City Council

The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, July 21, 1997. Mayor Zisa called the meeting to order at 8:0 5 P. M. and asked everyone to stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present - Councilmen Roger B. Mattei, Jesus R. Galvis, Deputy Mayor Juanita Trammell, Councilman Mark A. Stein, Mayor John F. I Zisa, City Manager James S. Lacava, City Clerk Doris L. Dukes and City Attorney Richard E. Salkin Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975 adequate notice of this meeting was provided by sending a notice to The Record and by posting a copy on the Bulletin Board in City Hall." Mayor Zisa called for a motion to approve the minutes of the meetings held July 1, 1997. Motion offered by Stein, seconded by Galvis that the minutes be approved as submitted. Carried FINAL ADOPTION OF ORDINANCE NO. 10-97 ENTITLED: "AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 134 OF THE CODE OF THE CITY OF HACKENSACK, NEW JERSEY, ENTITLED 'RENT STABILIZATION'". Mayor Zisa: "This Ordinance has been advertised pursuant to law and now calls for a public hearing. Will someone so move?" Motion offered by Trammell, seconded by Galvis that there be a public hearing. Carried Mayor Zisa asked if anyone present wished to be heard on this I Ordinance. Dorothy Schwartz, 47 Prospect Avenue, said the tenants are entitled to relief and was shocked that the ordinance did not allow for a yearly reduction in rents. She objected to having to file a 1040 in order to qualify, adding that privacy is a real concern. Nat Shatzoff, 101 Prospect Avenue, also felt the ordinance should have allowed for a rent reduction for all tenants, not just senior citizens. He said to ask senior citizens to file their income for 1% is insulting. Mayor Zisa asked him if he had any other appropriate method to determine qualification. If there is another valid document, let him know. Salvatore Moretti, 390 Park Street, also addressed the subject matter. Thomas Cafferty, Attorney representing The Record, stated his client has three publications, the newspaper, The Record Now and Life Time, which would all be aff ected by this ordinance. He wanted to work with the City towards a solution.  When Councilman Mattei asked what happened to "hiring paper boys", he stated that due to economics, The Record's publications could no longer be "delivered". The City Attorney presented "The Record Now" in a yellow plastic bag which was thrown in his driveway, and requested it be marked in the record. Mr. Salkin said the ordinance does not discourage the delivery of papers, but it does require that the papers be delivered to within five feet of the door. It was pointed out that these publications and others that may exist cpuld cause problems in alerting burglars that the homeowners are away when they are left on the property for s everal days. It I was also noted that residents have called The Record to tell them they do not want the publications and their requests were ignored. Mr. Stein added that a window was broken in his home due to the papers being thrown and his car was damaged. Richard Rankin, 430 Union Street, made comments regarding the freedom of the press. John Aletta, 286 Poplar Avenue, s aid he has been trying to stop delivery of the papers for two or three years . He keeps calling The Record and they are still throwing the papers on his property. He presented photos of his snow blower which was damaged, while in use, by a paper in a yellow plastic bag that had been thrown in his driveway. He said the cos t to fix it was $250.00 and he had to manually shovel the snow. Salvatore Moretti, 390 Park Street, s aid the paper provides a service by the inclusion of help wanted ads. During the public hearing, Mayor Zisa addres sed certain comments made by some of the speakers. Motion offered by Trammell, seconded by Stein that the public hearing be closed. Carried Mr. Salkin recommended the following amendment to the ordinance, stating that it does not require readvertising and does not require deferring final adoption. Resolution #232 OFFERED BY: TRAMMELL SECONDED BY: STEIN WHEREAS, the governing body of the City of Hackensack has been advised that an emergency affecting the health, safety and welfare I of the citizens of Hackensack due to a sewer line blockage on Main Street; and WHEREAS, the governing body is satisfied that an emergency does exist and that immediate action is necessary to correct the condition; and WHEREAS, the estimated cost to correct the condition is $16, 996. 88, including engineering fees, which is a fair and reasonable quotation; and  WHEREAS, the Chief Financial Officer has certified that funds are available in account #X-050-N04-002 of the.Capital Fund, P.O. #100719. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation I entitled "Woman's World v. City of Hackensack", Docket Nos. 0100010-95 and 008816-96 presently pending in the Tax Court of New Jersey so that the assessments be affirmed for each lot for each year under appeal and that the assessments for Lots 20 and 20A be affirmed for each year and that the provisions of the Freeze Act (N. J. S. A. 54:51A-8) be incorporated into such settlement documents; and  BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. Mayor Zisa thanked her and asked the City Manager, City Attorney and members of Council if they had anything to report. They did not. Mayor Zisa stated the July 4th Celebration was spectacular and asked the City Manager to convey the Mayor and Council's appreciation to all department heads and staff involved. Councilman Galvis also thanked those involved in the Colombian Day Celebration held on July 13th. The Mayor opened the meeting to the public for discussion of City business. Samuel Person, 230 Central Avenue, suggested tennis courts and basketball courts be installed in Foschini Park. Mayor Zisa advised that the City has invested a lot of money in Foschini Park, and pointed out that there are tennis courts by the High School and I Carver Park as well as basketball courts with both being very close to his home. Joseph Rossi, 245 Cedar Avenue, asked questions regarding Resolution #236, which were answered by the Mayor. Richard Rankin, 430 Union Street, also made some comments regarding Resolution #236. Lenny Nix, Elm Avenue, again addressed the Oliveri Property as it relates to their permits. Salvatore Moretti, 390 Park Street, said he was concerned about the condition of the area of Park Street. Larry Riley, 27 Rowland Avenue, asked the status of the parking of commercial, vehicles in residential zones, the reason being that a New York Taxi Cab is parked in front of his home at night and sometimes does not move for two days. He has called the Police and they refuse to ticket the vehicle. Mayor Zisa replied that the discussion will take place during the review of the Master Plan. However, the taxi is in direct violation of the law and they should be ticketed. The Mayor suggested he call Mr. Duffy about an approximate time frame for I discussion of the Master Plan.  Motion offered by Galvis, seconded by Stein that the public hearing be closed and the meeting be adjourned.
