social media. Residents were warned of the potential dangers with high water and the possible drastic changes with this type of weather. Council Member Cleary raised the matter of the school installing fencing on Cron Drive. There were issues on Saturday with parked vehicles. Ms. Hall commented it was her understanding the school plans to wait until after July 4, 2015. D. Director of Finance - Jeff Green Finance Director Jeff Green reported the building on South Hamilton Road was vacated by Kmart Distribution. The building is City of Groveport Page 6 City Council Meeting Minutes May 11, 2015 approximately 300,000 square feet. E. Director of Law - Kevin Shannon Law Director Shannon requested Council to consider making a motion at an appropriate time on tonight's agenda to go into Executive Session to consider both pending or imminent litigation and a personnel related matter. F. Council Members - Ed Rarey, Jean Ann Hilbert, Donna Drury, Ed Dildine, Shawn Cleary & Becky Hutson Council Member Hilbert commented on the National Day of Prayer at the Motts Military Museum. Groveport Police Officers were lifted up and Groveport was praised as a very peaceful community in which to live. Council Member Dildine reported on the need to have house numbers displayed on every house in Groveport. It makes it harder for the police and fire departments to find houses. He wants the word spread to City residents that they need to get house numbers displayed on their homes for safety reasons. Mr. Dildine also reported he and Council Members Hilbert and Hutson attended a presentation given by the Eastland Career Center Juniors for their Government Affairs Class. Their project was "Unsafe Roadway / Pedestrian Access along SR 317". The 15 to 20 minute program raised some ideas Council has never considered. The class will be coming to a Council meeting to make their presentation to the full body of Council, Mayor and staff. Council Member Rarey expressed concerns with the issue of children walking along the roadway of SR 317. He thinks it is long overdue for a solution to keep our children safe. G. Other Business Council Member Rarey acknowledged the presence of Carla Cramer with the Groveport Heritage & Preservation Society at tonight's meeting. Ms. Cramer was in attendance to follow the Ordinance City of Groveport Page 7 City Council Meeting Minutes May 11, 2015 pertaining to the Groveport Heritage & Preservation Society, which was referred to the Planning & Zoning Commission for June 1, 2015 meeting. Executive Session Law Director Shannon requested Council to consider making a motion to go into Executive Session pursuant to ORC 121.22 (G)(1) To consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official and ORC 121.22 (G)(3) conferences with an attorney for the public body concerning disputes involving the public body that are the subject of pending or imminent court action. To include all Members of Council, the Mayor, the Administrator, the Finance Director and himself. A motion was made by Council Member Hilbert, seconded by Council Member Cleary, to go into Executive Session pursuant to ORC 121.22 (G)(1) To consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official and ORC 121.22 (G)(3) conferences with an attorney for the public body concerning disputes involving the public body that are the subject of pending or imminent court action. To include all Members of Council, the Mayor, the Administrator, the Finance Director and the Law Director at 7:05 p.m. Motion carried by the following vote: Yes: 6 - Cleary, Dildine, Drury, Hilbert, Hutson and Rarey A motion was made by Council Member Hilbert, seconded by Council Member Dildine, to come out of Executive Session at 8:59 p.m. with no action taken.
