A Special Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jecsey, on Wednesday, December 19, 1990. Mayoc Zisa called the meeting' to ocdec at 5:05 P.M. and asked everyone to stand foe the flag salute. On coll call the following wece present: Councilmen Mack Stein and Rogec Mattei and Mayoc Zisa, City Cleek Docis L. Dukes, City Manager James s. Lacava and City Attorney Richard E. Salkin. Councilman Mecca accived at 5:10 P. M. and Deputy Mayoc Robinson I accived at 5:16 P. M. Mayoc Zisa stated that Ordinance No. 45-90 was tabled on Monday, December 17th and the public hearing on the ordinance was held and closed. He asked the City Clerk to read the resolution foe Ordinance No. 45-90. Resolution i 440 OFFERED BY: MATTEI SECONDED BY: STEIN BE IT RESOLVED by the City Council of the City of Hackensack, County of Becgen and State of New Jersey that Ordinance No. 45-90 entitled: "AN ORDINANCE TO AMEND AND SUPPLEMENT ARTICLE I OF CHAPTER 32 OF THE CODE OF THE CITY OF HACKENSACK, NEW JERSEY, ENTITLED 'POLICE DEPARTMENT ESTABLISHMENT • • AND ADMINISTRATION'", pass its second and final reading and is hereby adopted. Roll Call: Ayes - Stein, Mattei and Zisa Absent - Mecca and Robinson FINAL ADOPTION OF ORDINANCE NO. 41-90 ENTITLED" "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION AND SALARY RANGES FOR CERTAIN EMPLOYEES OF THE FIRE DEPARTMENT OF THE CITY OF HACKENSACK". I Mayor Zisa asked for a motion to hold a public hearing on this ordinance. Motion offered by Stein, seconded by Mattei that there be a public hearing. Carried. The Mayor asked if anyone wished to be heard on this ordinance and there was no response. Motion offered by Stein, seconded by Mattei that the public hearing be closed. Carried. Resolution 1472 OFFERED BY: MATTEI SECONDED BY: STEIN BE IT RESOLVED by the City Council of the City of 'Hackensack, County of Bergen and State of New Jersey that Ordinance No. 41-90 entitled: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION AND SALARY RANGES FOR CERTAIN EMPLOYEES OF THE FIRE DEPARTMENT OF THE CITY OF HACKENSACK", pass its second and final reading and is hereby adopted. Mayoc Zisa asked if anyone in the audience wished to speak on this ordinance. There was no response. Dr. Mecca asked what is the ordinance for and was told for the EMT's. Motion offered by Stein, seconded, Mattei that the public hearing be closed. Carried. Resolution #473 OFFERED BY: STEIN SECONDED BY: MATTEI BE IT RESOLVED by the City Council of the City of Hackensack, County of Bergen and State of New Jersey that Ordinance No. 42-90 entitled: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION AND SALARY RANGES FOR CERTAIN EMPLOYEES OF THE FIRE DEPARTMENT OF THE CITY OF HACKENSACK", pass I its second and final reading and is hereby adopted. Mayor Zisa asked for a motion to hold a public hearing. A motion was offered by Mattei, seconded by Stein that th�re be a public hearing. Carried. Resolution #474 OFFERED BY: STEIN SECONDED BY: MATTEI I BE IT RESOLVED by the City Council of the City of Hackensack, County of Bergen and State of New Jersey that II Ordinance No. 43-90 entitled: AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND SALARY RANGES FOR CERTAIN CONTRACTUAL OFFICERS AND EMPLOYEES OF THE CITY OF HACKENSACK11, pass its second and final reading and is hereby adopted. Roll Call: Ayes - Stein, Mattei, Zisa Nay - Mecca Absent - Robinson Resolution #475 OFFERED BY: MATTEI SEOCNDED BY: MECCA WHEREAS, there exists various very old deposits on the balance sheet of the Trust Fund; and WHEREAS, the funds creating these deposits have been investigated and it has been determined that these deposits should be cancelled; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hackensack that the following deposits in the amount of $1,004. 254, be and the same is hereby cancelled: I Security Permits $ 78. 00; Incinerator Coupons $326. 25; Rental Security $600. 00 The Deputy Mayor arrived at this time Roll Call: Ayes - Mecca, Stein, Mattei, Zisa Abstained - Robinson Resolution #476 OFFERED BY: STEIN SECONDED BY: MATTEI WHEREAS, there exists unallocated tax overpayments on the books of the Tax Collector; and WHEREAS, these overpayments have been investigated and it has been determined that these overpayments should be cancelled; NOW, THEREFORE, BE IT RESOLVED by the City Council of the I City of Hackensack that the Tax Collector is hereby authorized to cancel the amount of $11,166.13 from the tax overpayment records. Roll Call: Ayes - Mecca, Stein, Mattei, Zisa Abstained - Robinson Resolution #477 OFFERED BY: Mattei SECONDED BY: Mecca WHEREAS, the following Public Parking System Utility budget appropriation balance remains unexpended: CAPITAL OUTLAY $100,000. 00 WHEREAS, it is necessary to formally cancel said balance, so that the unexpended balance my be credited to surplus; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the above listed unexpended balance of the Public Parking System Utility be cancelled. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Mr. Lacava explained that this money was allocated for this fund in case there was a shortage because of the Parking Garage. He said it was not needed and it must be cancelled before we can put it back in surplus. I Prior to any action being taken, the City Attorney stated, for the purpose of clarity, that although certain items were not included when the paper was notified, the fact that sufficient notice of the special meeting had been given to the newspaper is enough to satisfy the requirements of the law. Since it is not an emergency meeting, other iterns can be added after the scheduled meeting. He noted additional resolutions which were added and said there is nothing improper about these iterns being on the agenda. He advised that he is satisfied that the law has been complied with. The Mayor asked the City Manager and City Attorney if they had anything to report. They did not. He then asked the members of Council if they wished to speak. Councilman Mecca stated that he objected to the ordinance (No. 45-90, regarding the Police Chief, ) was acted on. He had called the City Manager and told him to report that he would be late. He said the meeting could have been held until he arrived. The Mayor said there is another meeting scheduled in these I chambers after this meeting and we started a few minutes after 5 P. M. Councilman Mecca asked if he would be allowed to ask questions relating the ordinance and when told yes, he proceeded to ask the City Manager many questions regarding the table of organization chart for the Police Department and the report forwarded to members of Council on December 18, 1990. Mr. Lacava responded to his questions. Mayor Zisa, Councilman Mattei and Stein also made some comments as a result of Dr. Mecca 's questions. Deputy Mayor Robinson also said she was appalled that she meeting started prior to her arrival and asked if the table of organization chart is now available as a public record. She was told yes. Mayor Zisa reported that a letter had been sent Governor Florio requesting a visit to Hackensack and today a response was received. He will be in the City tomorrow.
