Call to Order by Committee Chair Dildine at 6:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Linda Haley - Community Affairs Director, Steve Farst - Engineer, Dennis Moore - Public Works Superintendent, Kyle Lund - Parks and Recreation Director, Tom Walker - Director of Golf, Tom Byrne - Director of Facilities Management, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence Committee Chair Dildine asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call Absent: 2 - Council Member Hilbert, and Council Member Rarey Present: 4 - Council Member Cleary, Council Member Dildine, Council Member Drury, and Council Member Stoots V. Approval of Minutes - September 16, 2013 Approved as submitted. #108-2013 9-16-13 Committee Minutes Attachments: 9-16-13 Committee Minutes VI. Business of Guests Madison Township Fire Chief Bates - Update Madison Township Fire Chief Bates thanked Council for the Fire Prevention Week Proclamation. Open House at Station 182 had a nice turn out. He commented on the bright pink t-shirts firefighters will be wearing all month to support Breast Cancer Awareness and informed Council crews will be out to assist with Trick or Treat. Ordinances and Resolutions A. 3rd Readings ORD. 13-045 AN ORDINANCE AUTHORIZING THE CHARITY NEWSIES SALE Sponsors: Ed Rarey Chair Dildine read by title Ordinance No. 13-045. A motion was made by Council Member Cleary, seconded by Council Member Drury, that this Ordinance be recommended for approval. The motion carried by the following vote: Yes: 4 - Cleary, Dildine, Drury and Stoots ORD. 13-046 AN ORDINANCE AUTHORIZING THE GROVEPORT COMMUNITY IMPROVEMENT CORPORATION (HEREINAFTER "GROVEPORT CIC") TO SELL PARCEL NUMBER 185- , LOCATED AT 173 FRONT STREET IN THE CITY OF GROVEPORT, OHIO PURSUANT TO OHIO REVISED CODE SECTION 1724.10(B) Sponsors: Stoots City of Groveport Page 2 Committee of the Whole Meeting Minutes October 21, 2013 Administrator Hall stated CIC will meet, once the Ordinance is approved, to determine how the property will be sold. Council has already decided to sell the property. Ms. Hall related to Council she has received some interest in the residence. Chair Dildine commented the CIC is in the process of scheduling their next meeting. Chair Dildine read by title Ordinance No. 13-046. A motion was made by Council Member Drury, seconded by Council Member Stoots, that this Ordinance be recommended for approval. The motion carried by the following vote: Yes: 4 - Cleary, Dildine, Drury and Stoots B. 2nd Readings ORD. 13-050 AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ACCEPT THE ASSIGNMENT OF A UTILITY EASEMENT FROM GROVEPORT HOUSING, LLC AND THE DECLARATION OF AN EMERGENCY Sponsors: Dildine Law Director Shannon advised Council the Ordinance pertains to the Senior Housing development; explaining the basis for an assignment of easement in lieu of a grant of easement. A utility easement had to be negotiated with the adjoining property owner. As part of the project's completion and actual sale of the property, the easement will be conveyed to the City; so if there are any utility issues; we can step into the shoes of the original easement grantee and have access to the easement. This explains an assignment of an easement opposed to the City being granted an easement directly. Chair Dildine read by title Ordinance No. 13-050. A motion was made by Council Member Stoots, seconded by Council Member Cleary, that this Ordinance be recommended for approval. The motion carried by the following vote: Yes: 4 - Cleary, Dildine, Drury and Stoots ORD. 13-051 AN ORDINANCE AUTHORIZING A CONTRACT FOR THE PROVISION City of Groveport Page 3 Committee of the Whole Meeting Minutes October 21, 2013 OF HEALTH SERVICES WITH THE DISTRICT ADVISORY COUNCIL OF THE FRANKLIN COUNTY GENERAL HEALTH DISTRICT Sponsors: Drury Administrator Marsha Hall informed Council this Ordinance is the City's annual contract for health services with Franklin County Health District. The contract for 2014 of $33,085.65 reflects a 3% increase. Chair Dildine read by title Ordinance No. 13-051. A motion was made by Council Member Drury, seconded by Council Member Stoots, that this Ordinance be recommended for approval. The motion carried by the following vote: Yes: 4 - Cleary, Dildine, Drury and Stoots RES. 13-009 A RESOLUTION RATIFYING THE AMENDED MID-OHIO REGIONAL PLANNING COMMISSION ARTICLES OF AGREEMENT Sponsors: Hilbert Attachments: Ratifying MORPC Agreement.pdf Administrator Hall apprised Council of the changes to the MORPC Articles of Agreement. They are required to be ratified by a certain percentage of communities. Chair Dildine read by title Resolution No. 13-009. A motion was made by Council Member Stoots, seconded by Council Member Cleary, that this Resolution be recommended for approval. The motion carried by the following vote: Yes: 4 - Cleary, Dildine, Drury and Stoots X. Financial Report Finance Director Green detailed the September Financial Report. Income tax is up almost 50% this year due to an unusually high tax payment from a local company. The payment was investigated by Bob Curtin and the City of Columbus and was found to be a legitimate amount due to the City. The money will be placed in "Refunds and Fees" for safe keeping. Mr. Green informed Council $1 million has been invested in a 6 City of Groveport Page 4 Committee of the Whole Meeting Minutes October 21, 2013 month CD, accruing a higher interest rate of .30%. Mr. Green met with the City's investment advisor from 5/3 Bank, the City had over $2.7 million sitting in the money market, drawing approximately .05% interest. Traditionally, he tries to keep $1.5 million to cover the Rainy Day Fund in the money market account. However, he made the decision to put $1 million in the 6 month CD and invested a total of $3.25 million in investments, ranging from 6 months up to 5 years. The City looks to get about a 2% return on the 5 year investment. Mr. Green hopes to come back to Council next year with some strategies for Council to consider on how the money can be used to best meet the needs of the City. #109-2013 September 2013 Financial Report Attachments: September 2013 Financial Report XI. Community Affairs Director - Linda Haley Community Affairs Director, Linda Haley reminded Council of the annual "Cemetery Tour" set for Wednesday, October 23, 2013. The "merry not scary" event starts at 7:00 p.m. at Heritage Park. Ms. Haley reported the Annual Holiday Art Exhibit, especially geared for children, will feature "The Art of the Comic". The program instructs children on how to create a comic; starting with an idea, initial sketch, Photoshopping and creating an entire storyline. Kids will have the opportunity to create their own comic and submit them; the best ones to be included on the web comics. Council Member Drury commented on the new sign at Hendron Rd. and Main St. K. Director of Facilities Management - Tom Byrne City of Groveport Page 6 Committee of the Whole Meeting Minutes October 21, 2013 Facilities Director, Tom Byrne reported to Council he has received the final report from the energy audit and is currently putting together a presentation for directors and Council for the November 6, 2013 Budget Workshop. L. Engineer - Steve Farst Engineer Steve Farst updated Council on the completion of the Spiegel Drive Project and the progress of various other projects. M. Clerk of Council - Ruthanne S. Council Members - Ed Rarey, Jean Ann Hilbert, Donna Drury, Ed Dildine, Shawn Cleary and Jan Stoots Nothing to report. --- Executive Session Law Director Shannon requested Council consider going into executive session pursuant to Ohio Revised Code Section 121.22(G)(1) to consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee and/or public official and invited the Mayor, Council, Administrator Hall, Finance Director Green and himself. A motion was made by Council Member Cleary, seconded by Council Member Stoots, to go into executive session pursuant to Ohio Revised Code Sections 121.22(G)(1) at 6:53 p.m. to discuss the employment of a public employee and/or public official and invited the Mayor, Council, Law Director Shannon, Administrator Hall and Finance Director Green. The motion carried by the following vote: Yes: 5 - Cleary, Dildine, Drury and Stoots A motion was made by Council Member Stoots, seconded by Council Member Cleary, to come out of executive session at 7:28 p.m., with no action taken.
