170 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on November 19, 2019 A special called meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Tuesday, November 19, 2019, at 5:15 p.m., prevailing time, in the third floor Assembly Room located in the Municipal Center Building at 222 First Street, Henderson, Kentucky. There were present Mayor Steve Austin presiding: PRESENT: Commissioner Patti Bugg Commissioner X R. Royster, III Commissioner Bradley S. Staton Commissioner Austin P. Vowels ALSO PRESENT: Mr. William L. “Buzzy” Newman, Jr., City Manager Mrs. Dawn Kelsey, City Attorney Ms. Maree Collins, City Clerk Mrs. Donna Stinnett, Community Relations Manager/Public Information Officer Mrs. Connie Galloway, Human Resources Director Mr. Robert Gunter, Finance Director Mr. Heath Cox, Police Chief Mr. Dylan Ward, Project Manager Mr. Brian Bishop, Planning Commission Executive Director Ms. Lindsay Locasto, Downtown Henderson Partnership Executive Director Mr. Kevin Knight Mr. Ryan Walenga, Police Sergeant Mr. Douglas White, the Gleaner ________________________ ORDINANCE NO. 30-19: SECOND READ ORDINANCE AMENDING APPENDIX A – ZONING AN ORDINANCE AMENDING APPENDIX A – ZONING, ARTICLE IV, GENERAL PROVISIONS, BY ADDING SECTION 4.22 SOLAR ENERGY SYSTEMS (SES) OF THE CODE OF ORDINANCES OF THE CITY OF HENDERSON MOTION by Commissioner Staton, seconded by Commissioner Royster, that the ordinance be adopted. The vote was called. On roll call, the vote stood: Commissioner Royster -- Aye: Commissioner Staton ---- Aye: Commissioner Vowels --- Aye: Commissioner Bugg ----- Aye: Mayor Austin ------------- Aye: WHEREUPON, Mayor Austin declared the ordinance adopted, affixed his signature and the date thereto and ordered that the same be recorded. /s/ Steve Austin Steve Austin, Mayor ATTEST: November 19, 2019 Maree Collins, CKMC, City Clerk ________________________ ORDINANCE NO. 31-19: SECOND READ ORDINANCE RELATING TO PARKING AN ORDINANCE AMENDING CHAPTER 22, TRAFFIC AND MOTOR VEHICLE, ARTICLE II – PARKING, STOPPING AND STANDING, DIVISION 1, SECTION 22-62 – LIMITED FREE PARKING TO PROVIDE FOR THREE HOURS OF FREE PARKING FROM 171 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on November 19, 2019 DECEMBER 1, 2019 UNTIL FEBRUARY 29, 2020 AND SECTION 22-63 EVADING TIME LIMITATIONS PROHIBITED CHANGING TEN TIMES A WEEK TO FIVE TIMES A WEEK FROM DECEMBER 1, 2019 THROUGH FEBRUARY 29, 2020 MOTION by Commissioner Bugg, seconded by Commissioner Royster, that the ordinance be adopted. COMMISSIONER STATON asked if this could be reviewed in early February so that there would not be a lag in keeping the ordinance in place after the trial period. MAYOR AUSTIN indicated that a report would be presented in February for review. The vote was called. On roll call, the vote stood: Commissioner Royster -- Aye: Commissioner Staton ---- Aye: Commissioner Vowels --- Aye: Commissioner Bugg ----- Aye: Mayor Austin ------------- Aye: WHEREUPON, Mayor Austin declared the ordinance adopted, affixed his signature and the date thereto and ordered that the same be recorded. /s/ Steve Austin Steve Austin, Mayor ATTEST: November 19, 2019 Maree Collins, CKMC, City Clerk ________________________ ORDINANCE NO. 32-19: FIRST READ ORDINANCE AMENDING CODE OF ORDINANCES REGARDING DEPARTMENTS AND OFFICES AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE IV, DEPARTMENTS AND OFFICES, DIVISION I, GENERALLY, SECTION 2-65, ADDING (#10) EMERGENCY COMMUNICATIONS OF THE CODE OF ORDINANCES OF THE CITY OF HENDERSON MOTION by Commissioner Royster, seconded by Commissioner Staton, that the ordinance be adopted. WILLIAM L. “BUZZY” NEWMAN, JR. indicated that the current budget created the new 9-1-1 Emergency Director position, however the position is shown as reporting to the Police Chief. This will create a new department with the director reporting directly to the City Manager. The vote was called. On roll call, the vote stood: Commissioner Royster -- Aye: Commissioner Staton ---- Aye: Commissioner Vowels --- Aye: Commissioner Bugg ----- Aye: Mayor Austin ------------- Aye: WHEREUPON, Mayor Austin declared the ordinance adopted on its first reading and ordered that it be presented for a second reading at a meeting of the Board of Commissioners. ________________________ 172 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on November 19, 2019 ORDINANCE NO. 33-19: FIRST READ ORDINANCE AMENDING EMPLOYEE MANUAL ORDINANCE AMENDING ARTICLE 10-PERSONNEL, OF THE CITY OF HENDERSON EMPLOYEE MANUAL BY ADDING NON-CIVIL SERVICE POSITION EMERGENCY COMMUNICATIONS DIRECTOR MOTION by Commissioner Vowels, seconded by Commissioner Royster, that the ordinance be adopted. CONNIE GALLOWAY, Human Resources Director, reported that it is necessary to amend the Employee Manual to add the new Emergency Communications Director position which will be a contractual non-civil service position. The vote was called. On roll call, the vote stood: Commissioner Royster -- Aye: Commissioner Staton ---- Aye: Commissioner Vowels --- Aye: Commissioner Bugg ----- Aye: Mayor Austin ------------- Aye: WHEREUPON, Mayor Austin declared the ordinance adopted on its first reading and ordered that it be presented for a second reading at a meeting of the Board of Commissioners. ________________________ MEETING ADJOURN: MOTION by Commissioner Staton, seconded by Commissioner Royster, to adjourn the meeting.
