AT A REGULAR MEETING FOR THE BOARD OF ZONING APPEALS OF THE CITY OF
HAMPTON, VIRGINIA, HELD IN THE CITY HALL HARDY CASH CONFERENCE ROOM, MAY 16, 2011.
Chairman Thomas Savage called the meeting to order. Upon roll call the following
answered as present: Rodney Gentry, William Hobbs, Burnett Peters, and Thomas Savage.
John C. Pope was absent. Also present were Acting Clerk to the Board, Joseph Dunford; Deputy
City Attorney, Lesa Yeatts; and Jacklyn Ray (recording secretary).

On motion of R. Gentry second by B. Peters to approve the minutes of the May 2, 2011
meeting as submitted.
A roll call vote on the motion resulted as follows:
AYES: Gentry, Hobbs, Peters, Savage
NAYS: None
ABSTAIN: Hobbs
ABSENT: Pope

A public hearing was held for Edward and Susan Black, 788 North 1st Street (LRSN
12007563), and on motion of R. Gentry, second by B. Peters that the variance be granted which
will reduce the required front yard setback from 30 feet to 25 feet; will reduce the required
side yard setback from 15 feet to 5 feet; and will reduce the required setback from the main
dwelling from 15 feet to 10’ to allow a 16’x24’ two‐story accessory structure in the front yard
because:
1. The strict application would produce undue hardship as it is in keeping with other
buildings in the neighborhood; and
2. The hardship is not shared generally by other properties in the same zoning district and
the same vicinity; and
3. The authorization of the variance is not of substantial detriment to adjacent property
and the character of the district will not be changed by the granting of the variance; and
4. The granting of the variance is in harmony with the intended spirit and purpose of the
ordinance.
A roll call vote on the motion resulted as follows:
0AYES: Gentry, Hobbs, Peters, Savage.

A public hearing was held for William Dougoud, Fun in the Son Church, 24 North Mallory
Street (LRSN 12001982), to be considered for a variance to reduce the required front building
setback from 30 feet to 27.93 feet; reduce the required left side yard building setback from 30
feet to 18.39 feet; allow parking in the 30 feet front yard setback and allow parking in the 10
feet side and rear setbacks to allow a church in an existing building.
On motion of W. Hobbs, second by B. Peters that this variance request be continued for
a period of 90 days in order to give the applicant an opportunity to discuss the request with the
Phoebus Improvement League (PIL) as the PIL had written a letter opposing this request.
A roll call vote on the motion resulted as follows:
AYES: Gentry, Hobbs, Peters, Savage
NAYS: None
