CITY OF HENDERSON CITY COUNCIL MINUTES COMMITTEE MEETING November 3, 2015 I. CALL TO ORDER Mayor Pro Tem Schroder called the Committee Meeting to order at 5:45 p.m., in the City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015. II. CONFIRMATION OF POSTING AND ROLL CALL The City Clerk confirmed the Committee Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing List. Present: Gerri Schroder, Mayor Pro Tem Sam Bateman, Councilman John F. ACCEPTANCE OF AGENDA (Motion) Councilman Sam Bateman moved to accept the agenda as presented. The roll call vote favoring passage was: Those voting aye: Sam Bateman, John F. Marz, and Gerri Schroder. Those voting nay: None. Those absent: Andy Hafen and Debra March. Those abstaining: None. Mayor Pro Tem Schroder declared the motion carried. IV. ITEMS OF BUSINESS C-1 BILL NO. 3029 AMEND HENDERSON MUNICIPAL CODE CHAPTER 4.102 VIDEO RENTAL STORES BUSINESS OPERATIONS DIVISION, CITY ATTORNEY'S OFFICE Robert Murnane, City Manager, introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND CHAPTER 4.102 – VIDEO RENTAL STORES – OF THE HENDERSON MUNICIPAL CODE AND MATTERS PROPERLY RELATED THERETO. Lana Hammond, Business License Administrative Specialist, reviewed proposed changes to the Bill. (Motion) Councilman Sam Bateman moved to refer Bill No. 3029 to the Regular Meeting with a do-pass recommendation. The roll call vote favoring passage was: Those voting aye: Sam Bateman, John F. Marz, and Gerri Schroder. Those voting nay: None. Those absent: Andy Hafen and Debra March. Those abstaining: None. Mayor Pro Tem Schroder declared the motion carried. Henderson City Council Committee Meeting Page 3 of 5 November 3, 2015 – Minutes C-2 BILL NO. 3030 REPEAL HENDERSON MUNICIPAL CODE CHAPTER 4.115 MEDICAL MARIJUANA FEES BUSINESS OPERATIONS DIVISION, CITY ATTORNEY'S OFFICE Robert Murnane, City Manager, introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO REPEAL CHAPTER 4.115 – MEDICAL MARIJUANA FEES – OF THE HENDERSON MUNICIPAL CODE AND MATTERS PROPERLY RELATED THERETO. Mike Cathcart, Business Operations Manager, stated this chapter is being deleted because all of the fees have been moved to Chapter 4.05. (Motion) Councilman John F. Marz moved to refer Bill No. 3030 to the Regular Meeting with a do-pass recommendation. The roll call vote favoring passage was: Those voting aye: Sam Bateman, John F. Marz, and Gerri Schroder. Those voting nay: None. Those absent: Andy Hafen and Debra March. Those abstaining: None. Mayor Pro Tem Schroder declared the motion carried. C-3 BILL NO. 3031 AMEND HENDERSON MUNICIPAL CODE CHAPTER 4.116 MEDICAL MARIJUANA-REGULATIONS AND LICENSES BUSINESS OPERATIONS DIVISION, CITY ATTORNEY'S OFFICE Robert Murnane, City Manager, introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND CHAPTER 4.116 – MEDICAL MARIJUANA- REGULATIONS AND LICENSES – OF THE HENDERSON MUNICIPAL CODE AND MATTERS PROPERLY RELATED THERETO. Mike Cathcart, Business Operations Manager, explained that the largest change is to allow licensed dispensaries within the city to deliver medical marijuana products to the card holder or their primary care giver at their residence. He noted that third-party delivery services are prohibited. Henderson City Council Committee Meeting Page 4 of 5 November 3, 2015 – Minutes Responding to a question regarding security procedures, Mr. Cathcart said security procedures are not currently in place; however, staff has asked for security policies and procedures to be in place. He stated that staff will request to see the security policies and procedures when Title 4 inspections are conducted. Councilman Bateman commented that it appears all jurisdictions are going to allow some level of marijuana product deliveries. In response to a question regarding pre-determined guidelines for deliveries, Mr. Cathcart explained that deliveries will only be made to the residence of the cardholder. The cardholder or the primary caregiver must accept the delivery. Mr. Cathcart said the best practice in the industry requires two people be in the delivery vehicle, one security person and one delivery person. He noted that staff did not mandate this practice. Councilman Marz stated that he would like to mandate two people be in the delivery vehicle for security purposes. Josh Reid, City Attorney, suggested that this amendment would be made under Section 4.16.200(A) and it should read: A. All deliveries must be conducted by two employees of the medical marijuana dispensary licensee. (Motion) Councilman John F. Marz moved to refer Bill No. 3031 to the Regular Meeting with a do-pass recommendation as amended. The roll call vote favoring passage was: Those voting aye: Sam Bateman, John F. Marz, and Gerri Schroder. Those voting nay: None. Those absent: Andy Hafen and Debra March. Those abstaining: None. Mayor Pro Tem Schroder declared the motion carried. V. PUBLIC COMMENT Mayor Pro Tem Schroder announced that this meeting is being video recorded and streamed live to the Web.
