Madison Township Fire Chief Fasone Madison Township Fire Chief Fasone reminded everyone that this is severe weather month. Walls collapsed in a building at Rickenbacker and at two warehouses in Hamilton Township during Sunday's high winds. Some roofs were blown off on Shook Road and one person was injured while standing next to a window when a tree came through the City of Groveport Page 1 Committee of the Whole Meeting Minutes April 15, 2019 window. Wayne White - Elm Street Parking Wayne White, 475 Elm Street, addressed Council with his concerns regarding the City's intent to introduce legislation for one-sided parking on Elm Street west of College Street. He inquired how the City decided to limit the parking to the south side as opposed to the north side of the street. Before he came to this meeting there were six cars parked on the north side of the street and one car parked on the south side. If the aforementioned legislation were to be adopted, all those cars would be parked on the south side. Hence the vehicles belonging to his neighbor across the street, will be parked directly in front of his house. He wouldn’t object to no parking on this portion of Elm Street. He would like Council to look into all the repercussions of limiting parking to one side of the street, whether it is the north or south side. Another issue Mr. White raised was the traffic that cuts through Elm Street and Hickory Alley to avoid the traffic light at College Street and Main Street. Drivers speed across Hickory Alley and Elm Street because of the "no turn on red" onto Main Street. The City will look into changing the "no turn on red" signage. Suggestions included restricting turns on red on certain days or adding times of day. VII. New Business None VIII. Unfinished Business None IX. Ordinances and Resolutions A. 3rd Readings ORD. 19-004 AN ORDINANCE AMENDING THE CODIFIED ORDINANCES OF GROVEPORT - PART THREE - TRAFFIC CODE, TITLE SEVEN, CHAPTER 351, SECTION 351.17, TRUCK PARKING IN RESIDENTIAL AREAS AND THE DECLARATION OF AN EMERGENCY City of Groveport Page 2 Committee of the Whole Meeting Minutes April 15, 2019 Sponsors: Hutson Attachments: ORD. 19-004 Exhibit A.pdf Marvin Draper, 4863 Saw Grove Court, addressed Council on the matter of heavy trucks parking on City streets in residential areas. Mr. Draper has been a resident of Groveport for three years. He moved here after living in Columbus for 66 years. Mr. Draper is retired from UPS where he drove a tractor and trailer for 32 years. He drove 6 years for Worthington Schools and now drives a six axle truck for a trucking company. He is well educated on heavy trucks and the damage they can cause to City streets and roadways. Unfortunately, there are a lot of bad semi-truck drivers out on our roads. These inexperienced drivers are going to run over curbs, sidewalks and tear the roads up that Groveport will need to repair. Law Director Kevin Shannon commented on the interrelationship of truck parking in residential areas (351.17 which falls under the Police department for enforcement) and the limitations of parking in residential zoning districts (1177.08 which falls under the Building and Zoning department for enforcement). The draft of this Ordinance changes the gross vehicle weight to 9,000 lbs. The crux of the debate is the weight of the newer models of personal passenger vehicles. The newer passenger vehicles are much heavier than the vehicles of the period of when this section code was originally written in 1988 and the 2 ½ tons (5,000 lbs.) made sense. Mr. Shannon clarified as to commercial vehicles under 1177.08, sections 1 and 2, are separate, distinct provisions as it relates to commercial vehicles in a residential area. 1177.08 LIMITATION OF PARKING IN RESIDENTIAL ZONING DISTRICTS. The provision of parking space, either open or enclosed for the parking or storage of vehicles in a Residential Zoning District or Planned Residential Zoning District as listed in Chapter 1151, shall be subject to the following: (a) Commercial Vehicles: (1) Not more than one truck limited to being a two-axle, four-tired pickup, panel or light truck, used strictly for commercial purposes, and which has operating characteristics similar to those of a passenger car shall be allowed per one (1) dwelling unit; (2) Trucks having dual tires on one (1) or more axles, or having more than two (2) axles, designed for the transportation of cargo, for commercial purposes and including, but not limited to tractor-trucks, trailers and semi-trailers shall not be allowed except in association with a home occupation, subject to approval in accordance with Section 351.17 of the Codified Ordinances and Chapter 1134 Conditional Use Review. Under this provision one cannot have these vehicles in the residential City of Groveport Page 3 Committee of the Whole Meeting Minutes April 15, 2019 areas and, if one does, it has to be associated with a home occupation, but still limited by section code 351.17 which pertains to the weight limitations of the vehicle itself. So, if an individual with a semi-tractor trailer somehow indicates it is associated with a home occupation, the vehicle would still be limited by 351.17. Mr. Shannon wanted to show the interplay between the two ordinances pertaining to the matter. Council Member Dildine raised concerns about changing the limit in 351.17 to 10,000 lbs. He does not want residents who currently own, or may want to own in the future, a regular Ford F350 (or any similar vehicle/ pickup truck) for personal use as a passenger vehicle, find they are in violation of the weight limits set forth in 351.17. Many of today’s models weigh more than 10,000 lbs. He has an issue with limiting people on what they can buy and park on their own driveway or neighborhood street, for their own personal use. After a long discussion on the points of the language in this Ordinance, it was agreed that the Mayor would appoint members of Council and officers of the Police department to serve on a committee to look more thoroughly into the issues at hand. ORD. 19-012 AN ORDINANCE AMENDING PART THIRTEEN - BUILDING CODE, CHAPTER 1322 - ENGINEERING REVIEW AND INSPECTION FEES OF THE CODIFIED ORDINANCES OF THE CITY OF GROVEPORT Sponsors: Cleary Attachments: ORD. 19-012 Exhibit A.pdf Chief Building Official, Stephen Moore, explained this Ordinance pertains to both engineering and zoning fee changes. The zoning language was changed to better clarify the fees. The biggest change made was adding a zoning verification for existing buildings that will be occupied by a new tenant. This change has been added to the City’s new zoning code. This changes the process and saves money for the new tenant if they plan to use the building for something other than the zoning allows. City Engineer, Steve Farst, stated the engineering fees apply once a project commences. These fees are designed to reimburse the City for expenses incurred for specialized consultants and other necessary outsourcing. Fees have been added for additional requirements in regard to stormwater operating and maintenance plans mandated by City of Groveport Page 4 Committee of the Whole Meeting Minutes April 15, 2019 the EPA. Another change pertains to the Traffic Impact Study (TIS). When a TIS plan review is needed these fees cover the cost of a non-complex and a complex traffic impact study. The motion carried by the following vote: Yes: 6- Cleary,Dildine,Grashel,Hilbert,Hutson, and Lockett B. 2nd Readings ORD. 19-018 AN ORDINANCE ESTABLISHING MEMBERSHIP FEES FOR THE RECREATION CENTER THEREBY AMENDING THE FEE SCHEDULE SET FORTH IN ORDINANCE NO. 13-005 Sponsors: Cleary Attachments: ORD. 19-018 Exhibit A.pdf Director of Recreation, Kyle Lund, explained that this Ordinance would make the fees for the day passes to the outdoor water park and the recreation center the same. Staff looks to make the birthday party packages the same fees for the outdoor package and the indoor package. Also, all age groups would be charged the same rate. No changes to membership fees. Financial Report Finance Director, Jeff Green, informed Council that there was no income tax report in this financial report because the department is still trying to figure out how the information should be presented. The City of Columbus just sends a spreadsheet that is very easy to duplicate. The information that comes from RITA is altogether different. Mayor - Lance Westcamp Mayor Lance Westcamp commented that he asked Mr. Green at lunch today which of his three hats he was wearing today. He thanked Mr. Green for stepping up to the plate during Administrator Hall’s vacation. The Mayor had the honor of attending “Shrek the Musical” at Groveport Madison High School. It was an excellent performance for an auditorium that was 2/3 full. B. Administrator - Marsha Hall Not present. C. Director of Law - Kevin Shannon a. Elm Street Parking Law Director Shannon advised Council that he had drawn up a draft ordinance addressing the matter of parking on Elm Street in anticipation of Council wanting the ordinance on next week’s agenda for first reading. The ordinance would limit parking on Elm Street to the south side from College Street to West Street. A letter from Administrator Hall indicated that there were issues/complaints in the neighborhood regarding the particular area. Council directed Mr. Shannon to have the ordinance on the agenda at next week’s meeting for its first reading. D. The event was put on by the Groveport Madison Boosters. Council Member Cleary wished everyone a blessed Easter. XIII.
