The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, October 24, 2023 at 8:01 p.m. Mayor Labrosse called the meeting to order and the City Clerk announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Attendance Ms. Karlsson called the roll: Mayor Labrosse, Deputy Mayor Canestrino, Councilman Battaglia, and Councilman Carroll were present. Councilwoman Von Rudenborg was absent. City Manager’s Report The city pumpkin carving contest deadline is October 31 st, winners will be announced on social media on November 1. The annual children’s Halloween party will be October 28th at our Recreation Center. Please check the website for additional details. The City will be hosting our biannual Slam Dunk the Junk event on Saturday November 4th. Registration is online for all who wish to participate. Hackensack PD has launched a drone program to enhance first response capabilities and public safety for our community. The City’s rabies clinic will be at the DPW garage on November 9 th. ORDINANCE NO. 39-2023 CITY OF HACKENSACK COUNTY OF BERGEN ORDINANCE AMENDING THE 360 MAIN STREET / YMCA REDEVELOPMENT PLAN FOR THE DELINEATED REDEVELOPMENT AREA CONSISTING OF BLOCK 402, LOTS 12, 16.01 AND 16.02 WHEREAS, the City of Hackensack, in the County of Bergen, State of New Jersey (the “City”) is authorized pursuant to N.J.S.A. 40A:12A-5 to determine that a delineated area in the City is an area in need of redevelopment; and WHEREAS, redevelopment plans must be undertaken by ordinance pursuant to N.J.S.A. 40A:12A-7, and said plans must include an outline for the planning, development, redevelopment or rehabilitation of the identified project area; and WHEREAS, on December 20, 2021, by Resolution No. 537-21, the governing body of the City authorized and requested the Planning Board to undertake a preliminary investigation (the “Investigation”) to determine whether Block 402, Lots 12, 16.01 and 16.02 (the “Area of Investigation”) constitutes an area in need of redevelopment according to the criteria set forth under the Local Redevelopment and Housing Law (“LRHL”), specifically N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, consistent with the requirements set forth in N.J.S.A. 40A:12A-6, the Planning Board specified and gave notice that on March 9, 2022, a hearing would be held for the purpose of hearing persons who are interested in or would be affected by a determination that the property located in the Area of Investigation constitutes an area in need of redevelopment as that term is defined under the LRHL for non-condemnation purposes; and WHEREAS, Francis Reiner, LLA, PP of DMR Architects publicly presented a “Report of Preliminary Investigation for Determination of an Area in Need of Redevelopment” for the designated Area of Investigation dated February 2022 (the “Investigation Report”); and WHEREAS, on March 9, 2022, the Planning Board unanimously recommended that the governing body of the City designate the Area of Investigation as a non-condemnation area in need of redevelopment due to the substantial evidence that the Area of Investigation meets the criteria enumerated in the Investigation Report, pursuant to N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, on March 22, 2022, by Resolution No. 144-22, in accordance with the Planning Board’s recommendation, the City’s governing body designated Block 402, Lots 12, 16.01 and 16.02 as an area in need of redevelopment for non-condemnation purposes; and WHEREAS, on May 24, 2022, by Ordinance No. 23-2022, in accordance with N.J.S.A. 40A:12A-7, the City adopted the 360 Main Street / YMCA Redevelopment Plan for Block 402, Lots 12, 16.01 and 16.02 to establish zoning for these properties under the LRHL; and 10/24/2023 2  WHEREAS, since the adoption of the 360 Main Street / YMCA Redevelopment Plan, the City has determined that it is in need of amendment to address concerns with building standards in the initial plan; and WHEREAS, the City’s planner has prepared an amended 360 Main Street / YMCA Redevelopment Plan to address these issues. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Hackensack in the County of Bergen, State of New Jersey, as follows: SECTION 1. Amended 360 Main Street / YMCA Redevelopment Plan. The Amended 360 Main Street / YMCA Redevelopment Plan prepared by DMR Architects dated September 2023 attached hereto and made part hereof as Exhibit A is hereby approved and adopted pursuant to N.J.S.A. 40A:12A-1 et seq., shall supersede the prior 360 Main Street / YMCA Redevelopment Plan and be enacted as an amendment to the City’s Zoning Map. SECTION 2. Severability. If any section, subsection or paragraph of this ordinance be declared unconstitutional, invalid or inoperative, in whole or in part, by a court of competent jurisdiction, such chapter, section subchapter or paragraph shall to the extent that is not held unconstitutional, invalid or inoperative remain in full force and effect and shall not affect the remainder of this ordinance. SECTION 3. Repealer. All ordinances and resolutions, and parts of ordinances and resolutions which are inconsistent with provisions of this ordinance, including Ordinance No. 23-2022 adopted on May 24, 2022, shall be, and are hereby, repealed to the extent of any such inconsistency. BE IT RESOLVED by the City Council of the City of Hackensack, County of Bergen and State of New Jersey, that Ordinance No. 40-2023 has passed its second and final reading and is hereby adopted. 10/24/2023 3  ORDINANCE NO. 40-2023 CITY OF HACKENSACK COUNTY OF BERGEN ORDINANCE AMENDING THE 359-375 MAIN STREET REDEVELOPMENT PLAN FOR THE FOR THE DELINEATED REDEVELOPMENT AREA CONSISTING OF BLOCK 408, LOTS 1 AND 16 WHEREAS, the City of Hackensack, in the County of Bergen, State of New Jersey (the “City”) is authorized pursuant to N.J.S.A. 40A:12A-5 to determine that a delineated area in the City is an area in need of redevelopment; and WHEREAS, redevelopment plans must be undertaken by ordinance pursuant to N.J.S.A. 40A:12A-7, and said plans must include an outline for the planning, development, redevelopment or rehabilitation of the identified project area; and WHEREAS, pursuant to N.J.S.A. 40A:12A-6, by Resolution No. 257-16 adopted on June 28, 2016, the governing body of the City authorized and requested the Planning Board to undertake a preliminary investigation (the “Investigation”) to determine whether Block 408, Lots 1, 8, 9.01, 9.02, 11, 15 and 16 (the “Area of Investigation”) constitutes an area in need of redevelopment according to the criteria set forth under the Local Redevelopment and Housing Law (“LRHL”), specifically N.J.S.A. 40A:12A-5; and WHEREAS, consistent with the requirements set forth in N.J.S.A. 40A:12A-6, the Planning Board specified and gave notice that on September 7, 2016 a hearing would be held for the purpose of hearing persons who are interested in or would be affected by a determination that the properties in the Area of Investigation constitute an area in need of redevelopment as that term is defined under the LRHL, N.J.S.A. 40A:12A-1 et seq.; and WHEREAS, Francis Reiner, PP, LLA publicly presented a “Report of Preliminary Investigation for Determination of an Area in Need of Redevelopment” for the designated Area of Investigation dated September 7, 2016 (the “Investigation Report”), finding that the properties consisting of Block 408, Lots 1, 15 and 16 met numerous criteria under N.J.S.A. 40A:12A-5; and WHEREAS, on December 6, 2016, pursuant to Resolution No. 456-16, the City previously designated Block 408, Lots 8, 9.01, 9.02 and 11, but not Lots 1, 15 and 16 as being an area in need of redevelopment for non-condemnation purposes based on the above-cited findings of the Investigation Report and the Planning Board’s determination; and WHEREAS, on December 22, 2020, pursuant to Resolution No. 515-20, the City’s governing body agreed with the Planning Board’s findings that the properties consisting of Block 408, Lots 1, 15 and 16 met numerous criteria under N.J.S.A. 40A:12A-5, and therefore, determined and declared these remaining properties as being in need of redevelopment for non-condemnation purposes; and WHEREAS, at the direction of the City’s governing body, Michael Mistretta, PP, LLA, prepared a Redevelopment Plan entitled the “359-375 Main Street Redevelopment Plan” dated September 2021 including Block 408, Lots 1 and 16 of the area determined to be in need of redevelopment for non- condemnation purposes; and WHEREAS, on October 26, 2021, by Ordinance No. 49-2021, in accordance with N.J.S.A. 40A:12A-7, the City adopted the 359-375 Main Street Redevelopment Plan for Block 408, Lots 1 and 16 to establish zoning for these properties under the LRHL; and WHEREAS, since the adoption of the 359-375 Main Street Redevelopment Plan, the City has determined that it is in need of amendment to address concerns with building standards in the initial plan; and 10/24/2023 4  WHEREAS, the City’s planner has prepared an amended 359-375 Main Street Redevelopment Plan to address these issues. CITY OF HACKENSACK ORDINANCE NO. 42-2023 ORDINANCE AMENDING AND RESTATING ORDINANCE NO. 35-2023 SOLELY AS TO THE ESTABLISHED FAIR MARKET VALUE FOR BLOCK 315, LOT 24 (271 MAIN STREET) IN THE CITY OF HACKENSACK WHEREAS, pursuant to N.J.S.A. 40A:12A-8(c), the governing body is authorized to acquire, by condemnation, any land or building which is necessary for a redevelopment project pursuant to the provisions of the Eminent Domain Act, N.J.S.A. 20:3-1, et seq. provided that the land or building is located within a condemnation redevelopment area; and WHEREAS, on September 5, 2023, pursuant to Ordinance No. 35-2023, the governing body of the City of Hackensack (the “City”) established the fair market value for Block 315, Lot 24 (271 Main Street) on the official tax map of the City and authorized its acquisition by purchase or eminent domain for the purpose of redevelopment, including a public parking garage; and WHEREAS, a typographical error was thereafter discovered in the data giving rise to Ordinance No. 35-2023 as regards Block 315, Lot 24 requiring amendment of Ordinance No. 35-2023 to correct solely the fair market value established for Block 315, Lot 24; and WHEREAS, Block 315, Lot 24 has been appraised by McNerney & Associates, Inc. (the “Appraiser”) to have a fair market value of $785,000. NOW, THEREFORE, BE IT ORDAINED, by the governing body of the City of Hackensack in the County of Bergen, State of New Jersey that: 1. Ordinance No. 35-2023 adopted by the governing body of the City of Hackensack on September 5, 2023 is hereby amended and restated solely with regard to the fair market value established for Block 315, Lot 24. 2. The governing body of the City of Hackensack accepts the $785,000 valuation set by the Appraiser for Block 315, Lot 24 as having been performed in a competent manner and in accordance with applicable laws and as establishing the fair market value of Block 315, Lot 24. CITY OF HACKENSACK ORDINANCE NO. 43-2023 AN ORDINANCE AMENDING CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO AMEND “GENERAL PARKING REGULATIONS” IN SECTION 170-6 WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, the City Council of the City of Hackensack wishes to amend Chapter 170 of the Code of the City of Hackensack, entitled “Vehicles and Traffic,” to amend section 170-6 “General Parking Regulations;” and, WHEREAS, the City Council finds it is in the City’s best interest to take this action to further clarify and regulate parking in public parks. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 170, Article II “Parking” of the Code of the City of Hackensack is hereby amended as follows [additions by underline] §170-6 General Parking Regulations. A. No person shall park, permit the parking of or leave unattended any vehicle in any of the following places or positions: (1) In or upon public parks or playgrounds except, during daylight hours, while utilizing the park or playground for authorized City recreational purposes during established hours of operation, in parking spaces designated and appropriately marked by the Police Department City. (2) – (4) UNCHANGED. Section 2: All other provisions of Chapter 170 of the Code of the City of Hackensack shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative 10/24/2023 7 intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. Section 6: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law. Council Intr Secon Abstai Absen Recuse Member o d Yes No n t d Von X Rudenborg Deputy Mayor Canestrino X X Battaglia X X Carroll X Mayor Labrosse X CITY OF HACKENSACK RESOLUTION NO. 385-23 INTRODUCTION OF ORDINANCE NO. 44-2023, AN ORDINANCE TO AMEND CHAPTER 32, SECTION 5 OF THE CODE OF THE CITY OF HACKENSACK AUTHORIZING AN ALTERNATIVE PROCESS FOR HIRING QUALIFIED POLICE OFFICERS PURSUANT TO N.J.S.A. 11A:4-1.3 BE IT RESOLVED that the above ordinance, being Ordinance 44-2023 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be held on November 21, 2023 at 8:00 p.m. or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and where said ordinance will be further considered for final passage. CITY OF HACKENSACK ORDINANCE NO. 44-2023 AN ORDINANCE TO AMEND CHAPTER 32, SECTION 5 OF THE CODE OF THE CITY OF HACKENSACK AUTHORIZING AN ALTERNATIVE PROCESS FOR HIRING QUALIFIED POLICE OFFICERS PURSUANT 10/24/2023 8  TO N.J.S.A. 11A:4-1.3 WHEREAS, Chapter 32, Section 5 of the Code of the City of Hackensack (“Code”) establishes procedures for appointments to the Hackensack Police Department; and, WHEREAS, in 2021 the New Jersey Legislature adopted P.L. 2021, c. 7, as amended by P.L. 2021, c. 406, and codified at N.J.S.A. 11A:4-1.3, which amends the Civil Service Act to provide that municipalities may directly hire individuals as sworn law enforcement officers subject to successful completion of certain training requirements, and such said individuals are not required to participate in the Civil Service examination process prior to appointment; and, WHEREAS, the statute establishes as conditions precedent before a municipality may hire individuals using this alternative process that the municipality must adopt an ordinance authorizing it, and must further adopt a conflict of interest and nepotism policy to ensure such appointments are not tainted by improper considerations; and, WHEREAS, the City Manager and Police Director have advised that permitting this option in appropriate circumstances will be beneficial to the future success of the Police Department by expanding the pool of potential new hires; and, WHEREAS, the City Council further believes that the public must have confidence that employment of police officers utilizing this alternative process is free from nepotism, patronage, and favoritism, and that employment as a police officer is based on merit; and, WHEREAS, upon recommendation of the City Manager and Police Director, the Council wishes to amend Chapter 32, Section 5 of the Code to formally authorize the alternative process for hiring qualified police officers pursuant to N.J.S.A. 11A:4-1.3 and associated Civil Service Commission regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 32, Section 5 of the Code of the City of Hackensack (“Code”) is hereby amended as follows [additions by underline, deletions by strikethrough]: Article I. Department Organization, Duties, and Regulations §32-5 Appointment of officers and personnel; temporary and provisional appointments. A. No person shall be appointed to the Police Department who is not qualified as provided in the by New Jersey Statutes law. The selection criteria for a police officer shall be in accordance with Department policy, the rules and regulations of the State of New Jersey Department of Personnel Civil Service Commission and as otherwise prescribed by the statutes of the State of New Jersey and City ordinances. B. [UNCHANGED] C. Alternative Hiring Process. Pursuant to N.J.S.A. 11:4-1.3, the City shall be authorized to utilize an alternative hiring process that allows for qualified applicants to be exempt from Civil Service examination requirements for entry-level law enforcement positions. Such applicants must complete a police full Basic Course for Police Officers program at a school approved and authorized by the New Jersey Police Training Commission (“PTC”). The City shall comply with all applicable regulations of the New Jersey Civil Service Commission with respect to the utilization of the alternative hiring process. The determination whether to utilize the alternative hiring process for any particular appointment shall be solely in the discretion of the City Manager. D. Police Department Conflict of Interest and Nepotism Policy. The City Council declares that a conflict of interest and nepotism policy should be enacted for the Hackensack Police Department. This policy is not intended to deprive any citizen of an equal chance for 10/24/2023 9  employment as a sworn law enforcement officer, but solely to eliminate the potential for preferential treatment of the relatives of senior government personnel or elected officials. 1. Definitions. For purposes of this Ordinance, the following terms shall have the meanings indicated: FAMILY MEMBER OR RELATIVE Members of an individual's household, as well as the following, whether related by marriage (or civil union or domestic partnership) or by adoption: spouse or the substantial equivalent; child; foster child; brother; sister; parent; grandparent; grandchild; father-in- law; mother-in-law; sister-in-law; brother-in-law; son-in-law; daughter-in-law; stepfather; stepmother; stepson; stepdaughter; stepbrother; stepsister; half-brother; half-sister; nephew; niece; aunt; uncle; children of aunt or uncle. ELECTED OFFICIAL Person holding the position of Council member in the City of Hackensack. SENIOR ADMINSTRATIVE OFFICIAL The City Manager, Deputy City Manager, Police Director or City Attorney. SUPERIOR OFFICER Any police officer of the City of Hackensack having direct supervisory powers and duties over another police officer. 2. Except as authorized by Section D(4), below, no person who is a family member or relative of any Elected Official or Senior Administrative Official of the City of Hackensack shall be considered for employment as a police officer with the City. This shall not restrict nor prohibit the continued employment of an individual as a police officer with the City where a family member or relative of an Elected Official or Senior Administrative Official was hired before the effective date of this Ordinance. 3. No Elected Official shall serve as an appointed Council liaison to the Police Department if any employee of the Police Department is a family member or relative of that Elected Official. 4. Open Competitive Process Exemption. The City of Hackensack is a Civil Service jurisdiction for the hiring, firing, promotion and discipline of police officers and is governed by the Civil Service Act at N.J.S.A. Title 11A and its associated regulations at N.J.A.C. 4A. This Section shall not prohibit an individual who is a family member or relative as defined herein and who is otherwise eligible to be hired or promoted through the open competitive process from being hired or promoted as a police officer. 5. Promotion of Existing Police Officers. No Elected Official or Senior Administrative Official or Superior Officer within the Police Department may participate in the promotional or disciplinary process of a police officer who is a family member or relative. 6. Enforceability. Nothing in this Section is intended to conflict with applicable Civil Service laws and regulations, or applicable provisions of other state laws or regulations. Section 2: All other provisions of Chapter 32 of the Code shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: 10/24/2023 10 Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. Section 6: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law. Council Intr Secon Abstai Absen Recuse Member o d Yes No n t d Von X Rudenborg Deputy Mayor Canestrino X X Battaglia X X Carroll X Mayor Labrosse X CITY OF HACKENSACK RESOLUTION NO. 403-23 RESOLUTION APPROVING PETITON TO FAA TO REDUCE AIR TRAFFIC NOISE WHEREAS, a large volume of private jets flying into Teterboro Airport brings intolerable noise levels in the City of Hackensack significantly impacting the quality of life of its residents; and WHEREAS, since 2019, the air route over Route 17, RNAV,GPSX was established as an alternate route; and WHEREAS, voluntary noise abatement recommendations have failed to effectively achieve the necessary utilization of the route; and WHEREAS, the utilization of the Route 17 corridor will significantly mitigate the noise over Hackensack while having little to no impact on residential dwellings along the corridor; and WHEREAS, the Governing Body seeks to join in the petition to the Federal Aviation Administration (FAA) and traffic controllers who mandate the air space to prioritize the Route 17 alternate route as the preferred route for arrivals to Runway 19 at Teterboro Airport; and NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the City of Hackensack, County of Bergen and State of New Jersey hereby support the petition requesting the FAA and traffic controllers to prioritize the Route 17 alternate route as the preferred route for arrivals to Runway 19 at Teterboro Airport; and BE IT FURTHER RESOLVED, that the City Clerk be and is hereby authorized and directed to forward a copy of this resolution to the Federal Aviation Administration, the municipalities surrounding the City of Hackensack, TANAAC and our State and Federal representatives. Public Comment A motion to open the meeting to the public was offered by Deputy Mayor Canestrino and seconded by Councilman Battaglia. 10/24/2023 23 Rich Cerbo – Spring Valley should be changed to some type of highway. I say it every time. The busses go by on Spring Valley in a ridiculous manner. They speed by most of the day. Second, this accrued time that was just handed out, is that a lottery now? Is that what is added up when you win the lottery when you retire? Is that just extra cash or a gift? I thought there was something done about that at one time, at least capping it. Mayor Labrosse responded – Yes, we did but we can’t take away from the guys that already had it. Now it is completely gone, and before that we did a $15,000 limit. Mr. Cerbo responded – Okay so they were grandfathered in. Mr. Caruso mentioned a celebration of America in the years to come. That is a great idea. Right here in Hackensack, the townspeople during the revolution the town people asked for a vote on taxes and they never got it from the British. We are still asking for that now. Voting on taxes was what the colonists asked for when they were overthrown by the British asking for money constantly and they never got it. It is written and in history books. This is not that understandable; I know it is something that is going to be involved in recreation and open space but it doesn’t make sense to me. I am urging people vote no on this. Why should you tax people to put in a trust fund? There is another element to this ballot measure and it has to do with property values and it plays into gentrification too. That is a problem here. I don’t think anything was discussed on this agenda. I walked in late on Mr. Mangin’s explanation. He does a good job but it needs more discussion. We don’t know what it is or why it is proposed. Jose Martinez - I have lived on Marvin Avenue for 52 years and in Hackensack for 57 years. How many of you lived here for 57 years? Then you will remember how it was here. Hackensack was a beautiful city with no traffic, no noise, no smell, no high buildings and today we have all of this. They picked up the garbage every twice a week and now it is every week and summer time the smell is terrible. We haven’t made improvement there. Tonight my complaint here is about property tax. This is my first time in 52 years coming to the City to complain. My property tax when I bought my home in 1972 January for a 1 family home 50 feet by 110 long, 1,400 sq feet of living space. My taxes were $850 dollars and today my taxes are $10,350.57 and every year it goes up. You take my social security to pay my taxes. My tax increased by 1,047.81 this year. I ask all of you who are you to increase my taxes every year when Mr. Jim Mangin said the PILOT money is given to the rich developers for 10 to 30 years. He said no rising taxes this year but mine increased 1,047 and my social security is only 700. What kind of leadership are you? If you don’t know how to run the city’s expenses, if you don’t know how to do it, you are going to make the city bankrupt. You increase my property tax every year and it makes my life very difficult. Mayor Labrosse responded – Are you sure it is the municipal tax that went up? You get taxed by three different entities, the City, the schools, and the County. The City hasn’t raised the tax levy in 3 years so if you have not done any work on your property, or haven’t been reassessed you should not of had a tax increase whatsoever in the last 3 years. The school system population has gone down close to 500 students in the past four years with all the buildings, less people are having children or they are sending them to private schools. There are less children now than five years ago. Mr. Martinez responded – When you are taking my money and taking my food, you go to the school and give them money or here or there, that is not right. Mayor Labrosse responded – We do a very good job where we can to bring money into the city through redevelopment through the PILOT programs which will lower taxes to keep them stable or low. Not to mention all the other work being done in town, 48 million dollars in sewer repairs and no one did that before. You are not 10/24/2023 24 the only one who pays taxes. I bought my house in 1979 and paid 1,200 a year in taxes and now I pay over 1,000 per month. I have the same size property as you. No one else wished to speak. Council Comment Deputy Mayor Canestrino – We started off tonight with a lovely celebration of the Majestic Temple’s 100th anniversary. Their mission is to do good things and good in the City of Hackensack and their organization has done good worldwide. Happy to have them here and we appreciate all they do for us. We also recognized Mr. Canal’s passing who was very involved in baseball for years. Another good citizen that contributed to the City and the youth. He will be sorely missed. I am very sorry to hear of his passing. A couple things on the agenda tonight, we talked about the YMCA and we are moving forward with their redevelopment plan. The YMCA was a prominent building in the City on the corner of Main Street they are looking at converting that to 400 units with a nice open space 6,000 sq foot area on the corner. Also was a redevelopment plan for 359 Main across the street where the old credit union was that moved to a new building on the other side of town. They are looking at building 107 units there. 111 Essex Street we are looking at, tonight we authorized a study to be done to designate that area. They are proposing to do 100 percent affordable housing in that site. Another thing we spoke about at the last meeting but tonight it was finalized, we have seen folks parking in our parks even when they are not using the parks, so to make everyone aware, if you are parking in our parks not using them, tickets will now be issued. That will now be in effect. The Open Space Trust fund, Jim spoke about, if you missed you, you can watch it on YouTube. We did this for the past 5 years. It is a trust fund and this money can only be invested in our parks. When work needs to be done in the parks, we don’t have to raise taxes. It is investing a small amount, for the average home it is $34 per year. When we come to a situation where that money can be used effectively, we use it rather than using the general tax funds. This will be on the ballot in November, the City is 100% in support of it. It has worked well so far. Jim specifically talked about targeting this money for Foschini Park to eliminate flooding that is still an issue there. Over the weekend we had a successful Octoberfest, I was happy to go. The Main Street Alliance did a great job putting this together, over 2,000 folks came. I think we had seven weekends in a row of rain. It started at 1 o’clock and the sun stayed out. Thanks to everyone involved to make this a success. It was great to see people in Hackensack enjoying Hackensack. The comments I received were very positive. People were saying Main Street looked great and was bringing the City back to the position of where it should be. We talked about years ago and the downtown degraded over the years. Now we are doing different things but the world changes and we have to change with it and that is what we are doing by reinventing our downtown. It is paying off, folks are spending money helping businesses and paying money into the City. This year’s budget included 4.5 million dollars coming in in PILOTS that comes right off the top and in addition to that the host community agreement with the hospital was renegotiated this year which is another 4 million dollars. Without those two, that is 8.5 million dollars in revenue that would have had to be paid by taxpayers. This Council is working diligently to bring more revenue into the City because I have been in the same house 50 years so I can relate to the comments but the world has changed. What I paid for a loaf of bread versus what I pay today. This Council has worked very hard to protect the residents from seeing a significant impact to their budgets. We had three years in a row with zero municipal tax levy increases, covid did set us back a little but we are on track to control expenditures and keep revenues coming in so that taxpayers don’t have to see significant increases. We hope to see you next time. Also, everyone knows I am working very hard to have the alternate route for the airplanes rerouted over 10/24/2023 25 Route 17 to abate some of the noise over Hackensack. Tonight the Council approved a resolution to hopefully encourage people to recognize the petition. Anyone wanting to sign, it is on the website to urge the FAA to use this flight path more often. Thanks again. Councilman Battaglia – Congratulations to the Majestic Group, they do a wonderful job. I belong to the Lion’s Club which does the same type of work. I am sad about Jimmy passing, he was a close friend and we used to spend weekends with each others families. My condolences to the family. The paving and improvements continue. My taxes are 12,000 and they used to be 3,000. A regular car in 1975 was $5,000 and now it is $55,000. Everything changes. All we can do is make a living in the world we are in right now. The kids have to get prepared because there is no way you can support a family on $40,000. They have to educate themselves to make more money so they can afford it to live in the city or anywhere. It is very hard to live around here. It is hard when you retire and only make $1,000 in social security, it isn’t enough to even pay the taxes. We try to do the best we can. We try to control the spending, try to bring in more revenue. The last thing is happy birthday Mayor. Councilman Carroll – Happy Birthday Mayor. I would like to acknowledge the Majestics Lodge 250th anniversary. I am sad to hear of the passing of Jamie Canal, its a sad day for baseball of Hackensack with his loss. Get home safe and God bless. Mayor Labrosse – Kathy explained the open space trust fund and one penny on every dollar which is a small amount which I understand some people can’t afford but the importance of that is that money saves the taxpayers down the road by not having to raise taxes. When we did this in 2018, it was one of the best moves we made to increase green space and store money away to acquire and take care of our green space which is what we are talking about doing with the trust fund money this time to alleviate flooding in Foschini Park which is at a point where sometimes to you can’t play ball for weeks and weeks. It is a good thing. I understand where you are coming from Rich but Jim will explain how it works. Congratulations on the Majestic Elks for 250 years. It is a great milestone. I was an officer at one point of the Elks, I am proud to have them in the City, they do a lot of good. The passing of Jamie Canal was sudden, we are the same exact age. It is an eye opener as you get older when people your age start passing, it is part of nature and life and all you can do is think of memories and move on. Our intent is to put a plaque on the club house at Foschini Park or on a field. It will be discussed later on but he will be honored for all he has done throughout the years. A friend of mine from Hackensack Lenny Betetto passed away this past week, his brother Butch and I coached wrestling for a long time. He was a 73 graduate as well with Jamie. My condolences there.
