CALL TO ORDER AND ANNOUNCE A QUORUM PRESENT 2. CITIZENS PARTICIPATION AND COMMENTS An opportunity for citizens to address the Planning and Zoning Commission (Commission) on matters which are on the agenda or are not scheduled for consideration (non-agenda items). The Texas Open Meetings Act prohibits deliberation by the Commission of any subject which is not on the posted agenda, therefore the Commission will not be able to discuss or take action on items not listed on this agenda, other than to make statements of specific factual information or to recite existing policy in response to the inquiry. NOTE: In order to address the Commission during this time, or later in the meeting for any item that is scheduled on the agenda, please complete, and submit a speaker card to the City Secretary prior to the start of the meeting. The presiding officer may ask the speaker to hold comments on agenda items until that agenda item is reached. 3. ATTACHMENTS: Exhibit EXECUTIVE SUMMARY BACKGROUND INFORMATION: Currently, several accessory uses and structures have been left off of Table 4.3-1 as well as some need to change from allowed by right to being allowed by a Specific Use Permit. Other uses need to be taken off the allowed use category. ANALYSIS The attached Exhibit shows in red the areas that are recommended for change. Underline items are proposed to be added while cross thru are to be eliminated. It is recommended that storm shelters be allowed in all districts as well as residential garages that are detached and sheds be allowed in the Old Town Core. It is also recommended that a new category of accessory uses such as electric vehicle charging stations be allowed in residential areas that are non-commercial in nature. Another significant change is that outdoor storage in commercial and industrial areas be allowed only with a specific use permit instead of being allowed by right. The last recommendation is that an accessory garage apartment have a maximum square footage no larger than the floor area of the garage with a maximum size of 800 sq. ft. and that a secondary accessory dwelling unit be no larger than 800 sq. ft. and not be allowed in the R-1 or R-2 district. Accessory Dwelling Unit (garage):An accessory garage apartment that meets the standards in this section shall not count as a dwelling unit for purposes of calculating density on the site: 1. Shall be located above a detached garage[.] 2. Maximum size shall be either the garage floor area with a maximum of 800 sq. ft. 400 sq. ft. (whichever is greater). 3. Shall not have more than one kitchen or one bathroom. F. Accessory Dwelling Unit (Secondary primary structure): An accessory dwelling unit in the AG, R-1, R-2, MU-N, and OT-T districts that meet the standards in this section shall not count as a dwelling unit for purposes of calculating density on the site. They shall: 1. ANALYSIS The attached Exhibit shows in red the areas that are being proposed by an ordinance amendment that will match the original intent and clarify for use by potential developers and City Staff. In developments outside of the “Old Town District” all setbacks are measured solely from the property line, however, due to the reduced lot size of many of the lots and pre-existing conditions setbacks are a combination measured from the back of curb, back of sidewalks and property lines.
