3 LINCOLN STREET, HAMPTON, VIRGINIA, ON TUESDAY, NOVEMBER 22, 2016 AT 5: 00 P. M.

5 ITEM I. CALL TO ORDER

7 In the absence of Chairman Wood, Vice-Chairman Cozzens called the meeting to
8 order at 5: 00 p.m.

10 ITEM II. ROLL CALL

12 A call of the roll noted Board Members Laura Burbage, Vice-Chairman Gayle Cozzens,
13 Dr. Arne Hasselquist, Troy Thompson, and Leigh Chapman as being present; Board
14 Member Jeff Amick and Chairman William Wood as being absent. Staff in
15 attendance: Deputy City Attorney Veronica Meade, Wetlands Board Coordinator and
16 City Site Plan/ Subdivision Agent II Andrew Griffey, and Recording
17 Secretary/ Administrative Assistant Shaelee Jones.

19 ITEM III. CONSIDERATION OF MINUTES

21 Board Member Chapman proposed that on page two, line eleven, the words " are
22 good" after Joint Permit Applications be removed due to improper grammar.

24 A motion then was made by Board Member Chapman and seconded by
25 Board Member Thompson to approve the minutes of the October 25, 2016 Public
26 Hearing and Regular Meeting. A roll call vote on the motion resulted as follows:

28 AYES: Cozzens, Thompson, Chapman
29 NAYS: None
30 ABSTAIN: Burbage, Hasselquist

33 ITEM IV. JOINT PERMIT APPLICATION 2016- 1653: FRANCISCUS HOMES, INC.

35 This was a proposal to have an ADA- accessible kayak/ boat launch on Newmarket
36 Creek at 1625 Power Plant Parkway for a proposed multi- family development. The
37 purpose and need was to give water access to the future tenants of the
38 development. A 5' x 7' section of pier would extend over the Wetlands Board
39 jurisdiction with no impacts expected. There was no mitigation proposed for the
40 project. Wetlands Board Coordinator Griffey then showed different aerial images of
41 the general location of the proposed pier.

43 Board Member Hasselquist questioned whether or not the trail in one of the aerial
44 images is part of the property; Wetlands Board Coordinator Griffey confirmed that the
45 trail is not part of the subject property. Board Member Chapman then asked if the
46 grass in the aerial photo was pasture land; Coordinator Griffey confirmed that was
47 correct.

1 Board Member Hasselquist questioned whether or not the floating dock would be
2 resting on non-vegetated wetlands within Wetlands Board jurisdiction during low tide;
3 he wanted to make sure there would be no damage to the non-vegetated wetlands.
4 Wetlands Board Coordinator Griffey stated that the floating dock would not be within
5 the Board' s jurisdiction during low tide.

7 Board Member Chapman questioned, when looking at the site plan portion of the
8 JPA, whether the kayak dock is even shown. Wetlands Board Coordinator Griffey
9 stated that no, the kayak dock is not shown on the presented site plan; it has actually
10 gone through a couple of changes since the JPA was submitted. Board Member
11 Thompson then questioned why the pine tree would be cut down; Wetlands Board
12 Coordinator Griffey responded he believes it to be due to the need of putting the
13 ADA- accessible walkway in that area. Board Member Chapman next questioned
14 whether the wording in the JPA should be modified so it does not show " permanent"
15 impacts to Wetlands. Wetlands Board Coordinator Griffey responded that that could
16 be done.

18 A motion was made by Board Member Chapman and seconded by Board
19 Member Hasselquist to approve JPA 2016- 1653 with conditions as stated in the staff
20 report.

30 ITEM V. MATTERS BY STAFF

32 Wetlands Board Coordinator Griffey announced that there is one JPA currently in
33 review; he still has not heard back from the applicant.

35 ITEM VI. MATTERS BY THE PUBLIC

37 Becky Wilk of Kerr Environmental on behalf of Franciscus Homes stated that she could
38 clear up Board Member Chapman' s question about the " permanent impacts" to
39 Wetlands written in the JPA. Ms. Wilk stated that the 35 sq. ft. of " permanent impact"
40 was added for a potential shading impact, and that the note was included more for
Al the Corps as they may evaluate that impact.

43 ITEM VII. MATTERS BY THE BOARD

45 Board Member Chapman shared a " thank you" with the Board, stating she has been
46 on the Board for 13 years and this would be her last meeting unless there is one to be
47 held in December.
