CALL TO ORDER Mayor March called the Committee Meeting to order at 5:46 p.m., in the City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015. Mayor March announced the meeting is being video recorded and streamed live over the Internet. II. CONFIRMATION OF POSTING AND ROLL CALL The City Clerk confirmed the Committee Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing and emailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing and Emailing List. C-6 BILL NO. 3376 AMENDMENT TO HENDERSON MUNICIPAL CODE CHAPTER 8.02 CITY ATTORNEY'S OFFICE City Manager/CEO Derrick introduced and read this bill by title. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, TO AMEND HENDERSON MUNICIPAL CODE CHAPTER 8.02 – VIOLATION OF STATE LAW, OF TITLE 8 - PUBLIC PEACE AND SAFETY. Nicholas Vaskov, City Attorney, briefed the City Council on the Nevada Supreme Court’s ruling on the case of Anderson versus the City of Las Vegas that will require jury trials for those charged with misdemeanor Domestic Battery. Mr. Vaskov stated that the Nevada Supreme Court’s ruling leaves the City with the following options to be in compliance: 1. The City of Henderson can charge all Domestic Battery cases as Simple Battery cases; 2. Refer all Domestic Violence cases to the District Attorney to for prosecution in District Court or Justice Court; or 3. Enact a City Ordinance that makes Domestic Battery a crime under the Henderson Municipal Code. Mr. Vaskov stated he does not believe the City should choose Option 1 because Domestic Battery is a distinct crime from Simple Battery and believes it should be recognized and charged as such. Mr. Vaskov said Option 2 would burden an already overtaxed County court system; therefore, he does not believe that Option 2 would be the appropriate solution. Henderson City Council Committee Meeting Page 7 of 8 Tuesday, October 15, 2019 – Minutes Mr. Vaskov explained Option 3 is the best solution currently available to the City as it allows the City to better protect victims and monitor those convicted of Domestic Battery. He stated this approach is consistent with the strategies the City of Las Vegas and the City of North Las Vegas are taking, and is also supported by the Henderson Municipal Court judges. Mr. Vaskov clarified he believes this a short-term solution and the City plans on building the infrastructure needed to conduct jury trials for the long-term. Mayor March opened a public hearing, asking if there was anyone present wishing to speak for or against this item. Julie Proctor, 89011, Executive Director of Safe House, stated that she supports what the City is attempting to do; however, she expressed concerns regarding offenders being able to keep their guns. She stated she believes this is a short-term solution and that something needs to be done at the legislative level. There being no one else wishing to speak, the public hearing was closed. Mayor March concurred with Ms. Proctor and stated she believes this is a matter the City needs to plan, budget, and collaborate with the legislature on to develop a more long-term solution. Responding to Mayor March’s statement, Mr. Vaskov said the City management team has already begun conversations regarding the necessary infrastructure needed for the City to be able to conduct jury trials. Councilman Stewart expressed dissatisfaction with the limited options available to the City; however, he commended staff for developing a short-term solution. (Motion) Councilman Dan H.
