2-82 CHAPTER 170-49.2 “PARKING FOR THE HANDICAPPED”, TO
INCLUDE THE NORTH SIDE OF CLAY STREET FROM A POINT 155 FEET
EAST FROM THE NORTHEAST CURB LINE APEX OF CLAY STREET AND
FIRST STREET TO A POINT 20 FEET EAST THEREOF.

WHEREAS, pursuant to N.J.S.A. 40:56-84, the District
Management Corporation known as the “Main Street Business
Alliance, Inc.” has submitted its proposed budget for 2007
to the Mayor and Council of the City of Hackensack in the
amount of $ 260,595.00 for the purposes of introduction; and
WHEREAS, municipal approval of said budget may be
conferred only upon compliance with the requested statutory
notices and procedures, and not prior to a public hearing on
said budget to be held not less than twenty-eight (28) days
from the date of introduction;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Hackensack as follows:
1. The appropriate City Officials are hereby
directed to undertake all necessary
procedures set forth in N.J.S.A. 40:56-84
prior to the Public Hearing on the proposed
budget; and
2. May 8, 2007 at 7:00 P.M., is hereby
established as the date of the public hearing

WHEREAS, the governing body of the City of Hackensack
has been advised that an emergency affecting the welfare of
the citizens of the City of Hackensack and the general
public when a sewer line collapsed on East Broadway and
Hudson Street and was rendered inoperable; and
WHEREAS, the Project Manager notified the City Manager
setting forth the circumstances regarding the emergency; and
WHEREAS, the governing body is satisfied that a
emergency did exist and that immediate action was necessary
to restore the aforementioned line to full operation; and
WHEREAS, the cost of the repair was $3,629.00, which
was a fair and reasonable quotation; and
WHEREAS, the Chief Financial Officer has certified that
funds are available in account #7-01-26-311-311-204,
Purchase order #154665;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Hackensack that pursuant to N.J.S.A.40A:11-6
which authorizes the governing body to award contracts
without benefit of public bidding in emergency situations
and the vendor J. Fletcher Creamer & Son, Inc., 101 East
Broadway, Hackensack, New Jersey 07601 be paid therefore.

WHEREAS, the Governing Body of the City of Hackensack
has agreed to apply for a PARIS Grant in the amount of
$50,000; and
WHEREAS, the Governing Body of the City of Hackensack
is acknowledging and accepting the responsibility of acting
as applicant for this grant; and
WHEREAS, the State of New Jersey has made PARIS grants
available to assist county and municipal governments in
their records management, preservation and storage efforts;
and
WHEREAS, the purpose of this grant is to conduct an
archives and records management needs assessment and
strategic plan;
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of
the City of Hackensack that the City does hereby apply for a
PARIS grant for the purpose cited above.

WHEREAS, it is the wish of the City of Hackensack to
conform with Chapter 119, Laws of 1973, N.J.S.A. 54:4-14
Governing Reg. 18:12A-1.6, which deals with petition of
appeal; and
WHEREAS, The Bergen County Board of Taxation shall not
accept, for filing, any petitions of appeal by the taxing
district unless the petition is accompanied by a certified
copy of a resolution of the governing body authorizing the
appeal; and
WHEREAS, upon continuing review of the tax list it may
become apparent that inequities may exist or errors may have
been made, which will require correction by appeal to the
Bergen County Board of Taxation;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council
of the City of Hackensack that they hereby authorize the Tax
Collector and/or the City Tax Attorney to execute petition
of appeal by the City of Hackensack to the Bergen County
Board of Taxation in any and all cases where inequities or
errors may exist for the tax year 2007 and further authorize
the Tax Collector and/or City Tax Attorney to take any all
actions that may be required to prosecute same to the final
determination.

WHEREAS, various 2006 bills have been presented for payment this year, which
bills were not covered by order number and/or recorded at the time of transfers between
the 2006 Budget Appropriation Reserve in the last two months of 2006; and
WHEREAS, N.J.S. 40A: 4-58 provides that all unexpended balances carried
forward after the close of the year are available, until lapsed at the close of the
succeeding year, and allow transfers to be made from unexpended balances which are
expected to be sufficient during the first three months of the succeeding year;

WHEREAS, an emergent condition has risen with respect to insufficient
temporary appropriations to facilitate the awarding of contracts and payments of bills and
salaries an no adequate provision has been made in the 2007 Temporary Appropriations
for the aforesaid purpose, and N.J.S. 40A: 4-20 provides for the creation of an emergency
temporary appropriation for the purpose above mentioned;
WHEREAS, the total emergency temporary resolutions adopted in the year 2007
pursuant to the provisions of N.J.S.40A: 4-20 (Chapter 96, P.L. 1951) including this
resolution total $12,973,312.82;
NOW, THEREFORE, BE IT RESOLVED (not less than two-thirds of all the
members thereof affirmatively concurring) that in accordance with N.J.S. 40A: 4-20:
1) An emergency temporary appropriation be and the same is hereby made
for the awarding of annual contracts in the amount of $12,973,312.82.
2) That said emergency temporary appropriations will be provided for in
the 2007 Budget.

WHEREAS, pursuant to Resolution No. 362, adopted October 17, 2006 by
the Mayor and Council of the City of Hackensack, the Planning Board of the City
of Hackensack was authorized to undertake a preliminary investigation to make a
determination pursuant to N.J.S.A. 40A:12A-6 as to whether certain properties
were qualified as areas in need of redevelopment; and
WHEREAS, the Mayor and Council of the City of Hackensack are
desirous of including certain additional properties as part of the area to be
investigated by the Planning Board pursuant to Resolution No. 362 to determine
whether the designation as an area-in-need of redevelopment is appropriate
pursuant to N.J.S.A. 40A:12A-6 is appropriate with respect to such additional
properties; and
WHEREAS, the Mayor and Council of the City of Hackensack are
desirous of amending Resolution No. 362 to include such additional properties as
part of the Planning Board’s area-in-need investigation; and
NOW, THEREFORE, BE IT RESOLVED, that Resolution No. 362 be and
the same is hereby amended to include the following properties to be
investigated as properties which may qualify as an area-in-need of
redevelopment pursuant to N.J.S.A. 40A:12-1 et seq.: Block 419, Lots 30, 18,
21, 22, 26, 27 (collectively, the “Additional Properties”).
BE IT FURTHER RESOLVED, that pursuant to N.J.S.A. 40A:12A-6, the
Planning Board is hereby directed to include in its preliminary investigation the
Additional Properties to determine whether such properties meet the criteria as
an area-in-need of redevelopment pursuant to N.J.S.A. 40A:12A-1 et seq.
A copy of this Resolution shall be kept on file in the office of the Mayor and
Council.
A copy of this Resolution shall be forwarded to the Planning Board of the
City of Hackensack.

WHEREAS, The Cigarette Fire Safety and Firefighters
Protection Act has been introduced in the New Jersey
Assembly (A.2575 (Conners, et al.) and in the Senate (S.2043
(Sarlo, et al.)); and
WHEREAS, cigarettes are the leading cause of fire
deaths in New Jersey and the United States;
WHEREAS, The Cigarette Fire Safety and Firefighter
Protection Act would require that cigarettes sold in New
Jersey meet stringent fire safety standards to make
cigarettes less likely to ignite upholstery and mattresses;
and
WHEREAS, enactment of The Cigarette Fire Safety and
Firefighter Protection Act would require that New Jersey
adopt the identical cigarette fire safety test and standard
used in the states of New York, California, Illinois,
Massachusetts, New Hampshire and Vermont, as well as Canada;
WHEREAS, The Cigarette Fire Safety and Firefighter
Protection Act would require cigarette manufacturers to
certify compliance with the state Division of Fire Safety in
the Department of Community Affairs;
WHEREAS, the New Jersey Fire Chiefs Association, fire
departments, firefighter associations, the National Fire
Protection Association, the American Cancer Society, the
Campaign for Tobacco-Free Kids and other civic organizations
support The Cigarette Fire Safety and Firefighter Protection
Act; and
NOW, THEREFORE, BE IT RESOLVED that the Mayor and
Council of the City of Hackensack supports passage of The
Cigarette Fire Safety and Firefighter Protection Act
A.2575/S.2043 and urge the Legislature and Governor to enact
this important legislation.
BE IT FURTHER RESOLVED, that a copy of this resolution
be forwarded to Governor Jon Corzine, local legislative
representatives, the New Jersey League of Municipalities and
all municipalities in the county.

WHEREAS, the Division of Local Government Services
requires the Chief Financial Officer to prepare with
assistance from other officials affected by the audit
finding and recommendations, and to file a “Corrective
Action Plan” outlining the actions to be taken by the City
relative to the finding and recommendations in the Annual
Audit Report; and
WHEREAS, said “Corrective Action Plan” is required to
be approved by the governing body and maintained in the
office of the City Clerk for public inspection;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and
Council of the City of Hackensack hereby approves the
“Corrective Action Plan” for the 2005 Audit Report.

Street Relief Sewer;
WHEREAS, bids were received from Matina and Son, Inc.,
Colenelli Bros., Inc., Tomco Construction, P.M.
Construction, J.Fletcher Creamer and Son, Inc., Montana
Construction, Stacey Contracting, Marvec Construction, New
Prince Construction, M.S.P. Construction and Pact
Construction;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Hackensack that the contract for the Hackensack
River Street Relief Sewer be awarded to Matina and Son,
Inc., 146 English Street, Hackensack, New Jersey 07601 for
the contract price of $ 230,500.00;
BE IT FURTHER RESOLVED that the Chief Financial Officer
has certified that funds are available in account 7-01-42-
250-252-227 of the Current Fund, Purchase Order # 154749.
