lff The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, December 2, 1996. Mayor Zisa called the meeting to order at 8:00 P.M. and asked everyone to stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present: Councilman Jesus R. Galvis, Councilwoman Juanita Trammell, Councilman Mark A. Stein, Mayor John F. Zisa, City I Manager James S. Lacava, City Clerk Doris L. Dukes and City Attorney Richard E. Salkin Absent - Deputy Mayor Roger B. Mattei Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy of same on the Bulletin Board in City Hall." Mayor Zisa called for a motion to approve the minutes of the meetings held November 18, 1996. Motion offered by Trammell, seconded by Stein that the minutes be approved as submitted. Carried Resolution #365 OFFERED BY: GALVIS SECONDED BY: STEIN BE IT RESOLVED by the City Council of the City of Hackensack that the following organization be granted permission to conduct Bingo games in accordance with the application on file in the office of the City Clerk: BA: 1516 Roman Catholic Church of the Holy Trinity I Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #366 OFFERED BY: TRAMMELL SECONDED BY: STEIN WHEREAS, there have been various County Tax Board judgments, as well as erroneous payments, veteran and senior citizen allowances made on various properties in the City of Hackensack for the years 1995 and 1996, ranging from $19.26 to $25,109.00; and WHEREAS, a schedule designated as "Exhibit A", dated November 21, 1996, is on file in the office of the Tax Collector as a public record; and WHEREAS, said 180 individual amounts total $180,555.42. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the proper officers be and are hereby authorized to make the refunds reflected on "Exhibit A, November 21, 1996". Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #367 OFFERED BY: STEIN SECONDED BY: TRAMMELL I WHEREAS, Jay Alpert, Police Sergeant, is requesting a twelve (12) month leave of absence, without pay, in order to continue to serve Bergen County as Undersheriff; and WHEREAS, City Manager James S. Lacava has determined that this employee be granted a twelve ( 12) month leave of absence, as requested, effective January 1, 1997 and terminating December 31, 1997. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that Jay Alpert, Police Sergeant, be granted a twelve (12) month leave of absence, without pay, as requested; and BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to the employee's pension system by the Chief Financial Officer. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #368 OFFERED BY: TRAMMELL SECONDED BY: GALVIS I WHEREAS, there exists in the City of Hackensack a need for the services of a Risk Management and Safety Consultant to provide specialized training for City employees and to assist the safety program, per state regulations; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A.40All-5(l)(a)(i) of the Local Public Contracts Law; and WHEREAS, it is the desire of the Mayor and Council to retain the services of E. J. Tobias & Associates as Risk Management and Safety Consultant for the City of Hackensack for an amount not to exceed $13,200.00 for twelve months; and WHEREAS, a certificate establishing that funds will be available in the 1997 budget from Account #7-010-855-204 of the Current Fund in the amount of $13,200.00 (P.O. #97105) has been issued by the Chief Financial Officer; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bidding and the contract must be available for public inspection. NOW, THEREFORE, BE IT RESOLVED the City of Hackensack that: by the Mayor and Council of I (1) The Mayor and City Clerk be and they are hereby authorized and directed to execute a contract with E. J. Tobias & Associates, 81 Morrissee Avenue, Wallington, New Jersey, to perform the aforesaid services. (2) This contract is awarded without competitive bidding as a professional service in accordance with the Local Public Contracts Law (N.J.S.A. 40A:ll-l et seq.); and BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy of the contract for public inspection and to publish a notice of this action once in the Record. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #369 OFFERED BY: STEIN SECONDED BY: TRAMMELL INTRODUCTION OF ORDINANCE NO. 24-96 ENTITLED: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION AND SALARY RANGES FOR CERTAIN EMPLOYEES OF THE POLICE DEPARTMENT OF THE CITY OF I HACKENSACK". BE IT RESOLVED that the above ordinance, being Ordinance No. 24-96 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be held on December 16, 1996, at 8:00 P.M, or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said Ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and /16 where said Ordinance will be further considered for final passage. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #370 OFFERED BY: GALVIS SECONDED BY: TRAMMELL INTRODUCTION OF ORDINANCE NO. 25-96 ENTITLED: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND SALARY RANGES FOR CERTAIN CONTRACTUAL OFFICERS AND EMPLOYEES OF THE CITY OF HACKENSACK". I BE IT RESOLVED that the above ordinance, being Ordinance No. 25-96 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be held on December 16, 1996, at 8:00 P.M, or as soon thereafter as the matter can be reached at the regular meeting place of the City Council, and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said Ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and where said Ordinance will be further considered for final passage. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #371 OFFERED BY: STEIN SECONDED BY: GALVIS INTRODUCTION OF ORDINANCE NO. 26-96 ENTITLED: "AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, NEW JERSEY, ENTITLED: 'VEHICLES AND TRAFFIC'"· BE IT RESOLVED that the above ordinance, being Ordinance No. 26-96 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be I held on December 16, 1996, at 8:00 P.M, or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said Ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and where said Ordinance will be further considered for final passage. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Resolution #372 OFFERED BY: TRAMMELL SECONDED BY: STEIN BE IT RESOLVED by the City Council of the City of Hackensack that the bills in the following accounts be and are hereby ordered paid: General Account $ 5,354,880.53 Public Assistance II Account 8,997.01 Capital Account 305,957.43 Public Parking System Account 6,265.68 Trust Account 9,833.00 Payroll Agency Account 85,794.86 SUI Account 34,104.48 I UDAG Account 200,000.00 BE IT FURTHER RESOLVED that said bills are on file as a public record in the office of the Chief Financial Officer. Roll Call: Ayes - Galvis, Trammell, Stein, Zisa Absent - Mattei Mrs. Dukes advised the Mayor that her Docket was completed. Mayor Zisa thanked her and asked the City Manager, City 117 Attorney and members of Council if they had anything to report. They did not. Mayor Zisa announced the annual tree lighting will be held on Wednesday, December 4th, at 4:30 P. M. at the Green. Mayor Zisa opened the meeting to the public for discussion of City business. Dorothy Schwartz, 47 Prospect Avenue, stated her opinion on the homeless issue. Rainer Olster, 144 Union Street, and Jack Donovan, Willow Avenue, also stated their opinions on the homeless matter in I Hackensack.
