This constitutes a quorum. This Special Meeting has been called for the purposes of a closed session to consult with legal counsel. Angela read the motion for the closed session. The motion required to convene your closed session today is pursuant to Virginia Code § 2.2-3711(8) to consult with legal counsel employed or retained by the Authority regarding the Authority, which requires the provision of legal advice by such counsel. Garth moved for the motion to be approved, Paul seconded the motion, and with a roll call vote, the motion unanimously passed. Angela read the resolution certifying the closed session. The resolution reads as follows: WHEREAS, the Peninsula Stadium Authority, has convened a closed session on this date pursuant to an affirmative recorded vote made in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712D of the Code of Virginia requires a certification by Peninsula Stadium Authority, that such closed meeting was conducted in conformity with Virginia Law;  2 10/18/2023 NOW, THEREFORE, BE IT RESOLVED that the Peninsula Stadium Authority, hereby certifies that, to the best of each member’s knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed session to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Peninsula Stadium Authority. Garth moved for the closed session resolution to be approved, Melissa seconded the motion, and with a roll call vote, the motion unanimously passed. The Chair adjourned the meeting at 7:55 p.m. Next regular meeting is November 6, 2023, at 12:00 (noon) at War Memorial Stadium.
