1 CITY OF HAMPTON BOARD OF ZONING APPEALS 2 WORK SESSION SUMMARY 3 4 June 4, 2018 5 The City of Hampton Board of Zoning Appeals held a work session on Monday, June 4, 2018 at 6 4:30 p.m. in the Hardy Cash Conference Room, City Hall, 22 Lincoln Street, Hampton, Virginia. 7 8 In attendance were: Chairman John C. Pope, Vice-Chair Linda Ellis, and Board Members 9 Thomas Savage, Richard Rudnicki, and Dr. Arne Hasselquist. Also present were Zoning 10 Administrator/Community Development Department (CDD) Deputy Director Steve Shapiro, 11 Planning and Zoning Administration Division Manager Michael Hayes, Senior Assistant City 12 Attorney Bonnie Brown, Development Services Center Manager Hannah Sabo, Zoning Official 13 Melvion Knight, City Planner Ana Elezovic, Zoning Official Angela Leflett, Zoning Official Kenar 14 Johnson, and Senior Administrative Assistant/Recording Secretary Ann Crist. 15 Chairman Pope called the work session to order at 4:32 p.m. 16 17 Regarding VA18-00012, Planning and Zoning Administration Division Manager Michael Hayes 18 explained to the Board Members that the site is very large. The applicant is unable to meet the 19 requirement of “first finished floor elevation 3’ above grade” and be ADA (American’s with 20 Disabilities Act) compliant across the site. Staff is recommending approval of this variance with 21 conditions. The conditions are intended to insure that each building will have one point where 22 the first finished floor elevation will be at 3’ above grade. Planning and Zoning Manager 23 Michael Hayes provided the Board Members with an email from the applicant requesting two 24 (2) amendments to these conditions; a copy is attached to these minutes. ON MONDAY, JUNE 4, 2018 4 ITEM I. ROLL CALL 5 6 Chairman Pope called the meeting to order at 5:00 p.m. 7 8 A call of the roll noted those present: Chairman John C. Pope, Vice-Chair Linda Ellis, and Board 9 Members Thomas Savage, Richard Rudnicki, and Dr. Arne Hasselquist. 10 11 Also present were Zoning Administrator/Community Development Department (CDD) Deputy 12 Director Steve Shapiro, Planning and Zoning Administration Division Manager Michael Hayes, 13 Senior Assistant City Attorney Bonnie Brown, Development Services Center Manager Hannah 14 Sabo, Zoning Official Melvion Knight, City Planner Ana Elezovic, Zoning Official Angela Leflett, Zoning Official Kenar Johnson, and Senior Administrative Assistant/Recording Secretary Ann 15 Crist. 16 17 ITEM II. MINUTES – MAY 7, 2018 18 19 A motion was made by Vice-Chair Ellis and seconded by Board Member Savage, to approve 20 the May 7, 2018 Board of Zoning Appeals work session and public hearing meeting minutes. 21 22 A roll call vote on the motion resulted as follows: 23 24 AYES: Hasselquist, Rudnicki, Savage, Ellis, Pope NAYS: None 25 ABSTAIN: None 26 ABSENT: None 27 28 ITEM III. PUBLIC HEARING ITEMS: 29 30 A. VA18-00012: MGD, LLC & Shea Management II, LLC, 20 Libby Street, LRSN 12001509, 31 a variance to reduce the required first finished floor elevation above grade, where 32 there are residential uses on the ground floor, from 3’ to 0.1’. 33 34 After being sworn in by the court reporter, Planning and Zoning Administration Division Manager Michael Hayes presented the case on behalf of the City which is summarized in the 35 staff report and PowerPoint presentation. 36 37 After being sworn in by the court reporter, developer Daniel Aston presented his case to the 38 Board which included photographs and a site plan, copies of which are attached to these 39 minutes. 40 41 After being sworn in by the court reporter, neighbor Jill Davis expressed concern regarding the 42 impact the approval of this variance may have on flood insurance rates. Interim Zoning 43 Administrator/Community Development Department (CDD) Deputy Director Steve Shapiro 44 advised that this project would have no effect on the City of Hampton’s Community Rating System approval with the National Flood Insurance Program and would not affect flood 45 insurance rates. 46 47 After discussion, a motion was made by Vice-Chair Ellis a motion to approve with staff 48 recommended conditions with the two amendments proposed by the applicant; the strict BZA Minutes: June 4, 2018 Page - 2
