A Regular October 23, 2012 A regular the meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Tuesday, October 23, 2012, at 5:30 p.m., prevailing time, in the third floor Assembly Room located in the Municipal Center Building at 222 First Street, Henderson, Kentucky. INVOCATION was given by Mayor Steve Austin, and then the Mayor led the assemblage in the recitation of the Pledge of Allegiance to our American Flag. ________________________ There were present Mayor Steve Austin presiding: PRESENT: Commissioner Mike Farmer Commissioner Alan C. The vote was called. PENALTY ARTICLE V, PROPERTY MAINTENANCE CODE OF THE CODE OF ORDINANCES FOR THE CITY OF HENDERSON On second reading of the Ordinance, it was moved by Commissioner Taylor, seconded by Commissioner Pruitt, that the Ordinance be adopted. The vote was called. On roll call, the vote stood: Commissioner Taylor ---------------- Aye: Commissioner Mills ----------------- Absent: Commissioner Farmer --------------- Aye: Commissioner Pruitt ----------------- Aye: Mayor Austin ------------------------- Aye: WHEREUPON Mayor Austin declared the ordinance adopted, affixed his signature and the date thereto and ordered that the same be recorded. /s/ Steve Austin Steve Austin, Mayor October 23, 2012 ATTEST: Carolyn Williams, City Clerk ______________________________ ORDINANCE NO. 30-12: FIRST READING ORDINANCE ACCEPTING PUBLIC IMPROVEMENTS IN III C SQUARE APARTMENTS, 501 HARDING AVENUE, CONSISTING OF CONCRETE SIDEWALKS On first reading of the Ordinance, it was moved by Commissioner Farmer, seconded by Commissioner Pruitt, that the Ordinance be adopted. The vote was called. On roll call, the vote stood: Commissioner Taylor ---------------- Aye: Commissioner Mills ----------------- Absent: Commissioner Farmer --------------- Aye: Commissioner Pruitt ----------------- Aye: Mayor Austin ------------------------- Aye: WHEREUPON Mayor Austin declared the Ordinance adopted on its first reading and ordered that it be presented for a second reading at a meeting of the Board of Commissioners. ______________________________ RESOLUTION NO. 95-12 RESOLUTION OF THE CITY OF HENDERSON, KENTUCKY (“CITY”) AUTHORIZING THE EXECUTION OF A GAS SALE CONTRACT (“CONTRACT”) WITH THE PUBLIC ENERGY AUTHORITY OF KENTUCKY (“PEAK”) FOR THE PURCHASE OF NATURAL GAS FROM PEAK; ACKNOWLEDGING THAT PEAK WILL ISSUE ITS GAS SUPPLY REVENUE BONDS, 2012 SERIES A, TO FUND THE PURCHASE OF A SUPPLY OF NATURAL GAS FROM MORGAN STANLEY CAPITAL GROUP (“MSCG”), WHICH GAS WILL BE USED TO MAKE DELIVERIES UNDER THE CONTRACT; AND FOR OTHER PURPOSES A Regular October 23, 2012 MOTION by Commissioner Farmer, seconded by Commissioner Pruitt, to adopt the resolution authorizing the execution of a Gas Sale Contract with the Public Energy Authority of Kentucky, Inc. (PEAK). MAYOR AUSTIN introduced Mr. Owen Reeves, Gas System Director. MR. REEVES explained that he and Mr. Gerald Ballinger, PEAK General Manager, are present to ask the Board to authorize the execution of a Gas Sale Contract with Public Energy Authority of Kentucky, Inc. (PEAK). This contract establishes the basis upon which Henderson will obtain natural gas from PEAK, Inc., for resale through our gas distribution system to our customers. This contract stems from a 30-year Natural Gas Sale Agreement with Morgan Stanley Capital Group. DISCUSSION WAS HELD. VERBATIM DISCUSSION IS ON TAPE OF THIS MEETING. The vote was called.
