STREET IN AND BY THE CITY OF HACKENSACK, IN THE COUNTY OF
BERGEN, NEW JERSEY, APPROPRIATING $250,000 THEREFOR AND
AUTHORIZING THE ISSUANCE OF $237,500 BONDS OR NOTES OF THE
CITY TO FINANCE PART OF THE COST THEREOF.

BERGEN, NEW JERSEY

WHEREAS, there exists in the City of Hackensack a need for the services of an
accountant to reconcile the Municipal Court General Accounts from January 1, 2009 to
December 31, 2009; and
WHEREAS, such professional services will be rendered or performed by a
person authorized by law to practice a recognized profession and whose practice is
regulated by law pursuant to N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public Contracts
Law; and
WHEREAS, it is the desire of the Mayor and Council to retain the services of
Garbarini & Co., P.C., for an amount not to exceed $12,000.00; and
WHEREAS, a certificate establishing that funds will be available in the 2008
Budget from Account No. 8-01-43-490-490-204 of the Current Fund in the amount of
$12,000.00, purchase order No. 160018 has been issued by the Chief Financial Officer;
and
WHEREAS, the Local Public Contracts Law requires that the resolution
authorizing the award of contracts for professional services without competitive bidding
and the contract must be made available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of
Hackensack that:
1) The Mayor and City Clerk be and they are hereby authorized and
directed to execute a contract with Garbarini & Co., P.C., Division
Avenue and Route 17 S. , P.O. Box 362, Carlstadt, New Jersey,
07072, to perform the aforesaid services.
2) This contract is awarded without competitive bidding as a professional
service in accordance with the Local Public Contracts Law (N.J.S.A.
40A:11-1 et seq.); and
BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to
retain a copy of the contract for public inspection and to publish a notice of this action
once in The Record.

WHEREAS, the New Jersey Department of Environmental Protection, Green
Acres Program, hereinafter referred to as the “State” provides loans and/or grants to
municipal and county governments and grants to nonprofit organizations for
assistance in the acquisition and development of lands for outdoor recreation and
conservation purposes; and
WHEREAS, the City of Hackensack desires to further the public interest by
obtaining funding in the amount of $553,565.00 from the State to fund the 2 nd Ward
Park Improvement Plan at a cost of $1,107,130.00.
NOW, THEREFORE, the Mayor and Council for the City of Hackensack
hereby authorizes City Manager, Stephen LoIacono to:
Make application for a grant
Provide additional application information and furnish such
documents as may be required, and
Act as the authorized correspondent of the City of Hackensack
WHEREAS, the State shall determine if the application is complete and in
conformance with the scope and intent of the Green Acres Program, and notify the
City of Hackensack of the amount of the funding award; and
WHEREAS, the City of Hackensack is willing to use the State’s funds in
accordance with such rules, regulations and applicable statutes, and is willing to
enter into an agreement with the State for the 2 nd Ward Park Improvement Plan;
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY OF
HACKENSACK,
1. That the Mayor of the City of Hackensack is hereby authorized to
execute an agreement and any amendment thereto with the State for
the project known as 2nd Ward Park Improvement Plan;
2. That, the City of Hackensack has its matching share of the project, if a
match is required, in the amount of $553,565.00;
3. That, in the event the State’s funds are less than the total project cost
specified above, the City of Hackensack will procure the balance of
funding necessary to complete the project;
4. That the City of Hackensack agrees to comply with all applicable
federal, state and local laws, rules and regulations in its performance of
the project; and
5. That this resolution will take effect immediately.

WHEREAS, the Second Ward Park is in dire need of renovations and the
neighborhood in which it is located needs a fully functional park; and
WHEREAS, the Second Ward Park Improvement Plan is part of the City of
Hackensack’s greater urban renewal plan in which all public parks and places of
recreation will be updated and renewed for the benefit of its citizens; and
WHEREAS, the City of Hackensack desires to make application for a grant to
the New Jersey Department of Environmental Protection, Green Acres Program to
fund the Second Ward Park Improvement Plan; and
WHEREAS, one of the conditions of the application for Green Acres funding is
that a public hearing be held.
NOW THEREFORE, BE IT RESOLVED, that a public hearing with reference
to this matter will be held on Tuesday, October 7, 2008 at 7:00 p.m. in the Council
Chambers, City Hall, 65 Central Avenue, Hackensack, New Jersey.

WHEREAS, there exists in the City of Hackensack a need for the services of
an Engineer for the City of Hackensack; and
WHEREAS, such professional services will be rendered or performed by a
person authorized by law to practice a recognized profession pursuant to
N.J.S.A.19:44A-20.4, 20.5, et seq.; and
WHEREAS, pursuant to the Fair and Open Process Rule, N.J.S.A. 19:44A-
20.4 et. seq., advertisements for proposals were published on the City of
Hackensack’s Web Site, and received and reviewed for the aforementioned
professional services which anticipated cost will be over $17,500 per year.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City
of Hackensack that:
(l) The Mayor and Council of the City of Hackensack, through the City
Manager, are hereby authorized and directed to retain the services of Boswell
Engineering, 330 Philips Avenue, South Hackensack, New Jersey, to perform the
services as the City Engineer for the City of Hackensack.
(2) This contract is awarded pursuant to a fair and open process.
BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to
retain a copy of the contract for public inspection.

WHEREAS, on February 26, 2008 a Developers Agreement by and between
the City of Hackensack and the Hackensack University Medical Center was duly
executed;
WHEREAS, paragraph 13 therein provides for the provision of Emergency
Medical Services/Ambulance Services by Hackensack University Medical Center to
the City of Hackensack 12 hours a day, 7 days a week, at no cost to the City, equal to
or better than the services then provided by the City EMT’s; and
WHEREAS, the City wishes to implement the provisions of N.J.S.A. 40A:11-
4.1-4.5 et seq., to effectuate similar benefits of this provision.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. The City Purchasing Agent be and he is hereby authorized to
prepare a request for proposal documentation pursuant to
the act;
2. The City Purchasing Agent is hereby directed to comply with
all other provisions of the act.
