Is that correct? Town Attorney Maccarone replied, "That is correct. " Supervisor Clavin stated, "And the decision will rescind the zone and not Grandfather any applications that have already been submitted?" Town Attorney Maccarone stated, 'That is correct. " Supeniisar Clavin asked Steven Losquadra, Special Caunsdta the Town, ta discuss same of the determining factors for the residents, so they will understand the Decision Calendar. Counsel Losquadra replied to the Supervisor, consistent with what you wanted and what the balance of the board wanted ta make sure with respect ta - 152 -  November 19, 2024 CASE NO. 30115 - PUBLIC HEARING- Continued an understanding of this zone and impacts that could affect the communities that are comprised within the zone, particularly to North Lawrence & Inwood that there should be a very comprehensive review and a study to understand what impacts could take place to this zone on a moving forward basis, on a build out basis, on a developmental basis. Also, quite frankly, how the zone was enacted and whether that was done properly again the best interests of the Town, and its residents could be met. One of things that was learned in conjunction with a very comprehensive review authorized by Nelson, Pope & Voorhis, the Towns environmental consultants, that there were a number of inadequacies with regard to how this zone was enacted. Not by this board but under the guidance of the prior Supervisor, Ms. Gillen. And one of the things that was learned and that was actually most glaring in the process is that the notification requirements and the legal obligations that the Town would actually, does have and continues to have in every instance with respect to notifying and reaching out and making sure there's proper communication to affected residents and property owners were not met with regard to the enactment of this zone. So, Mr. Supervisor, with respect to that glaring inadequacy and others, it is very clear that recission as the board will now take as an action is not just appropriate but actually required because the zone itselfwould be null and void. And again, this is an action, and a consequence brought about by a decision and improper steps taken by a prior Supervisor but something now of course responsible that the board here today must deal with in the best interests of the residents. Supervisor Clavin responded, "the other thing I wanted to clarify that the recission does not include the Grandfather in. It is a recission of the entirety, correct?" Special Counsel Losquadro replied, "That is correct it is across the board. " Supervisor Clavin responded, "Okay, this is to rescind the zone and not Grandfather in those developments and that is based on the analysis and reports as set forth by our outside counsel as well as our consulting agency. I wanted to let everyone know for the record because there was some confusion that this will rescind the zone or would not.
