AT THE WORK SESSION OF THE HAMPTON PLANNING COMMISSION HELD IN THE LAWSON
CONFERENCE ROOM, 8TH FLOOR, CITY HALL, HAMPTON, VIRGINIA, ON THURSDAY,
DECEMBER 3, 2015, AT 3:00 P.M.
Commissioners Gaynette LaRue, Gregory Williams, Carlton Campbell, Teresa
Schmidt, Mary Bunting, and Chairman Tommy Southall were present. Vice-Chair Andre
McCloud was absent.
Senior Planner Alison Alexander responded to Commissioner Campbell’s
question regarding the email she sent to the Planning Commissioners for the cell tower;
she explained there are two items on cell towers on the agenda and the email from her
concerned a 60-day referral request by PI Telecom Infrastructures, LLC for a tower
location at 231 Pine Chapel Road. This case was deferred previously to allow the
applicant to work further with the Coliseum Central Business Improvement District to find
a more suitable location. They are still working on that process.
Community Development Director Terry O’Neill explained the location of a tower
at 1435 Todds Lane by Verizon Wireless is a Planning Commission Action and not a Use
Permit request. The School Board has the final say on the tower because it would be
located on school property. The School Board wants the land use portion of the
request vetted by the Planning Commission before the School Board makes their final
decision. The action required by the Planning Commission is to make a
recommendation to the School Board for its consideration before entering into a
contract with Verizon.
In response to a question from Commissioner Campbell about those who
attended the community meeting concerning the proposed tower location at 1435
Todds Lane, Ms. Alexander stated only two people attended the meeting from the
community and they only had questions and were not there in either support or
opposition.
Ms. Alexander gave a brief history on the land use process for cell towers, and
stated that 10 school site locations were recommended for cell towers in the 2006
Community Plan. This Planning Commission Action is not part of the Public Hearing.
Both Commissioner Bunting and Senior Assistant City Attorney Bonnie Brown
stated that should the Commission recommend denial of the request, that denial would
have to be based on a legal reason.
In response to a question from Commissioner Schmidt whether aesthetics is a
reason for denial, Ms. Brown explained that it could not be a primary reason, but could
be an incidental reason. The Coliseum Central BID has a broader view of issues and can
express what they want and say things the Commission cannot as they are not a
government body.
Ms. Alexander stated that information did go out regarding the request for
deferral by the applicant. In response to a question about the cell tower being a
necessity, Ms. Alexander presented a propagation map that shows where cell towers
are located and the coverage of each tower.

In response to Commissioner Schmidt’s question as to a provider having the right
to deny another provider use of a tower, Ms. Alexander stated they do, but that is not
usually done.
Planning and Zoning Administration Division Manager Keith Cannady stated the
propagation map provides that information. The providers co-locate on towers; new
towers are needed to provide additional coverage.
Sunshine Torrey from the office of Budget and Management presented a briefing
on the upcoming Capital Improvement Plan process, a copy of which is attached. The
kick-off will be held January 19, 2016 at Kecoughtan High School. Ms. Torrey will come
back with another update for the Commission at the January 7, 2016 Planning
Commission meeting.
In response to Chairman Southall’s question about how many times an
application can be deferred, Mr. O’Neill stated as long as there is a public interest in
the issue a request to defer can be made.
Ms. Alexander stated that if a deferral is requested by an applicant, the
applicant is responsible for the re-advertising fee.
There being no further business, the meeting adjourned at 3:29 p.m.

A. Planning Commission Action No. 15-00002: by Verizon Wireless to allow for the installation
of a 150’ monopole tower at 1435 Todds Lane [LRSN 4001413]. Staff Contact: Alison

A. Use Permit Application No. 14-00020: by PI Telecom Infrastructure, LLC to construct a
communications tower at 231 Pine Chapel Road [LRSN 7001239]. The property is split-
zoned Limited Commercial [C-2] District and One-Family Residence [R-9] District. The
Hampton Community Plan (2006, as amended) recommends mixed use for this area. This
property is also in the Coliseum Central Overlay [O-CC] District. This item was deferred
from the October 1, 2015 Planning Commission agenda. Copies of documents or
information concerning this proposal may be obtained from the Community
Development Department located in Hampton City Hall at 22 Lincoln Street or from

B. Use Permit Application No. 15-00013: by Benita Taylor to operate a day care 3 at 950 Big
Bethel Road [LRSN 4001444] for 20 children with 5 employees. The property is zoned
Neighborhood Commercial (C-1) District, which permits a day care 3 subject to approval
of a use permit. The Hampton Community Plan (2006, as amended) recommends mixed-
use for this area. Copies of documents or information concerning this proposal may be

C. Zoning Ordinance Amendment No. 179-2015: Ordinance to amend and reenact
Chapter 3 of the Zoning Ordinance of the City of Hampton, Virginia by amending
Section 3-3 entitled “Additional Standards On Uses” pertaining to additional standards for
building or structure-mounted commercial communication antennas and to amend and
reenact Chapter 9 of the Zoning Ordinance of the City of Hampton, Virginia by
amending Section 9-23 entitled “Modifications To Permitted Uses” pertaining to building
or structure-mounted commercial communication antennas in the Coliseum Central
Overlay District. Approval of this amendment would clarify the standards which such
antennas must meet and would eliminate the requirement to obtain a use permit for
such antennas in the Coliseum Central Overlay District. This item is being concurrently
advertised for the December 9, 2015 meeting of the City Council. Copies of documents
or information concerning this proposal may be obtained from the Community
