C. 1st Readings Ord. 2020-029 AN ORDINANCE PROVIDING FOR THE SUBMISSION OF PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF GROVEPORT, OHIO, TO THE ELECTORS AT THE NEXT REGULAR MUNICIPAL ELECTION TO BE HELD NOVEMBER 3, 2020 AND THE DECLARATION OF AN EMERGENCY Sponsors: Dildine Law Director Kevin Shannon commented that it was a pleasure working with 2020 Charter Review Commission. Luke Watkins did an excellent job as Chair of the Commission. Mr. Shannon gave a brief explanation on the Commission's proposed changes for Council's consideration as set forth in the Ordinance. Under Council approval of expenditures Finance Director Jason Carr expressed some frustration in the past on the way Groveport has to pass its bond legislation. The City's special counsel on bond matters says bonds being issued is not an appropriation as defined by Groveport's Charter. Therefore, the legislation would require a mandate that the Council would always have City of Groveport Page 2 City Council Meeting Minutes July 13, 2020 to suspend the rules and pass it as emergency legislation, as opposed to treating it as an appropriation ordinance that if passed after one reading it would go into effect immediately. Mr. Carr, Mr. Shannon and Administrator BJ King all agree that when looking at the definitions of the issuance of bonds how can they not be considered appropriations in the eyes of the law. This amendment under Article III, §3.10 clears up the issue and sets forth in the City's Charter that such issuance of a note or a bond is an appropriation under this Charter. In Article III, §3.10 (A)(3) if the City is receiving federal and/or state loans for the various projects that the City undertakes, those should be considered an appropriation as well. These amendments make it very clear for all that those types of transactions are appropriations for purpose of the City Charter for Groveport. Article III, §3.10 (A)(4) basically gets into the common practice that Council before, as far as doing some sort of approval of an expenditure, has also utilized a motion at the request of the Finance Director. The Charter Commission wanted to set forth specifically, which makes it consistent with the City’s Charter that Council can act in one of three ways, by ordinance, resolution or motion. In Article VI, §6.02 (B)(10) the City no longer has a Recreation and Parks Department. The new language cleans the provision up to reflect the Recreation Department is separate from the Parks & Facilities Management Department. Mr. Shannon added that in 2010 Groveport passed a change to the Charter that said that the Charter Review Commission had to get proposed changes to Council by June 1st. That change did not get picked up in the codification by The Walter H. Drane Company, which is now American Legal Publishing; it still has the date of August 1st. Mr. Shannon requested Council to consider making a motion to permit the 2020 Charter Review Commission to submit the suggested Charter amendments to City Council at the later date of August 1st so the City can meet the time frame for filing with the Franklin County Board of Elections by August 3, 2020. Mayor Westcamp and City Council personally thanked Luke Watkins for his leadership on the Commission and the Commission members for their service to the City. Luke Watkins was present at tonight's meeting to answer any questions from Council. Clerk of Council Ross read by title Ordinance No. 2020-029. A motion was made by Council Member Dildine, seconded by Council Member Hutson, to approve the submission of this legislation to City Council after the June 1st date stated in the Groveport City Charter. Mayor - Lance Westcamp Mayor Westcamp announced the sad news that former City Administrator Steve Morris passed away today in Florida. Jeff Green has all the details in regard to funeral arrangements. On behalf of the City, Mayor Westcamp sent his condolences to Steve Morris’ family. The Mayor had told Sergeant Josh Short to participate in the protest march in Canal Winchester on Saturday along with Patrolman Javier Herrera. As soon as the event was over, Sgt. Short reported back to the Mayor on how smooth everything went in Canal Winchester. Even though the officers were out of our jurisdiction, given the City of Groveport’s relationship with Mayor Ebert and Canal Winchester, it all went very well. It shows that in smaller communities protest marches do work as long as everyone communicates. Chief Portier is back working everyday but the Mayor instructed him to not attend the Council meetings. B. Administrator - BJ King Administrator BJ King updated Council on the matter of food trucks and refuse and recycling collection service. Food Trucks Mr. King met with Jeff Green, Captain Kurt Blevins, and Stephen Moore to discuss how to move forward with permitting food trucks in residentially zoned areas of the City. It was determined that permitting food trucks in residentially zoned areas should be done on a trial basis before working toward a zoning code change. The process that was developed requires the food truck operator to get a special use Mobile Vendor Permit from the City. The permit includes contact information, information where the truck will be parked, day and times of operation, City of Groveport Page 4 City Council Meeting Minutes July 13, 2020 etc . . . Additional regulations are: · Must be parked on private property - · No trucks permitted to park on street of public right of way · Do not block sidewalks · No more than 2 signs permitted and signs must be on private property · Operation limited to 4 hours and not permitted past 8:00 p.m. Refuse and Recycling Collection Service The second refuse and recycling bid opening was held on June 25th. The lowest bid was submitted by Local Waste Services in the amount of $19.39 per month for status quo service. Local Waste Services submitted the lowest bid for the first bid opening in the amount of $19.20 per month for status quo service. · I recommend that we contract with Local Waste Services for the cost of $19.20 per month for refuse and recycling collection. The only outstanding decision is the use of the current totes for recycling or implementing the wheeled carts. If the wheeled carts are chosen, every customer would need to use the cart for recycling. Only recycling in the wheeled carts would be collected - no other container could be used. · During the July 13 Council meeting, I’ll be looking for direction on the recycling in order to have legislation on the July 27 Council agenda to begin the process of approving a contract with Local Waste Services. Removal of Trees on Front Street Tree removal will start this week. Residents have already been notified and Public Works staff is following up with those residents to make them aware of the removals starting this week. Today was the first day for Public Services Director Brian Strayer. He spent some time with HR and Mr. King and Jeff Green had the opportunity to spend some time with him as well. Mr. King contacted AEP in regard to the power outages taking place in Newport Village. AEP is asking for specific addresses and Mrs. Hutson will try to get some of the house addresses that are experiencing the frequent outages. Residents need to update their phone numbers with AEP and report outages as they occur.
