41 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Regular Meeting on March 12, 2024 A meeting of the Board of Commissioners of the City of Henderson, Kentucky, was held on Tuesday, March 12, 2024, at 3:00 p.m., prevailing time, in the third floor Assembly Room of the Municipal Center, 222 First Street, Henderson, Kentucky, designated as the primary location for this video teleconference meeting allowed under KRS 61.826. SUSAN BRYANT, Finance Department Revenue Supervisor, expressed her appreciation for the opportunities afforded her at the City and expressed appreciation for her City family. ________________________ PRESENTATION: “SunLife Premium Refund” KAREN PRICE, HR Benefits Coordinator, reported that she had a copy of a check, which had already been deposited, representing a refund of premiums from a previous year, and introduced Benji Marrs, BIM Group Senior Vice President, to explain the premium refunding process. BENJI MARRS, BIM Group Senior Vice President, reported that the City had included in contracts with SunLife for stop loss coverage a ‘refund of premiums’ clause for years with less loss. SunLife recently completed an audit of their records and found an error in the City’s favor in the 2018 premium year of $29,934.20. ________________________ APPROVAL OF CONSENT AGENDA: MAYOR STATON asked the City Clerk to read the Consent Agenda. On roll call, the vote stood: Commissioner Vowels Aye: Commissioner Pruitt Aye: Commissioner Thomas Aye: Commissioner Whitt Aye: Mayor Staton -------------- Aye: WHEREUPON, Mayor Staton declared the ordinance adopted on its first reading and ordered that it be presented for a second reading at a meeting of the Board of Commissioners. ________________________ RESOLUTION NO. 10-24: A RESOLUTION OF THE CITY OF HENDERSON ACCEPTING GRANT FUNDS FROM THE DEPARTMENT FOR LOCAL GOVERNMENT UNDER LAND & WATER CONSERVATION FUND IN THE AMOUNT OF $245,000.00; AND THE MAYOR IS AUTHORIZED TO EXECUTE ALL NECESSARY DOCUMENTS MOTION by Commissioner Vowels, seconded by Commissioner Thomas, to approve the acceptance of Land and Water Conservation Fund grant funds in the amount of $245,000.00 for upgrades which include a splash pad for the Rev. Anthony Brooks Park. MAYOR STATON read the following into the record: “Our family is grateful for the efforts of the officials and citizens of Henderson upgrading the Anthony Brooks Park,” shared Rev. Adrian Brooks Sr. “It will ensure that this fitting memorial and recreational area continues to honor this civil rights activist, educator, and community pastor. It makes us all proud to watch Henderson embrace his legacy of service.” Rev. Adrian M. Brooks, Sr. COMMISSIONER VOWELS indicated that it is awesome to get a quarter million dollars toward this project. It isn’t something that happens everyday to a town our size. The vote was called. Staton, Mayor ATTEST: March 12, 2024 Maree Collins, CKMC, City Clerk ________________________ 45 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Regular Meeting on March 12, 2024 CITY MANAGER’S REPORT: BRIAN WILLIAMS, Public Works Director and DAVID STEELE, Sanitation Superintendent, gave an update on the new sanitation collection policy utilizing the new trash cans. Mr. Williams expressed appreciation for the great job that David has done with the transition to this new policy for the trash cans. He took a lot of abuse from the citizens and did a great job calming them down and explaining details so that everyone knew how the system would work. Mr. Steele reported that 10,497 new cans have been distributed with 750 or 7.7% being second or more per household; and an additional 35 smaller 35-gallon cans have also been distributed. Currently we are utilizing one fully automated truck that doesn’t have a packing feature so it is safer, cleaner, and leaves less mess on the streets. Mr. Steele indicated that overall safety has increased with zero reportable accidents since implementation in July 2023. ________________________ WILLIAM L. “BUZZY” NEWMAN, JR., City Manager, reported that there would be a short called meeting scheduled for 2:45 p.m., just before the regular work session next Tuesday, March 19, 2024. The work session topics include the indoor facility at the new Sports Complex and design of a covered multiuse facility at Newman Park. ________________________ CITY ATTORNEY’S REPORT: “Annexation Request” DAWN KELSEY, City Attorney, reported that while finalizing the annexation plat for the property that the City purchased on Old Corydon Road, it was determined that the property is listed under two PVA parcel numbers. At this time, staff is requesting authority to forward the second parcel to the Planning Commission to conduct a public hearing for designation of an appropriate zoning district in order to finalize the annexation of this City owned property. MOTION by Commissioner Thomas, seconded by Commissioner Vowels to forward the request to the Planning Commission to conduct a public hearing and make recommendation on the appropriate zoning designation for this City owned property. The vote was called. On roll call, the vote stood: Commissioner Vowels Aye: Commissioner Pruitt Aye: Commissioner Thomas Aye: Commissioner Whitt Aye: Mayor Staton -------------- Aye: ________________________ COMMISSIONER’S REPORTS: COMMISSIONER THOMAS wished County High students Good Luck! ________________________ COMMISSIONER WHITT indicated that he and COMMISSIONER PRUITT have heard several presentations and that it has been refreshing to hear new ideas and programs relating to the homelessness issue and after school programs for youth engagement. ________________________ 46 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Regular Meeting on March 12, 2024 EXECUTIVE SESSION: “Real Property and Personnel” MOTION by Commissioner Thomas, seconded by Commissioner Vowels, that the Board of Commissioners go into Executive Session pursuant to KRS 61.810(1)(b) for discussion that may lead to future sale of real property in the vicinity of U.S. Highway 60 W and Borax Drive; discussion that may lead to a future sale of real property in the vicinity of Fifth Street and Bob Posey Street; and for discussion that may lead to a future sale of real property in the vicinity of Old Corydon Road and Highway 425; and pursuant to KRS 61.810(1)(f) for discussion that might lead to the appointment of an individual employee.
