Record of Minutes of A Special Called Meeting on November 14, 2023
A special called meeting of the Board of Commissioners of the City of Henderson,
Kentucky, was held on Tuesday, November 14, 2023, at 5:00 p.m., prevailing time, in the third
floor Assembly Room located in the Municipal Center Building at 222 First Street, Henderson,
Kentucky.
There were present Mayor Bradley S. Staton presiding:

MAREE COLLINS, City Clerk, read the special called meeting notice indicating that the
purpose of this called meeting is to conduct a public hearing relating to Rezoning #1152 with a
Graphic Development Plan – Submitted by the City of Henderson and Henderson Distilling
Company, LLC., for property located in the City of Henderson at 0 N. Water Street (PID#1-8-3-
4); 422 N. Water Street (PID #1-8-3-5);100 Fifth Street (PID #1-8-3-6), containing
approximately 2.16 acres. Applicants request a Zoning change/Map Amendment from
Riverfront-2 (RF-2) to Central Business District (CBD) with a graphic development plan to
construct a small distillery in downtown Henderson.

PUBLIC HEARING: “Rezoning #1152 with a Graphic Development Plan”
MAYOR STATON declared the Public Hearing to order at approximately 5:04 p.m.
ANDREW POWELL, Henderson Distilling Company, LLC, presented in favor of the
rezoning request along with the following persons:
Michael Ervin
Ben Johnston
Greg Gibson
Missy Vanderpool
Chuck Stinnett
Gray Hodge
Dick Beavin
Abby Dixon
Curt Hamilton
Chase Fulcher
Matt McCarroll
BILL LATTA, representing several area residents/business owners, presented concerns
relating to the rezoning and reported on subsequent meetings for resolution to those concerns.
The following persons spoke of their concerns:

Jule McClellan
WITH NO FURTHER COMMENTS OR QUESTIONS, Mayor Staton declared the
public hearing closed at approximately 6:10 p.m. .

MAYOR STATON requested a motion for either approval or denial of the rezoning.
MOTION by Commissioner Pruitt, seconded by Commissioner Thomas, to approve
Rezoning #1152 with a Graphic Development Plan conditioned upon the Findings of Fact to be
presented at a future Board of Commissioners meeting.
The vote was called. On roll call, the vote stood:

WHEREUPON, Mayor Staton declared the motion passed and ordered that Findings of
Fact and appropriate ordinance be presented at a future meeting of the Board of Commissioners

meeting.
