CITY OF HENDERSON CITY COUNCIL MINUTES COMMITTEE MEETING Tuesday, December 3, 2019 I. CALL TO ORDER Mayor March called the Committee Meeting to order at 5:48 p.m., in the City Council Chambers, City Hall, 240 Water Street, Henderson, Nevada 89015. Mayor March announced the meeting is being video recorded and streamed live over the Internet. II. CONFIRMATION OF POSTING AND ROLL CALL The City Clerk confirmed the Committee Meeting had been noticed in compliance with the Open Meeting Law by posting the Agenda three working days prior to the meeting at City Hall, the Multigenerational Center, the Whitney Ranch Recreation Center, Fire Station No. 86, the Nevada Public Notice Website, the City of Henderson Website, and by mailing and emailing a copy of the Agenda to everyone appearing thereon on the Agenda Master Mailing and Emailing List. Mayor March declared the motion carried. C-2 BILL NO. 3386 DEV-2019002329 MAJOR MODIFICATION TO UNION VILLAGE DEVELOPMENT AGREEMENT APPLICANT: COMMUNITY DEVELOPMENT AND SERVICES AND UNION VILLAGE, LLC City Manager/CEO Derrick introduced and read this bill by title. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, ADOPTING A MAJOR MODIFICATION TO AMEND THE DEVELOPMENT STANDARDS AND MAKE OTHER MODIFICATIONS TO THAT CERTAIN SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT BETWEEN THE CITY OF HENDERSON, VALLEY HEALTH SYSTEM, LLC, AND UNION VILLAGE, LLC, FOR THE DEVELOPMENT OF APPROXIMATELY 155 ACRES GENERALLY LOCATED NORTHWEST OF GIBSON ROAD AND GALLERIA DRIVE IN THE EASTSIDE REDEVELOPMENT AREA AND MIDWAY PLANNING AREA. Michael Tassi, Community Development and Services Director, presented a summary of this item and noted the amendments that were added at the November 19, 2019, Regular Meeting are included in this bill. Councilwoman Romero made the following disclosure statement: “This item is a request from Union Village, LLC for a major modification to a development agreement. In my private capacity, I provide consulting services to Union Village. My consulting work for Union Village is a conflict of interest that could be perceived by a reasonable person, to affect the independence of my judgment on this matter. Accordingly, I will abstain from deliberating and voting on this matter.” Henderson City Council Committee Meeting Page 4 of 7 Tuesday, December 3, 2019 – Minutes (Motion) Councilman John F. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, AMENDING ORDINANCE NO. 2870, THE ZONING MAP, TO RECLASSIFY CERTAIN REAL PROPERTY WITHIN THE CITY LIMITS OF THE CITY, DESCRIBED AS A PORTION OF SECTION 9, TOWNSHIP 22 SOUTH, RANGE 61 EAST, M.D.B. & M., CLARK COUNTY, NEVADA, LOCATED ON THE EAST SIDE OF GILESPIE STREET BETWEEN VOLUNTEER BOULEVARD AND EAST LARSON LANE, IN THE WEST HENDERSON PLANNING AREA, APPLYING CITY OF HENDERSON PS (PUBLIC/SEMIPUBLIC) ZONING DESIGNATION TO 5.0 ACRES OF PROPERTY WITH NO ESTABLISHED ZONING. Mayor March made the following disclosure statement: “This item relates to property that the City has agreed to sell to NV Energy for use as an electrical substation. I need to disclose that the church that I attend owns the property adjacent to this site. NV Energy’s use of the site as an electrical substation could impact the ability of the church to develop its property. My interests as a member of the church could be perceived to affect the independence of my judgment on this matter. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HENDERSON, NEVADA, APPROVING AND ADOPTING THAT CERTAIN DEVELOPMENT AGREEMENT BETWEEN THE CITY OF HENDERSON AND SOUTH 15 AMIGO DEV 3, LLC, FOR THE DEVELOPMENT 9.66 ACRES, LOCATED SOUTHEAST OF BOWES AVENUE AND CHAPARRAL ROAD, IN THE WEST HENDERSON PLANNING AREA.
