Jones, M.D. to provide said physician services for the Health Department; and WHEREAS, a certificate establishing that funds are available from account #9- 01-27-330-330-208 of the General Fund in an amount not to exceed $6,700.00, PO #164355 has been issued by the Chief Financial Officer. WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional service without competitive bidding and the contract itself must be available for public inspection. Jones, MD, 35 Brinkerhoff Avenue, Teaneck, New Jersey, to provide physician services effective January 1, 2009. Roll Call: Ayes- Meneses, Townes, Sasso, McAuliffe, Melfi  NO. 16 - 09 OFFERED BY: MCAULIFFE SECONDED BY: TOWNES WHEREAS, the Governing Body of the City of Hackensack finds and declares that N.J.S.A. 54:5-19 requires that the City of Hackensack conduct a public tax sale to enforce unpaid municipal liens by selling said liens in accordance with the Tax Sale Law; and WHEREAS, the Governing Body further finds and declares that the Municipal Tax Collector, Elisa Coccia, is qualified to hold said Tax Sale in the calendar year 2009 for 2008 municipal unpaid charges; and WHEREAS, the Governing Body further finds and declares that the annual Tax Sale may be at the discretion of the Municipal Tax Collector; NOW, THEREFORE BE IT RESOLVED, by the Governing Body of the City of Hackensack that the Municipal Tax Collector, Elisa Coccia, be and is hereby authorized to conduct the Annual Tax Sale during the calendar year of 2009 in accordance with N.J.S.A. 54:5-19. BE IT FURTHER RESOLVED, that the Municipal Clerk provide a certified copy of this resolution to the Tax Collector. Roll Call: Ayes- Meneses, Townes, Sasso, McAuliffe, Melfi NO. 17 - 09 OFFERED BY: MCAULIFFE SECONDED BY: TOWNES WHEREAS, N.J.S.A. 54:4-67 permits the Governing Body of the City of Hackensack to fix the rate of interest to be charges for the nonpayment of taxes, assessments, or any other municipal charges. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Hackensack that the rate of interest on unpaid taxes shall be eight (8) percent per annum on the first One Thousand Five Hundred ($1,500.00) Dollars of delinquency and eighteen (18) percent per annum on any amount in excess of One Thousand Five Hundred ($1,500.00) Dollars to be calculated from the date the tax was payable until the date of actual payment, provided that no interest shall be charged if payment of any installment is made on or before the tenth calendar day following the date upon which the same became payable; and, BE IT FURTHER RESOLVED, that the rate of interest on unpaid sewer bills shall be eight (8) percent per annum on the first One Thousand Five Hundred ($1,500.00) Dollars of delinquency and eighteen (18) percent per annum on any amount in excess of One Thousand Five Hundred ($1,500.00) Dollars to be calculated from the date the tax was payable until the date of actual payment, provided that no interest shall be charged if payment of any bill is made within thirty (30) calendar days following the billing date; and, BE IT FURTHER RESOLVED, that when the 10th day of grace period for taxes, or the 30th day for sewer billing falls on a Saturday or Sunday, it is due on the following Monday, and if the following Monday is a legal holiday, it will be due and payable on the following Tuesday, and, BE IT FURTHER RESOLVED, that in addition to the interest provided above, on all delinquencies in excess of Ten thousand ($10,000.00) Dollars and which are not paid prior to the end of the fiscal year, the tax collector shall also collect a penalty of six (6) percent of the amount of the delinquency in excess of Ten Thousand ($10,000.00) Dollars.  BE IT FURTHER RESOLVED, that the Municipal Clerk provide a certified copy of this resolution to the Tax Collector. Roll Call: Ayes- Meneses, Townes, Sasso, McAuliffe, Melfi NO. 18 - 09 OFFERED BY: MCAULIFFE SECONDED BY: TOWNES WHEREAS, since 1980 the New Jersey State Legislature has considered legislation to permit adult adoptees, and parents of adopted minors, to have access to a copy of the adopted person’s original birth certificate and other related information, and WHEREAS, legislation to this effect has passed in the New Jersey Assembly in 1991 and 1994, and in the New Jersey Senate in 2004, 2006 and 2008, and WHEREAS, the legislation recognizes that family history information, which includes medical, cultural and social history about an adopted person’s birth parents, is important for an adopted person’s medical concerns and emotional health, and WHEREAS, the proposed Model State Adoption Act published in the Federal Register (2/15/80), stated, “There can be no legally protected interest in keeping one’s identity secret from one’s biological offspring; parent and child are considered co- owners of the information regarding the event of birth”, and WHEREAS, the Child Welfare League of America in its 2000 Standards of Excellence for adoption agencies stated, “ The agency providing adoption services should support efforts to ensure that adults who were adopted have direct access to identifying information about themselves and their birth parents,” and WHEREAS, the New Jersey Division of Youth and Family Services Adoption Registry Coordinator in 2004, stated “Despite the fact that the majority of birth parents we search for are not registered with us, 95% do agree to some form of contact with the adoptee,” and WHEREAS, the Monmouth University Polling Institute in its April 2006 report, NJ Opinions on Adopted Persons’ Access to Birth Records found, “9 in 10 New Jerseyans feel that it is important for persons who were adopted to have access to their family medical history or other information about their heritage,” and WHEREAS, the Evan B. Donaldson Adoption Institute in its November 2007 report, For the Records; Restoring a Legal Right for Adult Adoptees stated, “The rights of adopted persons, who did not participate in any discussions or agreements, cannot be ‘signed away’ by others. Adopted persons did not waive their rights to knowledge about their births, and others cannot waive those rights for them”, and WHEREAS, Children’s Aid and Family Services, Paramus, New Jersey, in 2005 stated “It is our sincere belief that access to identifying information is the adopted person’s right. We believe that this access furthers the interest of all members of the adoption triad,” and WHEREAS, Spence-Chapin Services to Children “believes that access to identifying information is the adult adoptee’s right and that this access furthers the interests of all members of the triad- adoptees, birth parents and adoptive parents,” and WHEREAS, Catholic Charities, USA, in Adoption Search: An Ethical Guide for Professionals states, “Instead of secrecy and barriers to contact, there is an increased emphasis on openness and knowledge…Both parties consistently report a sense of healing and wholeness after contact…Having access to one’s source is everyman’s right.”  NOW, THEREFORE BE IT RESOLVED that the City of Hackensack, Bergen County, New Jersey, hereby goes on record giving its full and wholehearted support to the passage of legislation in our state that would permit adopted persons, or the adopted parents of a minor, access to a copy of the adopted person’s original birth certificate and related medical and cultural information, upon request. BE IT FURTHER RESOLVED, that a copy of this resolution be sent directly to the President of the New Jersey Senate, the Speaker of the New Jersey Assembly, the Governor of New Jersey and to the Members of the NJ State Senate and Assembly who represent this legislative district. BE IT FURTHER RESOLVED, that a copy of this resolution be sent to every municipality in Bergen County requesting them to adopt this resolution. Roll Call: Ayes- Meneses, Townes, Sasso, McAuliffe, Melfi NO. 20 - 09 OFFERED BY: MCAULIFFE SECONDED BY: TOWNES WHEREAS, the City of Hackensack is in the process of renovating the property of 89-91 Anderson Street, Hackensack, New Jersey 07601; and WHEREAS, the City of Hackensack will be the general contractor for the purpose of the renovations; and WHEREAS, the City of Hackensack deems it necessary to sub-contract certain aspects of the renovations; and WHEREAS, the City of Hackensack advertised for bids to be received on December 30, 2008 for plumbing, fire sprinkler, masonry and a fire alarm system for this location; and WHEREAS, the low bidder for masonry and the fire alarm sprinkler was Kaycon General Contracting, Inc. as follows, masonry $20,575.00 and fire alarm sprinkler $7,035.00; and WHEREAS, the Chief Financial Officer has certified that funds are available in account C-04-55-Z17-000-001 of the Capital Budget, Purchase Order #164390. NOW THEREFORE BE IT RESOLVED that the contract for masonry and fire alarm sprinkler renovations at 89-91 Anderson Street, Hackensack, New Jersey 07601 be awarded to Kaycon Construction Inc., 75 Voorhis Lane, Hackensack, New Jersey 07601 at the contract price of $20,575.00 for masonry and $7,035.00 for fire alarm sprinkler as per bid. NOW THEREFORE BE IT RESOLVED that the contract for plumbing renovations at 89-91 Anderson Street, Hackensack, New Jersey 07601 be awarded to Lanzo Plumbing, 74 Green Street, Hackensack, New Jersey 07601 at the bid price of $22,200.00. Roll Call: Ayes- Meneses, Townes, Sasso, McAuliffe, Melfi NO. 23-09 OFFERED BY: MCAULIFFE SECONDED BY: TOWNES WHEREAS, the City of Hackensack and the Northwest Bergen County Utilities Authority desire to enter into an inter-local service agreement pursuant to N.J.S.A. 40:8A-1 et seq. for authority to provide sanitary sewer jetting services to the City of Hackensack for the years 2009 and 2010; and  NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the City of Hackensack hereby authorize the Mayor and the City Clerk of the City of Hackensack to sign the Inter-local Agreement on behalf of the City of Hackensack as well as any other documents that may be required to effectuate performance of this agreement.
