CITY OF HENDERSON CITY COUNCIL MINUTES REGULAR MEETING Tuesday, November 16, 2021 I. CALL TO ORDER Mayor Debra March called the Regular Meeting to order at 4:02 p.m., in the City Council Chambers, City Hall, 240 South Water Street, Henderson, Nevada 89015. Mayor March announced due to the termination of the State of Nevada Executive Department Declaration of Emergency Directive 006 as of May 31, 2021, in-person attendance will be allowed consistent with CDC guidelines. However, in accordance with Declaration of Emergency Directive 047, individuals shall be required to cover their nose and mouth with a mask or face covering in a manner consistent with the guidance issued by the CDC, and any subsequent guidance issued by the CDC. She requested residents please check www.cdc.gov for additional information. To make it easier for residents to voice their comments, there will be two public comment periods. There will be one at the beginning of the meeting, designated for comments related to items on the agenda, and one at the end of the meeting, for general public comment. Mayor March said the meeting is being video recorded and streamed live to the Internet and on YouTube. II. INVOCATION AND PLEDGE OF ALLEGIANCE (Minutes/Discussion) The Invocation was given by Pastor Nikki McMullin with Central Church, and was followed by the Pledge of Allegiance. V. PUBLIC COMMENT (Minutes/Discussion) Donell Anthony, 89015, stated he wanted to speak on behalf of supporting the Assistance Breaking the Cycle (ABC) Program with the Henderson Municipal Court (HMC) and in support of the next HMC judge for Department 2 maintaining the program moving forward. He shared his story of graduating from the ABC Program and said he is appreciative of Jeremy Cooley’s work within the program. Brandon Pierce, 89015, shared his story of graduating from the ABC Program twice and said it was thanks to the ABC Program that he was able to turn his life around. He stated he does not want to sway the vote for who gets appointed as judge of HMC Department 2; however, he hopes the support and structure of the ABC Program remains in place for whoever is appointed. Robert Stargel, 89015, said he wanted to state his support for a candidate for the HMC Department 2 judge vacancy who is willing to continue the ABC Program and the support it provides the community. PROCLAMATIONS, COMMENDATIONS AND PRESENTATIONS 1 PRESENTATION MAYOR’S HONOR ROLL AWARD CHRISTIAN TORRES, FREDDY RODRIGUEZ, AND TARI SMITH CMTS NUMBER(S): N/A CITY MANAGER'S OFFICE Presentation of the Mayor's Honor Roll award to Christian Torres, kindergarten student at Twitchell Elementary School, Freddy Rodriguez, 11th grade student at Green Valley High School, and Tari Smith, 1st Grade teacher at Treem Elementary School, for their achievements, exemplary service, and outstanding contributions in education. (Minutes/Discussion) Richard Derrick, City Manager/CEO, stated the Mayor's Honor Roll recognizes Henderson students, teachers, administrators, and support professionals for special achievements, exemplary service, and outstanding contributions in education. He announced the first honorees of the 2021-2022 school year are: Christian Torres, kindergarten student at Twitchell Elementary School, Freddy Rodriguez, 11th grade student at Green Valley High School, and Tari Smith, First Grade teacher at Treem Elementary School. Mayor Debra March stated the Mayor’s Honor Roll is an important award for her and the Council because it allows them to acknowledge the individuals who are making a difference in our school system. She thanked the awardees for the example they set and their contributions to making Henderson a premier community. The Mayor and Council presented the three awardees a certificate and medal honoring their Mayor’s Honor Roll recognition, and joined them for a photograph at the dais. Henderson City Council Regular Meeting Page 4 of 32 Tuesday, November 16, 2021 – Draft Minutes 2 PROCLAMATION INTERNATIONAL FRAUD AWARENESS WEEK CMTS NUMBER(S): N/A INTERNAL AUDIT DEPARTMENT Proclamation declaring November 14-20, 2021, as International Fraud Awareness Week to promote anti-fraud education and awareness. (Minutes/Discussion) Richard Derrick, City Manager/CEO, said to promote anti-fraud education and awareness in order to minimize the impact of fraud, the Mayor and Council wish to proclaim the week of November 14, 2021, as International Fraud Awareness Week. Melissa Wright, City Auditor, presented a PowerPoint presentation titled, “Fraud, Waste, and Abuse,” discussing the effects of fraud on individuals and organizations and how the City and residents can work together to fight fraud. Mayor Debra March thanked Ms. Wright and her team for the work they do to keep the City safe, and presented them with a certificate proclaiming the week of November 14, 2021, as International Fraud Awareness Week in Henderson. The Mayor and Council joined Ms. Wright and employees of the City of Henderson Audit Division for a photograph at the dais. VIII. CITY MANAGER'S REPORT 3 CITY MANAGER'S REPORT CMTS NUMBER(S): N/A CITY MANAGER'S OFFICE The City Manager's Report cannot be acted upon or discussed at this meeting, but may be referred by Council to the next regular meeting for consideration. (Minutes/Discussion) Richard Derrick, City Manager/CEO, stated the City of Henderson honored the valor and sacrifices of U.S. Military Veterans during its annual Veterans Day Ceremony on Saturday, November 6, 2021, at the Water Street Plaza. He said the ceremony included remarks by Mayor Debra March, and the keynote speech was delivered by Colonel Jerry A. Brown of the U.S. Army Reserve’s 63rd Readiness Division. Mr. Derrick said Henderson is very proud to honor our veterans and thanked them for their service. Henderson City Council Regular Meeting Page 5 of 32 Tuesday, November 16, 2021 – Draft Minutes Mr. Derrick announced on November 15, 2021, the Henderson Fire Department (HFD) recognized and presented a ceremonial Henderson firefighter helmet to Joe Smith Jr. for his groundbreaking service as one of the City’s first African American firefighters starting as a firefighter with Basic Magnesium Industrial in 1966 and providing mutual aid to HFD. Mr. Derrick congratulated Mr. Smith and thanked him for his historic service in our community. Mr. Derrick recognized City of Henderson Utility Serviceperson, Jaime Rodriguez-Palacios, for demonstrating exemplary public service by returning a bag to Henderson residents Danielle and Paul Thompson after he witness the bag fall from the Thompson's vehicle during his shift. Mr. Derrick announced the retirements of Joshua Nilson, Henderson Police Officer, and Toni Barden, Judicial Assistant, and thanked them for their years of service to the City. IX. He stated the candidates will have two minutes to provide an opening statement and then they would be asked to answer the five questions they were provided ahead of time. Mr. Valdez said the Council may also ask the candidates any additional follow-up questions they may have. Ms. Albritton and Mr. Cooley each provided a brief opening statement and answered the following questions asked by the Council:  What characteristics or qualities do you possess that would make you a good judge?  If you were appointed to this position, describe how you would effectively and efficiently manage your courtroom and large criminal caseload?  Describe a case that you have handled which was particularly significant to you and describe why.  Describe your trial work and discuss why this would prepare you to fairly adjudicate cases in the Henderson Municipal Court.  Describe a time when you worked as part of a collaborative team or group and tell us what role you played. Responding to a follow-up question from Councilman Stewart regarding her familiarity with the Assistance Breaking the Cycle (ABC) Program, Ms. Albritton stated she has not had experience with the ABC Program for the Henderson Municipal Court; however, she has had experience with similar types of drug programs with the North Las Vegas Justice Court. Henderson City Council Regular Meeting Page 31 of 32 Tuesday, November 16, 2021 – Draft Minutes Responding to an inquiry from Councilman Stewart regarding Ms. Albritton’s mention of a young offender program, Ms. Albritton detailed the type of young offender program she would like to bring to the Henderson Municipal Court if she were appointed judge to stop youth from getting into the criminal justice system.
