Swearing-In of Sergeants Law Director Kevin Shannon administered the oath of office for police patrol sergeant to Josh Guiler. Sergeant Guiler introduced his wife and daughter. Law Director Kevin Shannon administered the oath of office for police patrol sergeant to Sam Yockey. Sergeant Yockey introduced his fiancé and other members of his family who were in attendance. Business of Guests City of Groveport Page 1 City Council Meeting Minutes August 9, 2021 A. James Chilton - 4918 Founders Drive James Chilton, 4918 Founders Drive, addressed Council about a shelter house and a swing set a Founders Park. The matter was proposed a few years ago, pre-COVID, and now the neighborhood wants Council to consider making that happen. Administrator BJ King will meet with Council Member Lockett and Parks & Facilities Management Director Tom Byrne on plans and gather some cost estimates. Mr. King likes the shelter houses in neighborhoods because it encourages community interaction with picnics and similar gatherings. B. Tina West and Judy Brown, Tallman Street Judy Brown and Tina West, Newport Village, brought a problematic property on Tallman Street to Council's attention. The house sits at the entrance to Newport Village and is the first seen on Tallman Street when turning off Rohr Road. The house needs repair, but the main concern is the grass; some yard areas have grass over 3 feet tall. The resident mows the front and side yards so no one will notice the backyard. The HOA is aware of the problem, but no one responds to Mrs. Brown's emails about resolving the issue. Administrator King will get with the City's Zoning Inspector to see if the property is on their radar. There is a City ordinance on tall grass. The vermin inhabiting the tall grass is causing a nuisance. The residence houses a mother, father, and four grown children. The daughter has two babies, a boyfriend, and three to four tenants are living in the basement. Eight to twelve vehicles parked on Tallman Street belong to the residents of that house. City Administration will follow up with the Building Department first thing tomorrow morning. A tree survey shall be completed and submitted for review with the required landscape plan for the site. 2. All recommendations and requirements stated in the letter from Columbus Regional Airport Authority dated May 12, 2021 shall be implemented in the development of this site. 3. Approval is contingent on the annexation of the property being approved. 4. A Water Main shall be extended along the project site frontage contemporaneously with or prior to the construction of site improvements. The design and construction of the water main (i.e., size, depth, pipe and material, specifications and alignment) shall be per the requirements of the City of Groveport and City of Columbus (per service agreement with Columbus). A flushing device shall be provided by the developer if so required by City of Columbus, to be located in a setting that meets approval of the City of Groveport. 5. The developer shall implement traffic-related improvements so required by the office of the Franklin County Engineer and /or City of Groveport, including but not limited to possible lane widening on Hayes Road to local standards across the parcel frontage. 6. A Development Agreement be established and entered into between the City and Developer before site development begins, to memorialize requirements of the Developer for the public water main extension and for any roadway improvements as required as an outcome of the Traffic Impact Study review. 7. The sanitary pump station and force main from it shall be a private system. The design of the proposed sanitary sewer system for this development shall be subject to approval of City of Columbus and City of Groveport using agency design standards, including the Ohio EPA requirements. The Sanitary sewer pump station shall be located outside of public right-of-way. 8. Site development design shall conform to City of Groveport requirements, including but not limited to compliance with stormwater management policies and regulations and including compliance with standards for Stream Corridor Protection Zone (SCPZ). Any grading and site drives within the SCPZ shall require mitigation; drive width in the SCPZ shall not exceed 24-ft in width. That is the statement of amendments. This matter hit the City's lap last week. The Ohio Attorney General's Office has been negotiating a settlement with the big three distributors of opioids that precipitated the lawsuit by the State of Ohio, the counties, the townships, and the municipalities. The parties have reached an agreement, and the State requires ratification by August 13, 2021. City staff has reviewed this as recommended by the Ohio Municipal League legal counsel and represented by the Ohio Attorney General. Clerk of Council Ross read by title Ordinance No. 2021-041. Mayor - Lance Westcamp Mayor Westcamp publicly thanked Chief Casey Adams for what Council and staff witnessed tonight and all the work it took getting the sergeants in place. The Department made offers to three new patrol officers to start in September. Kids Fest was a great day, the Mayor was a little concerned with the City of Groveport Page 9 City Council Meeting Minutes August 9, 2021 crowd, but everyone was busy most of the day. B. Administrator - BJ King Administrator BJ King referred to the tree inventory reports he previously sent to the Mayor and Council. Mr. King is satisfied with the information; he was unsure if the format would be easy to follow, but the reports list the location and the needs of a specific tree. The City received a notice of when to expect the first allocation of 1/2 of the American Rescue Plan Act funds of $294,402. City Administration anticipates the subsequent distribution will come in 2022. The City can use the money on infrastructure improvements; water, sewer, etc. Groveport's first City Clean-Up Day, in conjunction with the National Clean-Up Day, is Saturday, September 18, from 9 am to noon. Mr. King congratulated the three newly sworn-in sergeants, all three good individuals. #207-2021 Admin report to Council Attachments: Admin report to Council August 9 2021.pdf C. Chief of Police - Casey Adams Chief Casey Adams reported there is a lot of excitement in the Police Department with the promotions and new hires. The Department has been down two or three officers since February/ March of this year. Chief Adams thanked Council and Administration for the union contract. Having been on the other side of the table in contract negotiations, the Chief could appreciate the officers' excitement once the talks were over. He thanked Finance Director Jason Carr, Administrator BJ King and Personnel Director Sue Wadley for their participation. This contract enables the City to retain and recruit officers. The new sergeants bring a total of 27 years of full-time experience with Groveport and another 20 years from outside agencies with John Westhoven and Josh Guiler. Groveport's current officers, and new officers, will be able to draw from all that experience. The three prospective candidates to start in September bring 21 years of experience to the Groveport police force. Groveport Madison School District starts classes on August 16th. Chief Adams had lunch at the Groveport Senior Center. Members were excited to be back and have some normalcy too. Mr. Lockett attended the Chief's HOA meeting held every Wednesday. The residents like to see the Mayor and Council Members and have them field their questions at the meetings. Mr. Lockett added that they had questions City of Groveport Page 10 City Council Meeting Minutes August 9, 2021 that pertained to Groveport as a whole, not just their end of town. D. Director of Finance - Jason Carr Council previously adopted Ordinance Number 2021-020 Amending Chapter 153, which pertains to restitution for damage to public property. Finance Director Jason Carr gave an update on the process of getting claims submitted in a timely manner. Since the passage of the Ordinance, there were six claims the City collected; the largest was $9,300 and the smallest $258.13. The City currently has $2,955 in collections and collected a total of $12,275. E. Director of Law - Kevin Shannon Law Director Shannon had nothing further to report. F. Development Director - Jeff Green Economic Development Director Jeff Green met with Dr. Alec Land about the hot rod shop property and a local business interested in possibly sharing space where the hot rod shop now stands. Dr. Land is still interested in building up, with the only issue being parking. G. Council Members - Jean Ann Hilbert, Ed Dildine, Shawn Cleary, Becky Hutson, Scott Lockett and John Hougland Council Member Cleary commented on how he enjoyed the Kids Fest event. H. Clerk of Council - Ruthanne Sargus Ross Clerk of Council Ross had nothing further to report. I. Standing Committees Cemetery Committee Council Member Cleary reported that the Cemetery Committee meeting would be in September due to conflicts with his work schedule. The Committee has to follow up with letters to owners of plots about complying with the rules and regulations at the cemetery. Apple Butter Day Committee Council Member Dildine reported that at an Apple Butter Day Committee meeting today, everything was in line and ready to go. The event is planned at full capacity until the City gets word differently. X. Other Business A. Executive Session Law Director Kevin Shannon requested Council to consider making a motion to go into Executive Session pursuant to Ohio Revised Code Section 121.22(G) to discuss (1) To consider the employment of a public employee and G (7) economic development matters. To include all members of Council, the Mayor, himself, the Administrator, Finance Director and the Economic Development Director for the economic matter which will be discussed first. A motion was made by Council Member Cleary, seconded by Council Member Dildine, to go into Executive Session pursuant to Ohio Revised Code Section 121.22(G) to discuss (1) To consider the employment of a public employee and G (7) economic development matters at 7:47 p.m. To include all members of Council, the Mayor, the Law Director, the Administrator, the Finance Director and the Economic Development Director for the economic matter. A motion was made by Council Member Hilbert, seconded by Council Member Dildine, to adopt. The motion carried by the following vote: Yes: 6- Cleary, Dildine, Hilbert, Hougland, Hutson and Lockett Law Director Kevin Shannon advised the Mayor, Council, and staff that City of Groveport Page 12 City Council Meeting Minutes August 9, 2021 the Ohio Ethics Commission prohibits them from receiving a gift from anyone who may have business before City Council at any given time, including any resident or citizen. The issue here is whether or not a book would constitute anything of value. The Governor's office gives some guidance but indicating that anything valued at $20 or less is insignificant and would not fall into play with respect to receiving something of value. The book indicates a $28 value on the back. Mr. Shannon's opinion is that Council can thank the resident and relay that City officials are not permitted to accept the gift. If Council wished, they could have the resident provide information on the books' cost and what they spent. Nevertheless, he thinks the best practice is for City officials or employees not to accept gifts. XI.
