BE IT RESOLVED that the above ordinance, being Ordinance 12-2007 as introduced as
amended, does now pass on first reading and that said Ordinance shall be considered for final
passage at a meeting to be held on May 8, 2007 at 7:00 pm or as soon thereafter as the matter can
be reached at the regular meeting place of the City Council and at such time and place all persons

WHEREAS, the governing body of the City of Hackensack has been advised that an
emergency affecting the welfare of the citizens of the City of Hackensack and the general public
when a traffic signal was knocked down on the corner of Essex Street and Prospect Avenue and
was rendered inoperable; and
WHEREAS, the Project Manager notified the City Manager setting forth the
circumstances regarding the emergency; and
WHEREAS, the governing body is satisfied that a emergency did exist and that
immediate action was necessary to restore the aforementioned line to full operation; and
WHEREAS, the cost of the repair was $11,269.06, which was a fair and reasonable
quotation; and
WHEREAS, the Chief Financial Officer has certified that funds are available in account
#7-01-25-240-240-267, Purchase orders #154741 and #154742;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Hackensack that pursuant to N.J.S.A.40A:11-6 which authorizes the governing body to award
contracts without benefit of public bidding in emergency situations and the vendor Allen

awarded the New Jersey State Contract A#51014 under the State of New Jersey Cooperative
Purchasing Program 1-NJCP; and
WHEREAS, the City of Hackensack desires to purchase a 911iPASP System for the
Police Department pursuant to the Local Public Contracts Law (N.J.S.A. 40A: 11-12);
WHEREAS, the cost to purchase the iPASP 911 System will be $106,743.25; and
WHEREAS, the Police Chief recommends and the Director of Purchasing agree that the
utilization of this contract requests the best price available;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and city Council of the City
of Hackensack authorizes the purchase of the iPASP 911 System for the Police Department from
Tel Control, Inc.;
BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that funds
are available from account 7-01-41-785-000-227 in the amount of $106,743.25 from the Current

WHEREAS, Strategic Products & Services, 3 Wing Drive, Cedar Knolls, New Jersey
07927 was awarded New Jersey State Contract A42285 under the State of New Jersey
Cooperative Purchasing Program 1-NJCP; and
WHEREAS, the City of Hackensack desires to purchase a 911 emergency call system for
the Police Department pursuant to the Local Public Contracts Law (N.J.S.A. 40A: 11-12);
WHEREAS, the cost to purchase the 911 emergency hardware, cabling, gateways, and
UPS battery backup including voice mail will be $159,466.03; and
WHEREAS, the Police Chief recommends and the Director of Purchasing agree that the
utilization of this contract requests the best price available;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of
Hackensack authorizes the purchase of the 911 emergency call system hardware, cabling,

BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that funds
are available from account 7-01-41-785-000-227 in the amount of $118,175.75 and C-04-55-

WHEREAS, there were 773 motor vehicle fatalities in New Jersey in 2006; and
WHEREAS, a large percentage of the motor vehicle occupants killed in traffic crashes
were not wearing a safety belt; and
WHEREAS, use of a safety belt remains the most effective way to avoid death or serious
injury in a motor vehicle crash; and
WHEREAS, the National Highway Traffic Safety Administration estimates that 135,000
lives were saved by safety belt usage nationally between 1975-2000; and
WHEREAS, the State of New Jersey will participate in the nationwide Click It or Ticket
safety belt mobilization from May 21 – June 3, 2007 in an effort to raise awareness and increase
safety belt usage through a combination of enforcement and education; and
WHEREAS, the Division of Highway Traffic Safety has set a goal of increasing the
safety belt usage rate in the state from the current level of 90% to 92%; and
WHEREAS, a further increase in safety belt usage in New Jersey will save lives on our
roadways;
THEREFORE, BE IT RESOLVED that the City of Hackensack declares it’s support
for the Click It or Ticket safety belt mobilization both locally and nationally from May 21 – June
3, 2007 and pledges to increase awareness of the mobilization and the benefits of safety belt use.

WHEREAS, the City of Hackensack has received Change Order No. 1 and 2 from
Concrete Construction Company, in the amount of $20,600.50 for the Historic Green
Improvements Park Benches 10, Liter Receptacles 2, Winter Boxwoods 20; and
WHEREAS, the total contract amount will increase from $223,457.70 to $244,058.26;
and
WHEREAS, the City’s Engineers, T&M Associates as well as John Flannigan, the
City’s Project Manager have reviewed these change orders and have recommended that said
Change Orders be approved; and
WHEREAS, the Chief Financial Officer has certified that funds are available from
account No. 7-01-42-250-252-227 of the Current Fund in the amount of $20,600.56. Purchase
Order Nos. 154847 and 154848;
NOW, THEREFORE, BE IT RESOLVED that Change Order No. 1 and 2 in the
amount of $20,600.56 for Historic Green Improvements Park Benches 10, Litter Receptacles 2,
Winter Boxwoods 20 be approved for payment to Concrete Construction Company, PO Box

joints at stair tower, reset 21 additional coping stones, additional patching and urethane coating
on top deck; and
WHEREAS, the total contract amount will increase from $101,400.00 to $107,910.00;
and
WHEREAS, the City’s Engineers, Thomas Parisi, P.E., P.C., as well as John Flannigan,
the City’s Project Manager have reviewed these change orders and have recommended that said
Change Orders be approved; and
WHEREAS, the Chief Financial Officer has certified that funds are available from
account No. 6-05-55-502-000-234 of the General Capital Fund in the amount of $6,510.00.

Avenue, Saddle Brook, New Jersey can provide said services; and
WHEREAS, the local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) requires that the
resolution authorizing the award of contracts for professional services without competitive
bidding and the contract itself must be available for public inspection; and
WHEREAS, the maximum of the contract for said services is $2,129.00; and
WHEREAS, a certificate establishing that funds are available from Account
7-01-42-330-330-227 of the Current Fund in the amount of $2,129.00, has been issued by the
Chief Financial Officer.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City
of Hackensack that:
1. The Mayor and City Clerk be and are hereby authorized and directed to
execute an agreement with Infection Prevention Healthcare Consultants
(IPHC), LLC to perform the aforementioned services.

WHEREAS, bids were received on April 12, 2005 for Heating and Air Conditioning
Maintenance for the City of Hackensack for a three year period; and
WHEREAS, Resolution #172 dated May 2, 2005 awarded a contract to PA
Environmental Corp., 92 Bogart Avenue, Garfield, New Jersey, 07026, for the period of May 1,
2005 through April 30, 2007.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of
Hackensack that the contract for Heating and Air Conditioning Maintenance for the City of
Hackensack be awarded to PA Environmental Corp., 92 Bogart Avenue, Garfield, New Jersey,
07026, for the final year contract price of $5,820.00, hourly rate of $60.00 per hour and overtime
hourly rate of $85.00 per hour, for the period May 1, 2007 to April 30, 2008.
BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that funds
are available in account 7-01-201-26-130-130-204 $3,880.00 and will be available in account 8-
01-201-26-130-130-204, $1,940.00 of the Current Fund, Purchase Order #155038.

WHEREAS, there exists in the City of Hackensack a need for the services of an
accountant to reconcile the monthly Municipal Court bank statements from July 1, 2006 to March
31, 2007; and
WHEREAS, such professional services will be rendered or performed by a person
authorized by law to practice a recognized profession and whose practice is regulated by law
pursuant to N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public Contracts Law; and
WHEREAS, it is the desire of the Mayor and Council to retain the services of Garbarini
& Co., P.C., for an amount not to exceed $8,000.00; and
WHEREAS, a certificate establishing that funds will be available in the 2007 Budget
from Account No. 7-01-43-490-490-204 of the Current Fund in the amount of $8,000.00,
purchase order No. 155110 has been issued by the Chief Financial Officer; and
WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the
award of contracts for professional services without competitive bidding and the contract must be
made available for public inspection;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of
Hackensack that:
1) The Mayor and City Clerk be and they are hereby authorized and directed to
execute a contract with Garbarini & Co., P.C., Division Avenue and Route 17
S. , P.O. Box 362, Carlstadt, New Jersey, 07072, to perform the aforesaid
services.
2) This contract is awarded without competitive bidding as a professional
service in accordance with the Local Public Contracts Law (N.J.S.A. 40A:11-
1 et seq.); and

WHEREAS, a certificate establishing that funds will be available in Account No. C-04-
55-R07-000-017 $6,000.00 and C-04-55-VO4-000-002, $9,500.00 of the Capital Fund in the
amount of $15,500.00, Purchase Order No. 155109 has been issued by the Chief Financial
Officer; and
WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the
award of contracts for professional services without competitive bidding and the contract must be
made available for public inspection;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of
Hackensack that:
3) The Mayor and City Clerk be and they are hereby authorized and directed to
execute a contract with Anthony Iovino, AIA, PP, of Arcari & Iovino
Architects, P.C., One Katherine Street, Little Ferry, NJ, 07643, to perform
the aforesaid services.
4) This contract is awarded without competitive bidding as a professional
service in accordance with the Local Public Contracts Law (N.J.S.A. 40A:11-
1 et seq.); and
