113 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on July 11, 2023 A special called meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Tuesday, July 11, 2023, at 1:30 p.m., prevailing time, in the third floor Assembly Room located in the Municipal Center Building at 222 First Street, Henderson, Kentucky. There were present Mayor Bradley S. Staton presiding: PRESENT: Commissioner Robert N. Pruitt, Sr. Commissioner Austin P. Vowels Commissioner Rodney Thomas ABSENT: Commissioner Nicholas E. Whitt ALSO PRESENT: Mrs. Dawn Kelsey, City Attorney Ms. Maree Collins, City Clerk Mrs. Connie Galloway, Human Resources Director Ms. Lennett Fox, Court Reporter Mr. Briscoe Edwards, Police Officer ALSO IN ATTENDANCE: were Mr. Cameron Shelton, the Respondent in this disciplinary hearing who was represented by Mr. Preston Wade, and Police Chief Sean McKinney with counsel for the City, Mr. Charles Cole. ________________________ MAREE COLLINS, City Clerk, read the special called meeting notice indicating that the purpose of this called meeting is to conduct a hearing that may result in the discipline or removal of an employee pursuant to the provisions of KRS 61.810(1)(f). ________________________ MAYOR STATON announced that the proceeding is being taped and that the purpose of this called meeting is to hear and decide disciplinary charges of Police Chief Sean McKinney dated June 27, 2023 concerning Police Officer Cameron Shelton. ________________________ DAWN KELSEY, City Attorney, stated that pursuant to KRS 15.520(k) Officer Shelton had the option to request by writing three (3) days before the hearing to have the hearing open to the public. Officer Shelton did not request to have the hearing open to the public; therefore, this Police Disciplinary Hearing will be closed to the public upon a proper motion being passed. ________________________ EXECUTIVE SESSION: “Personnel – Hearing” MOTION by Commissioner Thomas, seconded by Commissioner Vowels, and pursuant to the provisions of KRS 61.810(1)(f) that the Board of Commissioners go into Executive Session for the purpose of conducting a hearing which might result in the discipline, or removal of an individual employee. The vote was called. On roll call, the vote stood. Commissioner Pruitt ------ Aye: Commissioner Vowels --- Aye: Commissioner Whitt ------ Absent: Commissioner Thomas --- Aye: Mayor Staton ----- Aye: WHEREUPON, Mayor Staton declared the Board adjourned into Executive Session and asked that any attendees and/or witnesses leave the hearing room. ________________________ 114 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Special Called Meeting on July 11, 2023 EXECUTIVE SESSION: “Personnel – Deliberation” MOTION by Commissioner Pruitt, seconded by Commissioner Vowels, and pursuant to the provisions of KRS 61.810(1)(f) that the Board of Commissioners go into Executive Session for the purpose of deliberations which might result in the discipline, or removal of an individual employee. The vote was called. On roll call, the vote stood. Commissioner Pruitt ------ Aye: Commissioner Vowels --- Aye: Commissioner Whitt ------ Absent: Commissioner Thomas --- Aye: Mayor Staton ----- Aye: WHEREUPON, Mayor Staton declared the Board adjourned for deliberations. ________________________ MEETING RECONVENED: MOTION by Commissioner Pruitt, seconded by Commissioner Thomas, the Board of Commissioners reconvened into regular session. The vote was called. On roll call, the vote stood. Commissioner Pruitt ------ Aye: Commissioner Vowels --- Aye: Commissioner Whitt ------ Absent: Commissioner Thomas --- Aye: Mayor Staton ----- Aye: WHEREUPON, Mayor Austin reconvened the Board into regular session. ________________________ RESOLUTION NO. 46-23: RESOLUTION ADOPTING FINDINGS OF FACT, CONCLUSIONS OF LAW AND JUDGMENT IN DISCIPLINARY CASE OF CITY OF HENDERSON, KENTUCKY VS. OFFICER CAMERON SHELTON RESULTING IN THE TERMINATION OF CAMERON SHELTON MOTION by Commissioner Vowels, seconded by Commissioner Pruitt, to adopt the resolution and attached Findings of Fact, Conclusions of Law and Judgment in the disciplinary case of the City of Henderson, Kentucky vs. Police Officer Cameron Shelton. The vote was called. On roll call, the vote stood: Commissioner Pruitt ------ Aye: Commissioner Vowels --- Aye: Commissioner Whitt ------ Absent: Commissioner Thomas --- Aye: Mayor Staton ----- Aye: WHEREUPON, Mayor Staton declared the resolution adopted, affixed his signature and the date thereto, and ordered that the same be recorded. /s/ Bradley S.
