CITY OF HENDERSON CITY COUNCIL MINUTES COMMITTEE MEETING December 1, 2015 I. CALL TO ORDER Mayor Hafen called the Committee Meeting to order at 5:47 p.m., in the City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015. II. CONFIRMATION OF POSTING AND ROLL CALL The City Clerk confirmed the Committee Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing List. Present: Andy Hafen, Mayor Gerri Schroder, Councilwoman Sam Bateman, Councilman John F. Marz, Councilman Debra March, Councilwoman Absent: None Officers: Robert Murnane, City Manager Josh Reid, City Attorney Sabrina Mercadante, City Clerk Absent: None Staff: Richard Derrick, Chief Financial Officer Robert Herr, Director of Public Works, Parks & Recreation Stephanie Garcia-Vause, Community Dev. and Services Director Tedie Jackson, Council and Commission Services Reporter Amber Ellis, Deputy City Clerk Mayor Hafen announced that this meeting is being video recorded and streamed live to the Web. ACCEPTANCE OF AGENDA Councilwoman Debra March moved to accept the agenda as amended: C-3 was noted to have had changes to the proposed bill, specifically to Henderson Municipal Code section 4.36.040(E) to make the provisions for Craft distillery-combo establishments consistent with the proposed changes to Craft distilleries, which were outlined in a memorandum that was part of the backup to the item. The roll call vote favoring passage was: Those voting aye: Sam Bateman, Andy Hafen, Debra March, John F. Marz, and Gerri Schroder. Those voting nay: None. Those absent: None. Those abstaining: None. Mayor Hafen declared the motion carried. IV. ITEMS OF BUSINESS C-1 BILL NO. 3036 ZCA-15-500346 ALPER PARCEL APPLICANT: COMMUNITY DEVELOPMENT AND SERVICES AND LENNAR HOMES City Manager Murnane introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, AMENDING ORDINANCE NO. 2869, THE ZONING MAP, TO RECLASSIFY CERTAIN REAL PROPERTY WITHIN THE CITY LIMITS OF THE CITY, DESCRIBED AS A PORTION OF SECTION 35, TOWNSHIP 22 SOUTH, RANGE 61 EAST, M.D.B. & M., CLARK COUNTY, NEVADA, GENERALLY LOCATED SOUTHEAST OF THE INTERSECTION OF ALPER CENTER DRIVE AND ST. ROSE PARKWAY, IN THE WESTGATE PLANNING AREA, FROM IG (GENERAL INDUSTRIAL) ON 22.4 ACRES AND PS-MP (PUBLIC/SEMIPUBLIC WITH MASTER PLAN OVERLAY) ON .1 ACRE TO RM-10 (MEDIUM-DENSITY RESIDENTIAL) ON 22.5 ACRES, AND MATTERS PROPERLY RELATING THERETO. C-2 BILL NO. 3038 ZCA-13-500283 (A2 & A3) MONTELAGO 17 COMMUNITY DEVELOPMENT AND SERVICES City Manager Murnane introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, AMENDING ORDINANCE NO. 2870, THE ZONING MAP, TO RECLASSIFY CERTAIN REAL PROPERTY WITHIN THE CITY LIMITS, DESCRIBED AS A PORTION OF SECTION 22, TOWNSHIP 21 SOUTH, RANGE 63 EAST, M.D. & M., CLARK COUNTY, NEVADA, GENERALLY LOCATED ON THE SOUTH SIDE OF MONTELAGO BOULEVARD, EAST OF ITS INTERSECTION WITH AVENIDA SORRENTO, ON 17.8 ACRES IN THE LAKE LAS VEGAS PLANNING AREA FROM CT-G-MP (TOURIST COMMERCIAL WITH GAMING ENTERPRISE AND MASTER PLAN OVERLAYS) ON 17.3 ACRES AND PS-G-MP (PUBLIC / SEMIPUBLIC WITH GAMING ENTERPRISE AND MASTER PLAN OVERLAYS) ON 0.5 ACRES TO RS-6-MP (LOW-DENSITY RESIDENTIAL WITH MASTER PLAN OVERLAY) 17.8 ACRES; AND MATTERS PROPERLY RELATED THERETO. Henderson City Council Committee Meeting Page 4 of 6 December 1, 2015 – Minutes C-3 BILL NO. 3039 AMEND HENDERSON MUNICIPAL CODE CHAPTER 4.36 LIQUOR-REGULATIONS AND LICENSES BUSINESS OPERATIONS DIVISION, CITY ATTORNEY'S OFFICE City Manager Murnane introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND CHAPTER 4.36 – LIQUOR-REGULATIONS AND LICENSES – OF THE HENDERSON MUNICIPAL CODE AND MATTERS PROPERLY RELATED THERETO. Lana Hammond, Business License Administrative Specialist, presented a summary of this item and reviewed proposed amendments to the ordinance. Councilwoman March asked what kind of business impact outreach staff conducted regarding these changes. Ms. Hammond replied that staff provided information to the retail association and various businesses that would be impacted by the changes. Responding to a question by Councilman Bateman as to the most significant changes that may impact an existing business, Ms. Hammond explained that these changes are being made in response to input from the business industry. Councilman Marz commented that the Redevelopment division wants to provide outside seating to attract new restaurants and allow for expansion possibilities. He asked how the businesses in the redevelopment area will be impacted regarding insurance or bonding requirements. He expressed concern about the restrictions being onerous for the establishments to comply with the ordinance. Councilwoman March noted that staff could explore and evaluate this requirement issue and revisit if necessary. Erin Flynn, Assistant City Attorney II, reported that staff did not conduct an independent analysis of insurance requirements. She said staff asked that the City would be named as an additional insured on existing CGL policies. She noted that staff also asked for an indemnification in the event there was legal action and for a bond. Ms. Flynn stated that staff does not believe these requirements will be overly burdensome to the businesses. The businesses will determine whether the cost benefit is in their favor. In response to a question by Councilwoman Schroder, Ms. Hammond reviewed circumstances when the ten-day requirement for special event permits may be waived. C-4 BILL NO. 3040 AMEND HENDERSON MUNICIPAL CODE TITLE 19 ZOA-15-500436 – MEDICAL MARIJUANA ESTABLISHMENTS - UPDATE COMMUNITY DEVELOPMENT AND SERVICES City Manager Murnane introduced and read this Bill by title: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND TITLE 19 OF THE HENDERSON MUNICIPAL CODE BY AMENDING PORTIONS OF CHAPTERS 19.5 AND 19.6 TO MAKE VARIOUS CORRECTIONS, REVISIONS AND UPDATES AS NECESSARY, AND MATTERS PROPERLY RELATED THERETO. Stephanie Garcia-Vause, Community Development and Services Director, presented a summary of this item. (Motion) Councilwoman Gerri Schroder moved to refer Bill No. 3040 to the Regular Meeting with a do-pass recommendation.
