Chapter 173 of the Code of the City of Hagerstown, § 173-5, is hereby amended to include a provision enabling the Mayor and Council to grant an exception to the prohibition against being engaged or concerned in any show or public exhibition by ropes, chains or apparatus suspended at a dangerous elevation above the ground, provided that appropriate safety measure are instituted: § 173-5. Public exhibitions at dangerous elevations. A. It shall be unlawful for any person within the corporate limits of the City to be in any manner engaged or concerned in any show or public exhibition by ropes, chains or apparatus suspended at a dangerous elevation above the ground upon any street, alley or square or above a stage or floor if within any building. B. Performing the necessary repairs, including a new roof, chimney repair, soffit replacement, mortar repair and electrical upgrades will have a minor aesthetic impact. Additional renovation plans include replacing the existing fire engine bay doors with storefront glass and exterior painting and possible window replacement would further enhance the exterior aesthetic. Additional interior renovations will be completed to convert the existing interior to something more compatible with the branding and needs of MSB Architects, which will relocate to the space once construction is complete, bringing 6 professional jobs into the City Center. A financing plan is a required attachment. Describe the financial feasibility of the proposed funding sources, and describe the development experience of the applicant: Please see details in attached financing plan. Funding includes a construction loan from Patriot Federal Credit Union, private funding, and the Invest Hagerstown Grant. While I have not developed any real estate on my own, I have assisted many developers during my career. As an architect, I have an in depth understanding of what it takes to take an older building and bring out its unique charm and characteristics, while bringing it up to date with modern code expectations and conveniences. Having worked with different developers from DM Bowman, Blackwell2, and Hager 5, I have helped bring a variety of projects to completion that enhance Hagerstown. Additionally, I have volunteered on the Economic Development Committee for Main Street Hagerstown and believe this project is keeping with forward momentum for the City's vision with Urban Partners. Discussion: As background information, in November of 1998, the City of Hagerstown entered into an agreement with Enviro-Gro Technologies (currently Synagro) to build a pelletizing facility designed to process and dispose of the sludge that is produced at the Hagerstown WWTP. The process involves pumping the sludge through a belt press to thicken the sludge, heat drying the sludge and disposal of the dried product. The initial term of the contract was ten years, with an option to allow Synagro to extend the operating term for an additional five years, which was executed, during April of 2001. In August, 2006, the contract was extended another 5 years with a provision containing one year renewals. The Mayor and Council approved a ten year contract extension “Third Extension Agreement” with Synagro on September 24, 2013. The agreement further extends a relationship in excess of twenty years whereas Synagro converts the solid waste component of our wastewater treatment process into pellets which are then land applied as a soil amendment or disposed of by other means, depending upon market conditions. The Wastewater Division owns the building, equipment and the associated hardware with Synagro supplying the technology, labor, and disposal services for an operation that produces approximately 15 dry tons per day during a 4.5 day week. The Mayor and Council were recently updated on the projected cost increase for this project from $5.1 to $10.5 million dollars. The additional cost will be incorporated into the current five year rate plan for the Wastewater Division. Construction for Phase 1B of the project is currently under way and includes replacement of the 35 year old Dissolved Air Flotation (DAF) system for thickening liquid sludge prior to sending it to our pelletizing facility which is operated by Synagro. The design for Phase 2 of the project is now complete and a contract is being negotiated with the General Contractor. In an effort to save mark-up costs from the General Contractor, Synagro has issued Purchase Orders directly to all the manufacturers of the major equipment being replaced in the Pelletizing Facility under the Phase 2 project. Deike, Public Works Director RE: Holiday Parking Hours MAYOR AND COUNCIL ACTION REQUESTED Staff is looking for the approval of modified parking hours for the two parking decks (University District Parking Deck and Arts & Entertainment District Parking Deck) during the holiday season. DISCUSSION Modified parking hours for the holiday season is not a new program. The city has provided variations of free holiday parking through previous years. Last year, the city provided for free parking after 5:00 PM weekdays and on Saturday and Sundays in both parking decks. This typically began in November on the Monday after Thanksgiving. The city replaced the entire parking access and revenue control systems in both parking decks this year. Unlike the previous parking program which was web based, the new equipment is now making it extremely difficult for staff to make any modifications to the programming. Therefore, the options for free parking in the parking decks are limited. Staff is proposing that the holiday free parking would include free parking each Friday evening through the weekend. Beginning at 5:00 PM Fridays, the gates would be manually raised allowing free access to the decks. The gates would then be lowered early Monday morning. The free parking would begin a bit earlier this year on Friday November 16th which is the tree lighting in the Square. The following week is Thanksgiving and the gates would be raised on Wednesday November 21st in recognition of this city holiday. The gates would remain up through Monday morning including Black Friday. After that, each weekend would operate as described above. New Years Day in on a Tuesday this year. Staff is proposing the gates would remain up through Monday December 31st for the Donut Drop and on Tuesday January 1st for the city holiday. Parking operations in the parking decks would return to normal on Wednesday January 2nd. FINANCIAL IMPACT The financial impact will be minimal at the University District Deck (UD) as this is used infrequently on weekends.
