City Council Resolutions, January 21, 2009 NO. 24 - 09 OFFERED BY: MENESES SECONDED BY: MC AULIFFE ________________________________________________________________ BE IT RESOLVED by the City Council of the City of Hackensack that the bills in the following accounts be and are hereby ordered paid: Current Account $ 8,376,963.70 Escrow $ 110,784.74 Payroll Agency Account $ 11,318.22 Self Insurance $ 32,472.19 Public Parking System $ 15,339.43 Capital $ 120,622.67 Trust Account $ 1,000.00 Roll Call: Ayes – Meneses, Townes, McAuliffe, Melfi Absent - Sasso “The City Clerk announces that the following items are considered to be routine in nature and will be enacted in one motion; any items requiring expenditure are supported by a Certification of Availability of Funds; any item requiring discussion will be removed from the Consent Agenda; all Consent Agenda items will be reflected in full in the minutes including any exceptions and/or additions.” NO. 25- 09 OFFERED BY: TOWNES SECONDED BY: MC AULIFFE WHEREAS, there exists in the City of Hackensack a need for the services of a Professional Planner specializing in COAH compliance for the City of Hackensack; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession pursuant to N.J.S.A.19:44A-20.4, 20.5, et seq.; and WHEREAS, pursuant to the Fair and Open Process Rule, N.J.S.A. 19:44A-20.4 et. seq., advertisements for proposals were published on the City of Hackensack’s Web Site, and received and reviewed for the aforementioned professional services which anticipated cost will be over $17,500 per year. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that: (l) The Mayor and Council of the City of Hackensack, through the City Manager, are hereby authorized and directed to retain the services of Burgis Associates, Inc., 25 Westwood Avenue, Westwood, New Jersey, 07675, to perform Professional Planning services specializing in COAH compliance for the City of Hackensack. (2) This contract is awarded pursuant to a fair and open process. BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy of the contract for public inspection. Panny, residing at 650 North Prospect Avenue, Hackensack, New Jersey, having satisfied the above, determined to be a 100% disabled veteran, is entitled to tax exemption at 100% to be prorated as of August 23, 2007 is entitled to receive the following refund: 2007 tax exemption prorated 8/23/07 $2,408.89 2008 tax exemption (amount paid) $1,690.00 Total Refund due $4,098.89 NOW, THEREFORE, BE IT RESOLVED, the Tax Collector is directed to cancel property taxes for Block 552 Lot 12.02 assessed to Frank J. Panny prorated as of August 23, 2007 in the amount of $2.408.89 and cancel taxes for the full year of 2008 in the amount of $7,123.51 accordingly, to reflect the disabled veteran exemption and issue a refund in the amount of $4,098.89 to Frank J. Panny. WHEREAS, the City of Hackensack purchased property on May 14, 2008 from Rainbow Realty Co. % Greene, located at 89 Anderson Street, Hackensack, New Jersey, also known as Block 419 Lot 18, WHEREAS, said property owned by a municipality is tax exempt, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Hackensack authorizes the Tax Collector to cancel the 2008 taxes effective May 14, 2008, in the amount of $26,315.62. Roll Call: Ayes – Meneses, Townes, McAuliffe, Melfi NO. 29- 09 OFFERED BY: TOWNES SECONDED BY: MC AULIFFE WHEREAS, statute N.J.S.A. 54:3-14-21 permits tax appeals to the Tax Court of New Jersey by taxpayers feeling aggrieved by the assessed valuation or the contesting of entitlement of exemption status of the taxpayer’s property, WHEREAS, New Concepts for Living Inc. is the owner of Block 549 Lot 50, with additional lots 51-53, known as 795-799 Main Street, Hackensack NJ, WHEREAS, the Tax Collector is empowered to cancel taxes in cases where the Tax Court of New Jersey determines a property to be exempt, WHEREAS, the Tax Collector has received Judgments from the Tax Court of New Jersey declaring Block 549 Lot 50 to be exempt for the years 2000 -2005 as follows: Docket # 004896-2001 2000 $15,401.10 Docket # 004896-2001 2001 15,559.06 Docket # 004474-2002 2002 16,309.37 Docket # 004502-2003 2003 16,980.70 Docket # 005887-2004 2004 17,691.52 Docket # 005826-2005 2005 18,520.81 TOTAL ADJUSTMENT DUE $100,462.56 NOW, THEREFORE, BE IT RESOLVED, the Tax Collector is directed to adjust the property taxes for Block 549 Lot 50 assessed to New Concepts for the Living, Inc. for the tax years 2000-2005 in the amount of $100,462.56. Roll Call: Ayes – Meneses, Townes, McAuliffe, Melfi Absent - Sasso NO. 30- 09 OFFERED BY: TOWNES SECONDED BY: MC AULIFFE ________________________________________________________________ WHEREAS, there exists in the City of Hackensack a need for the services of a Risk Management and Safety Consultant to provide specialized training for City employees and to assist the safety program, per state regulations; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A. 40A11-5(1)(a)(i) of the Local Public Contracts Law; and WHEREAS, it is the desire of the Mayor and Council to retain the services of E.J. Tobias & Associates as Risk Management and Safety Consultant to the City of Hackensack for an amount not to exceed $13,200.00 for twelve months; and WHEREAS, a certificate establishing that funds will be available in the 2008 Budget from Account No. 9-01-27-330-332-204 of the Current Fund in the amount of $13,200.00, Purchase Order No. 164424 has been issued by the Chief Financial Officer; WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bidding and the contract must be available for public inspection; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that: (1) The Mayor and City Clerk be and they are hereby authorized and directed to execute a contract with E.J. Tobias & Associates, 81 Morrissee Avenue, Wallington, New Jersey 07057, to provide the services of a Risk Management and Safety Consultant to provide specialized training for City employees and to assist the safety program, per state regulations. (2) This contract is awarded without competitive bidding as professional services in accordance with N.J.S.A. 40A:11-1(1)(a) of the Local Public Contracts Law. BE IT FURTHER RESOLVED that the City Clerk be and hereby is directed to retain a copy of the contract for public inspection and to publish notice of this action once in The Record.
