Record of Minutes of A Regular Meeting on August 27, 2019
A meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held
on Tuesday, August 27, 2019, at 5:30 p.m., prevailing time, in the third floor Assembly Room
located in the Municipal Center Building at 222 First Street, Henderson, Kentucky.
INVOCATION was given by Deacon Earnest Jones, New Jerusalem Missionary Baptist
Church, followed by recitation of the Pledge of Allegiance to our American Flag.

PRESENTATION: “Humane Society Quarterly Report”
KENDRA GALLAGHER-STRAWN, Humane Society of Henderson County, introduced
the new shelter Executive Director. DEBBIE EDWARDS, Humane Society of Henderson
County Executive Director, gave a brief update on happenings at the Humane Society Shelter.
There has been an outbreak of Parvo at the shelter as well as New Hope Animal Shelter. Neither
shelter will be able to receive any animals during the 14 day quarantine period. Emergency calls
will be handled by the Animal Control Officer as normal.

Understanding Between the Henderson County Sheriff’s Office
and the City of Henderson Through the Police Department
Regarding the Emergency Response Team (ERT)
Resolution: 53-19: Resolution Authorizing Acceptance of Grant in the Amount
of $683,596.00 from the United States Department of
Transportation, Federal Aviation Administration, for Runway
Extension Project to the Henderson City-County Airport; and
Authorizing and Directing Mayor to Execute any Necessary
Documents on Behalf of the City of Henderson
Motion by Commissioner Royster, seconded by Commissioner Vowels, to approve the
items on the Consent Agenda as presented.

AN ORDINANCE AMENDING ARTICLE II, WATER AND SEWER SERVICE, OF
CHAPTER 23, UTILITIES, DIVISION 1, GENERALLY, SEC. 23-16.1, DIVISION 2, SEWER
USE REGULATIONS, SEC. 23-26, SEC. 23-30 AND SEC. 23-32 OF THE CODE OF

MAYOR AUSTIN indicated that the next item on the agenda is an ordinance relating to
the 9-1-1 fees and that a similar ordinance was approved by Henderson County Fiscal Court
earlier today.

MAYOR AUSTIN indicated that the next item on the agenda relates to the levy and
collection of Ad Valorem taxes and there is no increase in the City property tax rate for the
coming year.

ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF AD
VALOREM TAXES
AN ORDINANCE OF THE CITY OF HENDERSON, KENTUCKY PROVIDING FOR
THE LEVY AND COLLECTION OF AD VALOREM TAXES FOR THE FISCAL YEAR
BEGINNING JULY 1, 2019, AND PROVIDING FOR THE TIME OF PAYMENT FOR SUCH
TAXES, PENALTY, INTEREST AND DISCOUNT

PURCHASE OF FOUR (4) PATROL/PURSUIT VEHICLES (GROUP A) IN THE AMOUNT
OF $134,656.00; AND FOR ONE (1) SEDAN (GROUP B) TO STERNBERG, INC. OF
JASPER, INDIANA IN THE AMOUNT OF $26,566.00 FOR THE POLICE DEPARTMENT

MOTION by Commissioner Staton, seconded by Commissioner Royster, to approve
amending Municipal Order 08-19 relating to the purchase of vehicles for the police department.
HEATH COX, Police Chief, reported that one of the vehicles received did not meet
specifications as a police pursuit vehicle, however upon discussion with the dealership, and
taking into consideration the amount of time to order and receive another vehicle, it was
determined that the vehicle would meet specifications of an administration vehicle that is
scheduled to be replaced in the next fiscal year budget with a few modifications. The additional
equipment would be approximately $7,600.00 this year and would decrease the requested vehicle
budget next year by approximately the same amount.

COMMISSIONER’S REPORT:
MAYOR AUSTIN reported that there would be no meeting conducted on Tuesday,
September 24th due to a conflict with the Kentucky League of Cities Conference and Board
meetings.

PROCLAMATION: “New Jerusalem Missionary Baptist Church 100th Anniversary”
Reverend ROBERT L. WHITLOCK, and members of the congregation of the New
Jerusalem Missionary Baptist Church were in attendance to accept the proclamation extending
congratulations and best wishes on the church’s 100th Anniversary.
MAYOR AUSTIN thanked Reverend Whitlock and the congregation on behalf of the
entire Board of Commissioners and the community for all they do for our citizens.

EXECUTIVE SESSION: Litigation and Real Property
MOTION by Commissioner Bugg, seconded by Commissioner Staton, that the Board of
Commissioners go into Executive Session pursuant to the provisions of KRS 61.810(1)(C) for
the purpose of discussion of pending litigation against the City and pursuant to KRS
61.810(1)(B) for discussion of the potential purchase of real property located in the Highway
351, Airline Road and Adams Lane area.
