AGENDA REGULAR MEETING HELOTES CITY COUNCIL June 13, 2024 7:00 p.m. The City of Helotes City Council will meet for a Regular Meeting on Thursday, June 13, 2024, at 7:00 p.m. in the City Hall Council Chambers, 12951 Bandera Road, Helotes, Texas 78023. Council Members may participate remotely by videoconferencing; however, a physical quorum of the City Council shall be present at Helotes City Hall. This is an open meeting, subject to the open meeting laws of the State of Texas. 1. Call to order. • Invocation. • Pledge of Allegiance. OPEN SESSION: 2. Citizens to be Heard. The City Council shall not discuss any presented issue, nor may any action be taken on any issue at this time (Attorney General Opinion JC-0169). The Council will accept comments from citizens, business owners, business representative’s, property owners, and representatives of property owners of the City of Helotes and its Extraterritorial Jurisdiction (ETJ) only. Comments are limited to three (3) minutes and this time is not transferable. Each person may only speak once. No profanity or threats will be tolerated. CONSENT AGENDA (ITEM NO. 3): All Consent Agenda items listed below are considered routine by City Staff and are intended to be enacted by one motion. There will be no separate discussion of these items, unless a Councilmember requests it, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the Agenda. 3. Approval of the minutes of the Regular Meeting dated May 23, 2024. Updates on the following: • TxDOT improvements; and • Helotes Independence Day Celebration & Fireworks event on Wednesday, July 3, from 6:00 PM to midnight at the Helotes Festival Fairgrounds. ITEMS FOR INDIVIDUAL CONSIDERATION: 5. Discussion of and action on the Bexar Appraisal District Proposed 2025 Annual Budget. (Staff) - Agenda Item 6. Discussion of and action on the following appointments to the Board of Adjustment to serve a two year term that runs in conjunction with the Mayor’s term: • Place 1 Alternate (“1a”) – Cody Marshall; and • Place 2 Alternate (“2a”) – Michael Gutierrez. (Mayor) - Agenda Item 7. Discussion of and action on the following appointments/*reappointment to the Ethics Commission to serve a two year term that runs in conjunction with their corresponding Council Member’s term: • Council Member Sanders nominee – Robert Viera, Place 1; • *Council Member Sones reappointment – Shawna Misiong, Place 2; and • Council Member McGowan nominee – Richard Acuna, Place 4. (City Council) - Agenda Item 8. Second and final reading, and action on an Ordinance of the City Council of the City of Helotes, Texas, amending Municipal Code of Ordinances Chapter 70 Solid Waste, Article III Trimming by Tree Contractors by adding Section 70-43 Exemptions to establish regular lawn maintenance does not require a permit and incorporating terms in Chapter 94 Vegetation, Article I Commercial and Residential Subdivision Tree Preservation, Section 94-2 Definitions to identify scope of work applicable to regular lawn maintenance. Discussion of and action on a request by Daniel and Laura LaVoie for approval of two variances to Municipal Code of Ordinances Chapter 18 Buildings and Building Regulations, Section 18-12 (b) International Building Code Adopted, Subsection 312.2 Access Control Gate Systems authorizing two vehicular access gates to encroach on the required setback of twenty feet (20’) from the property line on a residential zoned lot located at 11108 Baxtershire, Helotes, Texas 78023, and identified as BCAD Prop. Discussion of and action on accepting a petition by L&F-1, LLC for the voluntary annexation of two parcels of land totaling approximately 10.016 acres, being the future Bricewood Subdivision Unit-6A, all of which is currently located within the City of Helotes Extraterritorial Jurisdiction, and specifically described as: a) A 5.358 acre tract of land currently addressed as 10851 Paloma Drive, BCAD Property Tax ID No. 236310; and b) A 4.658 acre tract of land currently addressed as 10851 Paloma Drive, BCAD Property Tax ID No. 236313. (Staff) - Agenda Item Adjourn into Closed Session. CLOSED SESSION: 11. Closed Session in accordance with Texas Government Code §551.074 Personnel Matters. In addition to the matters listed below, any matter scheduled for Open Session may be discussed in Closed Session, as appropriate and authorized by law: • §551.074 Personnel Matters related to the duties of city employees.
