A Regular November 13, 2012 A regular the meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Tuesday, November 13, 2012, at 5:30 p.m., prevailing time, in the third floor Assembly Room located in the Municipal Center Building at 222 First Street, Henderson, Kentucky. INVOCATION was given by Pastor Vernon Rigsby, Apostolic Bread of Life Church, and then Mayor Austin led the assemblage in the recitation of the Pledge of Allegiance to our American Flag. ________________________ There were present Mayor Steve Austin presiding: PRESENT: Commissioner Mike Farmer Commissioner Alan C. MIKE VICKERS, Bernardin, Lochmueller & Associates, Inc., stated that the firm has opened a Madisonville office and he is located there. He added that his firm was deeply involved with the I-69 project. ___________________________ PROCLAMATION: “PANCREATIC CANCER AWARENESS MONTH” MAYOR AUSTIN proclaimed the month of November 2012 as “PANCREATIC CANCER AWARENESS MONTH” and urged all citizens to support the Pancreatic Cancer Action Network (PanCAN) and its volunteers across the country to spread the word to raise awareness and increase research for Pancreatic Cancer. Mr. John Harris accepted the proclamation designating the month of November as “Pancreatic Cancer Awareness Month.” A Regular November 13, 2012 PROCLAMATION: “COLLEGE APPLICATION WEEK AND COLLEGE COLORS DAY” MAYOR AUSTIN announced and proclaimed November 26-30, 2012, and “College Application Week” and November 26, 2012, ad “College Colors Day” and urged citizens to acknowledge and highlight the importance of high school students being prepared to apply to college. Ms. Rachel Heath, Henderson County High School College Coach-Americorps, accepted the proclamation. ___________________________ APPROVAL OF CONSENT AGENDA: MAYOR AUSTIN asked Carolyn Williams, City Clerk, to read the following item included on the Consent Agenda: Minutes: October 23, 2012, Regular Meeting MOTION by Commissioner Mills, seconded by Commissioner Pruitt, to approve the items on the Consent Agenda as enumerated. The vote was called. The vote was called. On roll call, the vote stood: Commissioner Taylor ---------------- Aye: Commissioner Mills ----------------- Aye: Commissioner Farmer --------------- Aye: Commissioner Pruitt ----------------- Aye: Mayor Austin ------------------------- Aye: WHEREUPON Mayor Austin declared the ordinance adopted, affixed his signature and the date thereto and ordered that the same be recorded. /s/ Steve Austin Steve Austin, Mayor November 13, 2012 ATTEST: Carolyn Williams, City Clerk ______________________________ ORDINANCE NO. 31-12: FIRST READING ORDINANCE AMENDING JOB CLASSIFICATION AND PAY PLAN BY RECLASSIFYING ONE HENDERSON WATER UTILITY (HWU) SECRETARY POSITION TO HWU SECRETARY, SENIOR POSITION, AND AMENDING A Regular November 13, 2012 HENDERSON WATER UTILITY (HWU) BUDGETED POSITIONS AND JOB CLASSIFICATIONS OF THE 2012-2013 HWU BUDGET BY ADDING ONE HWU SECRETARY SENIOR POSITION AND DELETING ONE HWU SECRETARY POSITION On first reading of the Ordinance, it was moved by Commissioner Farmer, seconded by Commissioner Mills, that the Ordinance be adopted. The vote was called. On roll call, the vote stood: Commissioner Taylor ---------------- Aye: Commissioner Mills ----------------- Aye: Commissioner Farmer --------------- Aye: Commissioner Pruitt ----------------- Aye: Mayor Austin ------------------------- Aye: WHEREUPON Mayor Austin declared the Ordinance adopted on its first reading and ordered that it be presented for a second reading at a meeting of the Board of Commissioners. ______________________________ RESOLUTION NO. 96-12 RESOLUTION AWARDING BID FOR THE PURCHASE OF A 2013 CAB AND CHASSIS TO DON MOORE CHEVROLET OF OWENSBORO, KENTUCKY, IN THE AMOUNT OF $21,357.00 MOTION by Commissioner Pruitt, seconded by Commissioner Taylor, to adopt the resolution authorizing the award of a bid for the purchase of a 2013 one-ton dump truck, cab and chassis only, to Don Moore Automotive Team, Owensboro, Kentucky, in the amount of $21,357.00 The vote was called. RUSSELL R. SIGHTS, CITY MANAGER, relayed that our calendar shows that the regular Henderson Water Utility meeting listed to be held on November 19th has been changed to November 15, 2012, as a Called Meeting. _________________________ COMMISSIONER’S REPORTS: COMMISSIONER MILLS commented that the Harding Avenue project was a big improvement for that area and applauded the Cornbleet’s for the work they have done. A Regular November 13, 2012 ________________________ COMMISSIONER PRUITT thanked the people for supporting him for another term. EXECUTIVE SESSION: LITIGATION MOTION by Commissioner Farmer, seconded by Commissioner Pruitt, pursuant to the provisions of KRS 61.810(1)(c) that the Board of Commissioners go into Executive Session for the purpose of discussions of proposed of pending litigation against or on behalf of the public agency. The vote was called.
