City Council

The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, December 17, 1990. Mayor Zisa called the meeting to order at 8:05 P. M. and asked everyone to stand for the flag salute. On roll call the following were present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salkin, City I Manager James s. Lacava and Deputy City Clerk Anna LaMarche. Absent: City Clerk Doris L. Dukes Mrs. LaMarche: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall." Mayor Zisa asked for approval of the minutes for the meetings of December 3, 1990. Motion offered by Stein, seconded by Mecca that the minutes be approved as submitted. Roll Call: Mecca: I was one of the ones who voted against both the Fire and Police contracts. I stand by that vote. I do not believe that this City can afford these salary increases. True arbitration can be fought within the context of the law. NAY Robinson: I have an obligation to look at the budget and I salaries of all departments. I am not at ease with dealing with three year contracts but feel compelled to stand by information given me by the labor counsel and the City attorney. AYE Stein: One of my responsibilities is to uphold the laws of this State. Under state law, whether we like it or not, we are compelled to honor PERC law. I am not happy with those laws. The negotiators did an excellent j ob with this contract as compared to comparable contracts. AYE Mattei: The Deputy Mayor and Councilman Stein said it eloquently - legislation rules. I The City Attorney commented on this statement. I Rainer Olster, 144I Union Street, asked questions about the ordinance which were apswered by the City Manager. Mr. Olster opposed the salary increases and urged that we should "fight arbitration". I Alexis Palinkas, 23� Prospect Avenue, commented that we live in a very expensive area and salary increases reflect that. She added that she would not like to see cuts. in Fire and Police departments. I I t Nat Schatzoff, 101 Prospect Avenue, spoke in favor of the ordinance. A YE  Resolution i439 WHEREAS, in 1977, after a two ( 2) year study, the State Legislature enacted legislation that compels municipalities and other public employers to face the prospect of being sub jected to binding arbitration when negotiating labor contracts with police and fire unions: and WHEREAS, the history and experience of the compulsory arbitration system forced upon municipalities such as Hackensack by the State Legislature demonstrates to the satisfaction of the Mayor and Council that, however well intentioned the original concept, the I present reality of the system is a perversion of logic and common sense: and WHEREAS, while ostensibly charged by law with the responsibility of preparing annual budgets that are responsive to the financial limitations of its citizens, the governing bodies of the communities throughout this State have seen their role usurped by a handful of State arbitrators: and WHEREAS, it is the perception of the Mayor and Council that such State Arbitrators: 1. Give little to no consideration to the taxpayers' ability to pay for the awards given through arbitration: and 2. Are apparently oblivious to economic trends generally, and to the plight of the New Jersey taxpayer in particular: and 3. Place undue emphasis upon the determination of salary levels in so-called "comparable communities" in arriving at their arbitration awards. This results in a seemingly never-ending upward spiral of salary increases that are clearly outpacing the taxpayers' reasonable burdens of taxation: and t WHEREAS, it is clear to the Mayor and Council of the City of Hackensack that the net result of this compulsory arbitration system is that the arbitrator, a stranger to the community and its needs, effectively determines significant portions of the municipality's budget and tax burden, while the governing body is reduced to a role of a monitor of "damage control". Invariably, communities which elect to contest the union demands to the point of a decision from the arbitrator are saddled with contract awards far beyond their ability to pay, (as has recently occurred in Fair Lawn and Maywood), while the remaining communities must enter into settlements of the disputes at levels beyond that which the citizenry and the governing body believes to be reasonable and affordable, strictly out of the justified fear that an award by an arbitrator would be yet more expensive and damaging to the taxpayer: and WHEREAS, when municipalities have protested the foregoing scenario, the response from the courts and the arbitrators has effectively been "either raise taxes or cut basic services to your residents to pay for these contracts": and WHEREAS, the Mayor and Council find no fault with any union, nor the membership thereof, for pressing for the highest level of compensation they can obtain for their services within this system. The Mayor and Council do, however, find fault with a system that preordains "losing hands" being dealt to the municipalities from a I "stacked deck" and mislabels the process "bargaining": and WHEREAS, recently the Mayor and Council of the City of Hackensack have been compelled to enact salary ordinances. ordinances, respectively, reflect the settlements of the labor These contracts with P.B.A. Local i9 (Police Department), I.A.F.F. Local 2081 (Firefighters), I.A.F.F. Local 317 2 (Fire Officers). The salary increases reflected in these ordinances, while certainly lower than that which would have been produced by an arbitrator's award, still exceeded those levels believed by the Mayor and Council and the City Manager to be fair, reasonable, and most importantly, affordable to the taxpayers of Hackensack: and  I , , WHEREAS, on the basis of the existing trends in the national economy in general, and the economy of New Jersey in partjcular, the ¥ Mayor and Council of the City of Hackensack believe that the compulsory arbitration s stem, as · it presently exists, is steering New Jersey Municipalities down a path which will lead to the � situation where residents will be deprived of those basic services which are necessary to th orderly function of their communities. I ; NOW I THEREFORE I BE IT RESOLVED by the Mayor and Council of the City of Hackensack, New Jersey, that the State Legislature consider immediate legislation to1 establish a study commission charged with t the responsibility to: I 1. : Review the thirteen ( 13) year history of the compulsory arbitration provisions contained in N.J.S.A. 34:13A-14, et seq., and the impact it has had on New Jerse i Communities: and I I 2. Make a recommen�ation to the State Legislature on the basis of its findings as to whether the compulsory arbitration legislation should be repealed. : I BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and- directed to cause a: copy of this resolution to be served upon Governor James Florio, I State Senator Paul Contillo, Assemblymen William P. Shuber and· Patrick J. Roma, and the Clerl:s of each municipality within Bergen I County. I A motion was offered by Mattei and seconded by Stein. On roll call, Dr. Mecca commended the City Attorney for this resolution and voted AYE. Ms. Robins�n requested that the Council members make changes in certain areas� After much discussion, a motion to table this resolution until the next work session was made by Mattei, 1 seconded by Stein. Grover Reynolds, 197 Berdan Place, made several comments concerning the promotion : of the Police Chief and others. Mayor Zisa reminded Mr. Reynolds that the public hearing was for the ordinance being considered for adoption and that he could speak at the public portion of the meeting if' he chose. Mr. Reynolds stated he would speak at that time. Rainer Olster, 144 bnion Street, questioned if this position is newly created and if it �s necessary. I I : The Mayor explained that this position has been on th•� books for many years, but had been deleted a few years ago. It would be filled through an appointment by the City Manager. I The City Manager ad� ed that when the new Chief was appointed, a reorganization of the department was discussed. With the safety of the citizens and the saving of money for the City in mind, a new Table of Organization wa� set up. , Mr. Lacava reviewed the table and explained the organizat i on of the Police Department and what this ordinance will bring to the department. I I Margaret Otchy, 359 Anderson I Street, stated she was confused  about the Table of Organization. The Mayor asked Mr. Lacava to explain the savings with the new Table which he did. Mrs. Otchy commented that she felt the Police Department was top heavy. Eric Martindale, 322 Park Street, spoke in favor of the ordinance. Joseph Consentino, Hamilton Place, raised several questions about the Table of Organization and in particular details on the savings that would be realized as a result of this Table. Mr. Lacava answered these questions. I Motion offered by Mattei, hearing be closed. Carried. A motion was offered by Mattei, seconded by Stein. Dr. Mecca commented that the Table of Organization was distributed to the Council members only eight minutes before the Regular Meeting and he did not have sufficient time to discuss it with anyone or review it himself. The Mayor noted that the Council was not voting on the Table of Organization. It was put forward to the Council the previous week at everyone 's request. The Table was offered for review showing changes in an effort to further economize. I After lengthy discussion, a motion was made by Dr. Mecca to table this resolution until the previously scheduled special meeting on December 19th, and was seconded by Ms. Robinson.
