I. CALL TO ORDER
Mayor Hafen called the Committee Meeting to order at 6:54 p.m., in the City
Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015.
II. CONFIRMATION OF POSTING AND ROLL CALL
The City Clerk confirmed the Committee Meeting had been noticed in
compliance with the Open Meeting Law by posting the Agenda three working
days prior to the meeting at City Hall, the Multigenerational Center, the Whitney
Ranch Recreation Center, and Fire Station No. 86, and by mailing a copy of the
Agenda to everyone appearing thereon on the Agenda Master Mailing List.

III. ACCEPTANCE OF AGENDA
(Motion)
Mayor Andy Hafen moved to accept the agenda as presented.
The roll call vote favoring passage was: Those voting aye: Sam Bateman,
Andy Hafen, Debra March, John F. Marz, and Gerri Schroder. Those voting
nay: None. Those absent: None. Those abstaining: None. Mayor Hafen
declared the motion carried.

Mayor Hafen introduced Bill No. 2680 and City Manager Snow read the Bill by
title:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON,
NEVADA, AMENDING ORDINANCE NO. 2869, THE ZONING MAP, TO
RECLASSIFY CERTAIN REAL PROPERTY WITHIN THE CITY LIMITS OF
THE CITY, DESCRIBED AS A PORTION OF SECTION 36, TOWNSHIP 22
SOUTH, RANGE 61 EAST, M.D. & M., CLARK COUNTY, NEVADA,
GENERALLY LOCATED ON THE SOUTHWEST CORNER OF SUNRIDGE
HEIGHTS PARKWAY AND PECOS RIDGE PARKWAY FROM CC
(COMMUNITY COMMERCIAL) TO RS-8-PUD (LOW-DENSITY RESIDENTIAL
WITH PLANNED UNIT DEVELOPMENT OVERLAY), AND OTHER MATTERS
RELATING THERETO.
Tracy Foutz, Assistant Director of Planning and Neighborhood Services, stated
that this bill is a follow-up item to the approval from the last City Council
meeting.
(Motion)
Councilman Sam Bateman moved to refer Bill No. 2680 to the Regular Meeting
with a do-pass recommendation.
The roll call vote favoring passage was: Those voting aye: Sam Bateman,
Andy Hafen, Debra March, John F. Marz, and Gerri Schroder. Those voting
nay: None. Those absent: None. Those abstaining: None. Mayor Hafen
declared the motion carried.

Mayor Hafen introduced Bill No. 2681 and City Manager Snow read the Bill by
title:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON,
NEVADA, AMENDING ORDINANCE NO. 2869, THE ZONING MAP, TO
RECLASSIFY CERTAIN REAL PROPERTY WITHIN THE CITY LIMITS OF

UNION VILLAGE
APPLICANT: COMMUNITY DEVELOPMENT AND UNION VILLAGE, LLC
Mayor Hafen introduced Bill No. 2682 and City Manager Snow read the Bill by
title:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON,
NEVADA, ADOPTING A DEVELOPMENT AGREEMENT BETWEEN THE CITY
OF HENDERSON AND UNION VILLAGE, LLC, A NEVADA LIMITED LIABILITY
COMPANY FOR THE DEVELOPMENT OF LAND AND PROVIDING OTHER
MATTERS PROPERLY RELATING THERETO.

Tracy Foutz, Assistant Director of Planning and Neighborhood Services,
presented a summary of this item and noted that the Council is receiving a list of
exhibits that should be included as part of the backup. He noted that these
exhibits were included for the public hearing on September 4, 2012.
Mayor Hafen disclosed that his son-in-law is a brother of one of the financial
investors in this project.
Darren Enns, 2561 New Morning Avenue, representing the Southern Nevada
Building and Construction Trades Council (SNBCTC), explained that
representatives from Union Village approached them about a partnership.
Following negotiations, a project labor agreement was drafted regarding how
this project would provide jobs for union members, and that union members
would use the medical facilities for health care assistance. Mr. Enns distributed
and reviewed a handout entitled Article 7 Cooperation agreement. Mr. Enns
expressed concern that although Union Village representatives signed this
agreement, they accepted financing from Dignity Healthcare to build the first
phase of the project, which does not guarantee using union laborers.
Responding to a question by Mayor Hafen regarding whether the use of Tax
Increment Financing (TIF) monies will ensure prevailing wages are applied to
workers, Josh Reid, City Attorney, said he is not aware of a requirement
regarding TIF funds and prevailing wages, but he will check.
John Marchiano, 218 Lead Street, representing Union Village, stated that the
applicant intends to provide as many union jobs as they can on what they
control for this project. He noted that this project will provide thousands of jobs
and will be a remarkable medical complex. He said the deal with Dignity
Healthcare was effectuated for the good of the project.
Councilman Bateman stated that this item is an ordinance for the development
agreement and does not include labor issues. He agreed that the applicant
should use as much union and local labor as possible to develop the project.
Mr. Marchiano commented that the applicant intends to continue discussions
with the union.
Councilman Marz said this labor issue should be discussed between the
developer, the contractors, and the unions.
Councilwoman March said the most important role of the Council is to stimulate
investment in the community, and create jobs and opportunities. She hopes the
developer would seek to hire as many union members as possible to construct
this project.

In response to a question by Councilwoman Schroder regarding the status of
the labor agreement, Mr. Marchiano clarified that Dignity Healthcare has
insisted on purchasing the land and building the hospital. He said the applicant
still intends to commence with ongoing discussions with the union.

Councilman John F. Marz moved to refer Bill No. 2682 to the Regular Meeting
with a do-pass recommendation.

V. PUBLIC COMMENT
There were no public comments presented.
VI. ADJOURNMENT
There being no further business to come before the Council, Mayor Hafen, in
concurrence with the Council, adjourned the Committee Meeting at 7:18 p.m.
