1 AT A PUBLIC HEARING AND REGULAR MEETING OF THE WETLANDS BOARD OF THE CITY 2 OF HAMPTON, VIRGINIA, HELD IN THE CITY COUNCIL CHAMBERS, CITY HALL, 22 3 LINCOLN STREET, 8TH FLOOR, AT 5: 00 P. M. ON TUESDAY, MARCH 22, 2016 4 5 ITEM I. CALL TO ORDER 6 7 The meeting was called to order at 5: 00 p. m. by Chairman Wood. 8 9 ITEM II. ROLL CALL 10 11 Board Members present and seated were: Mr. Troy Thompson, Ms. Laura Burbage, 12 Ms. Leigh Chapman, Vice- Chairman Gayle Cozzens, Mr. Jeff Amick ( Alternate) Ms. 13 Carole Garrison ( Alternate), and Chairman William Wood. Mr. David Bruckheimer 14 and Mr. Arne Hasselquist were absent. Also present were Veronica Meade, Deputy 15 City Attorney, Mr. David Imburgia, Environmental & Sustainability Manager, and Ms. 16 Dorinda Weeks, Recording Secretary. 17 18 ITEM III. CONSIDERATION OF MINUTES 19 20 Ms. Chapman proposed the following changes: ( 1) page 1, line 44, to read: "... and 21 he is willing to pay the mitigation fee of $3,000" and (2) page 2, line 10, to read: " Mr. 22 Bruckheimer motioned to approve JPA 2015 -1119 and the applicant to pay the 23 mitigation fee. Ms. Burbage seconded the motion." 24 25 Ms. Chapman motioned to approve the February 23, 2016 minutes with the 26 proposed changes. Ms. Cozzens seconded the motion. A roll call vote on the motion 27 resulted as follows: 28 29 AYES: Thompson, Burbage, Chapman, Cozzens, Amick, Garrison, Wood 30 NAYS: None 31 ABSTAIN: None 32 ABSENT: Bruckheimer, Hasselquist 33 34 ITEM IV. PUBLIC HEARING JPA 2015 -1841, SALLY & GARY POWELL, 4408 CHESAPEAKE 35 AVENUE RIPRAP REVETMENT AND GROIN 36 37 Mr. Imburgia presented JPA 2015 -1841 to the Board: The applicant proposes to 38 remove one existing groin, reconstruct a second derelict groin, and construct 80 39 linear feet of new revetment channelward of an existing bulkhead at a single family 40 residential property along the shoreline in the Hampton Roads waterbody. The 41 primary purpose is to stabilize the existing bulkhead which is showing signs of failure. 42 The secondary purpose is to maintain access to the waterfront and continue to 43 capture sand along this shoreline. 44 45 The proposed 80 linear feet of revetment will result in a loss of 720 square feet of non - 46 vegetated tidal wetlands. Reconstruction of the northern groin will result in a loss of 47 48 March 22, 2016 Minutes - 1 1 170 square feet of non -vegetated tidal wetlands. The project will include a total loss 2 of 890 square feet of non -vegetated tidal wetlands. 3 4 Staff advised the applicant of the requirement to compensate for tidal wetlands loss. 5 The Wetlands Board' s Mitigation -Compensation Policy requires compensatory 6 mitigation in order to achieve no net loss of existing wetlands acreage and function. 7 If the in -lieu fee fund option is utilized, the fee should be $ 5, 800 ( 290 square feet lost) 8 x ( 1. 25) x ($ 16. 00 /square foot). 9 10 The, ap( licant, Mr. Powell, expressed his concern of the existing deteriorating prr-operty groin due to wave and storm action and how stabilization would allow 12 access to the waterfront. 13 14 Mr. Imburgia communicated that the area between MLW and MHW is considered 15 non -vegetated wetlands, and the impacted square footage does include the 16 existing groin even though it is rocks. 17 18 After discussion of the existing concrete groin and the square footage of the 19 concrete arm, it was determined that 17 square feet of the concrete wall will be 20 removed from the applicants' proposal and will not be included in the calculations; 21 therefore, the in -lieu fee would be $5, 460. 22 23 Staff is not certain if there is sufficient sand in the littoral drift system, without 24 nourishment, to support a groin, so a future nourishment project may come before 25 the Board for evaluation. 26 27 Ms. Burbage motioned to approve JPA 2015 -1841 with standard conditions; however, 28 the mitigation requirement removes 17 square feet out of the calculation which 29 would now be $ 5, 460 and an added condition for groin construction shall be 30 sequenced as to minimize the loss of existing sand. Mr. Amick seconded the motion. 31 A roll call vote on the motion resulted as follows: 32 33 AYES: Thompson, Burbage, Cozzens, Amick, Garrison, Wood 34 NAYS: None 35 ABSTAIN: Chapman 36 ABSENT: Bruckheimer, Hasselquist 37 38 Permit has been granted according to the conditions. 39 40 ITEM Va. MATTERS BY STAFF - In -Lieu Fee Fund 41 42 Mr. Imburgia presented an update to the Board of the current In -Lieu Fee Fund 43 balance: $ 48,405.00. 44 45 ITEM Vb. MATTERS BY STAFF - JPAs Processed Since July 1, 2015 46 47 There were eighteen ( 19) " No Permit Necessary" letters issued since July 1, 2015. 48 March 22, 2016 Minutes - 2 1 2 Three Joint Permit Applications are in review: 3 JPA 2015 -1841, 4408 Chesapeake Avenue, riprap revetment and groin. 4 JPA 2016 -0239, 1 Boxwood Point Road, riprap revetment. 5 JPA 2016 -0325, Club Run Boulevard, oyster sanctuary/ reef balls. 6 7 One Joint Permit Application has been denied. 8 JPA 2015 -1119, Karl Schmidt, 1 l 1 Alamo Court, bulkhead and pier. 9 10 ITEM Vc. MATTERS BY STAFF - Updates from Staff 11 VIMS Tidal Wetlands Workshop will be held May 5, 2016. If any members do not plan 12 to attend, please notify Mr. Imburgia. 13 14 ITEM VI. MATTERS BY THE PUBLIC 15 16 No matters were presented by the public. 17 18 ITEM VII. MATTERS BY THE BOARD 19 20 No matters were presented by the Board. 21 22 ITEM VIII.
