"Buzzy" Newman, Jr., City Manager SUBJECT: Amending Budgeted Positions and Pay Plan Relating to Hazardous Duty Pay - Rehire Retired Police Officers Final reading of two ordinances will be heard at a special called meeting on December 13, 2019. One will be to amend the budgeted positions for HPD allowing the rehiring of retired police officers into the authorized police officer positions and the other will be to amend the Hazardous Duty portion of the Pay Plan to set the rate of pay for rehired police officers. The proposed ordinances would allow the rehire of retired police officers under certain specifications detailed in KRS 95.022 and Kentucky Retirement System certification while allowing those officers to continue their retirement benefits under the Kentucky Retirement System. As detailed in the attached Police Department Memorandum 19-35 from Police Chief Heath Cox, the City has received permission from the retirement system to fill the equivalent of up to 15 police officer positions in full-time or part-time capacity with retired police officers. Under KRS 95.022 the City would not be required to contribute retirement employer contributions or insurance contributions normally due on retired Kentucky Retirement System CERS members or provide health insurance coverage through the City. It is proposed that these officers be hired on a contractual one-year basis at the equivalent rate of pay of a 20-year patrol officer. Officers hired under this provision would be within the current budget and within the unchanged number of authorized police officer positions. WHEREAS, the City would be exempt from paying employer CERS contributions and insurance contributions normally due on retired Kentucky Retirement System members, provided the retired officers meet the criteria of Kentucky statue. "Buzzy" Newman, Jr., City Manager SUBJECT: Amend Chapter 14 Garbage and Refuse - Proposed Schedule of Garbage and Refuse Fees An item for the agenda of the Friday, December 13, 2019 special called meeting is final reading of an ordinance amending Chapter 14, Garbage and Refuse, Sections 14-88 Nonresidential rates; 14-90 Residential rates; and 14-91 Special charges of Article V, Rates and Charges, of the City's Code of Ordinances. This item is in conjunction with the proposed municipal orders establishing the rate schedules for the City Transfer Station Solid Waste Disposal fees and the Residual/Construction Demolition and Debris Landfill under separate cover. The proposed ordinance would increase the nonresidential or commercial 2-yard dumpster collection and disposal rate from the current $35.00 per month rate for a once- weekly dumpster pick-up and $30.00 for each additional weekly pick-up to $40.00 per month for a once-weekly pick-up and $35.00 for each additional weekly pick-up; would increase the residential rate for collection and disposal of garbage and/or household refuse from $17.00 to $19.50 per month, which includes a $1.00 per month earmark for recycling services; and would increase the current $20.00 rate for special charges for pick-up of any one truckload of garbage, refuse and/or rubbish or other waste material, whether made by request of the owner or tenant of the premises or when the public health, safety and welfare of the city should demand, when the amount accumulated, deposited or stored for collection greatly exceeds the average amount usually deposited on the premises for regular collection to $30.00 per small truckload (pick-up truck or one ton dump truck) and to $60.00 per large truckload (single axle dump truck). The proposed rate increases align more closely with the actual costs associated with the collection and disposal of garbage and/or refuse and would take effect January 1, 2020. Your approval of the attached ordinance is requested. c: Robert Gunter Brian Williams Ray Nix  ORDINANCE NO. 36-19 ORDINANCE AMENDING SANITATION RATES: SUMMARY: AN ORDINANCE AMENDING CHAPTER 14, GARBAGE AND REFUSE, ARTICLE III TRANSFER STATION/RESIDUAL LANDFILL, SECTION 14-88, NONRESIDENTIAL RATES, SECTION 14-90 RESIDENTIAL RATES TO INCREASE THE MONTHLY RATE TO NINETEEN DOLLARS AND FIFTY CENTS ($19.50), AND SECTION 14-91 SPECIAL CHARGES TO INCREASE THE SPECIAL CHARGE TO THIRTY DOLLARS ($30.00) FOR A SMALL TRUCKLOAD AND SIXTY DOLLARS ($60.00) FOR A SINGLE AXLE DUMP TRUCK EFFECTIVE JANUARY 1, 2020 WHEREAS, the Sanitation Fund recorded a $147,548 loss in 2018 and a $11,630 loss in 2019;and WHEREAS, the Sanitation Fund has a negative fund balance of$246,776 as of June 30, 2019;and WHEREAS, in an effort to offset these losses, the current sanitation fees need to be increased; and WHEREAS, the City Manager recommends that these amendments be adopted. (a) Notwithstanding the levy of monthly charges prescribed in sections 14-88 and 14-90, there shall be a charge of [twenty dollars ($20.00)] thirty dollars ($30.00 per small truckload (pick up truck or one ton dump truck) and sixty dollars ($60.00) per large (single axle dump truck) on any nonresidential establishment, commercial building or housekeeping unit for any one (1) truckload of garbage, refuse and/or rubbish or other waste material, whether made by request of the owner or tenant of the premises effected or when the public health, safety and welfare of the city should demand, when the amount accumulated, deposited or stored for collection greatly exceeds the average amount usually deposited on the premises for regular collection. (b) Said charge in subsection (a) [of tvrenty dollars ($20.00) per truckload] shall be incorporated in the utility bill issued monthly by the city. All ordinances or parts of ordinances in conflict herewith are hereby repealed and superseded to the extent of such conflict. This ordinance of amendment shall become effective upon its legal adoption. On first reading of the foregoing ordinance, it was moved by Commissioner Royster seconded by Commissioner Vowels that the ordinance be adopted on its first reading.
