AT A REGULAR MEETING FOR THE BOARD OF ZONING APPEALS OF THE CITY OF HAMPTON, VIRGINIA, HELD IN THE CITY HALL HARDY CASH CONFERENCE ROOM, JUNE 20, 2011. Chairman Thomas Savage called the meeting to order. Upon roll call the following answered as present: Rodney Gentry, William Hobbs, Burnett Peters, John C. Pope and Thomas Savage. Also present were Clerk to the Board, Steven Shapiro; Deputy City Attorney, Lesa Yeatts; and Jacklyn Ray (recording secretary). . ____________ . On motion of B. Peters second by W. Hobbs to approve the minutes of the May 16, 2011 meeting as submitted. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Savage NAYS: None ABSTAIN: Pope . ___________ . 11‐021 A public hearing was held for Walter Johnson, 201 Beach Rd., LRSN 10000226. The applicant appeared in person. On motion of J. Pope, second by W. Hobbs that the variance be granted which will reduce the required lot width from 56’ to 50’ to allow the development of a substandard lot because: 1. The strict application of the ordinance would produce undue hardship due to this request being in keeping with the neighborhood; and 2. The hardship is not shared generally by other properties in the same zoning district; and 3. The authorization of the variance is not of substantial detriment to adjacent property and the character of the district will not be changed by the granting of the variance; and 4. The granting of the variance is in harmony with the intended spirit and purpose of the ordinance. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage. NAYS: None 11‐022 A public hearing was held for Old Point National Bank, 101 E. Queen St., LRSN 2002943. The applicant appeared by representative, Jeffery Sanford. On motion of J. Pope, second by R. Gentry that the variance be granted, which will increase the allowed building height from 75’ to 92.9’ to allow the construction of a new building because: 1. The strict application of the ordinance would produce undue hardship: due to the size of the parcel; and 2. The hardship is not shared generally by other properties in the same zoning district and the same vicinity; and 3. The authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by the granting of the variance; and 4. The granting of the variance is in harmony with the intended spirit and purpose of the ordinance. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage NAYS: None . ___________ . 11‐024 A public hearing was held for Garnett Construction, LLC, 2604 E. Pembroke Ave., LRSN 13002691. The applicant appeared by representative, Wade Garnett. On motion of J. Pope, second by B. Peters that the variance be granted which will increase the encroachment in the side yard from 2’ to 4’ to allow HVAC equipment because: 1. The strict application of the ordinance would produce undue hardship due to the exceptional narrowness of the lot; and 2. The hardship is not shared generally by other properties in the same zoning district and the same vicinity; and 3. The authorization of the variance will not be of substantial detriment to adjacent property and the character of the district will not be changed by the granting of the variance; and 4. The granting of the variance is in harmony with the intended spirit and purpose of the ordinance. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage NAYS: None 11‐019 A public hearing was held for William Dougoud, Fun in the Son Church, 24 N. Mallory St. (LRSN 12001982). On motion of J. Pope, second by B. Peters that the variance application be withdrawn per applicant’s written request. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage NAYS: None . ___________ .
