59 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on May 21, 2021 A special called meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Friday, May 21, 2021, at 2:30 p.m., prevailing time, in the third-floor assembly room, 222 First Street, Henderson, Kentucky. There were present Mayor Steve Austin presiding: PRESENT: Commissioner Rodney Thomas Commissioner Robert N. Pruitt Commissioner Bradley S. Staton ABSENT: Commissioner Austin P. Vowels ALSO PRESENT: Mr. Robert Gunter, Acting City Manager Mrs. Dawn Kelsey, City Attorney Ms. Maree Collins, City Clerk Mrs. Donna Stinnett, Community Relations Manager/Public Information Officer Mr. Kevin Patton, the Gleaner (via Zoom) ________________________ The purpose of this called meeting is for the following: MUNICIPAL ORDER NO. 26-21: MUNICIPAL ORDER APPROVING SALES AND PURCHASE CONTRACT BETWEEN NANCY AND JOHN ROBERTS, AND BETH ANN AND JEFF FRANCIS, AND CITY OF HENDERSON FOR THE PURCHASE OF TWO HUNDRED NINETY EIGHT ACRES OF REAL ESTATE, MORE OR LESS, FOR THE SUM OF $5,000,000.00 IN CASH AND $1,120,000.00 ROBERTS AND FRANCIS’S DONATION TO THE CITY; TO BE USED AS FUTURE INDUSTRIAL SITE AND APPROVAL OF THE CONSENT TO ANNEXATION OF THE PROPERTY; AND AUTHORIZING MAYOR TO EXECUTE CONTRACT ON BEHALF OF THE CITY CONDITIONED UPON THE HENDERSON WATER UTILITY BOARD’S APPROVAL OF THE EXPENDITURE OF ITS CASH RESERVES TO FUND THE PURCHASE MOTION by Commissioner Staton, seconded by Commissioner Thomas, approving the Sales and Purchase Contract between Nancy and John Roberts, and Beth Ann and Jeff Francis, and City of Henderson for the purchase of two hundred ninety-eight acres of real estate located on the Highway 425 Bypass, for the sum of $5,000,000.00 in cash and $1,120,000.00 Roberts and Francis’s donation to the City; to be used as future industrial site and approval of the consent to annexation of the property; and authorizing Mayor to execute contract on behalf of the City conditioned upon the Henderson Water Utility Board’s approval of the expenditure of its cash reserves to fund the purchase. DISCUSSION WAS HELD relating to what would happen if for some reason the company that we are purchasing this land for decided not to come to Henderson-this purchase is contingent upon that company coming to Henderson; and that the current owners have agreed to accept $5,000,000.00 in cash and donate the remaining $1,120,000.00 land value to the city. The vote was called.
