CITY OF HENDERSON PLANNING COMMISSION REGULAR MEETING AGENDA Thursday, November 16, 2023 Council Chambers 4:00 PM 240 Water Street Meeting Inquiries: (702) 267-1500 Henderson, Nevada 89015 Notice to persons with special needs: For those requiring special assistance or accommodation to participate in this meeting, arrangements for a sign language interpreter should be made as soon as possible, but no later than 72 hours before the scheduled meeting. The Chair reserves the right to hear agenda items out of order, combine two or more agenda items for consideration, remove an item from the agenda, or delay discussion relating to an item on the agenda at any time. Public comment will be taken on each agenda item as it is heard. Public comment will be taken during the designated Public Comment period, on Consent Agenda items that have been pulled for discussion, and on Public Hearing items. Individuals will be limited to three (3) minutes and spokespersons for a group will be limited to ten (10) minutes at the discretion of the Chair. The Chair reserves the right to curtail abusive, offensive, inflammatory, or repetitive comments that disrupt, disturb, or otherwise impede the orderly conduct of the meeting. See NRS 241.030(4)(a). Examples of disruptive conduct include, without limitation, yelling, stamping of feet, whistles, applause, heckling, name calling, use of profanity, personal attacks, intimidation, threats, or any other comments intended to impede the meeting or infringe on the rights of the Henderson Planning Commission, City staff, or meeting participants. Planning Commission's recommendation on agenda items containing comprehensive plan amendments, zone changes, development agreements, master streets and highway amendments, and vacations are forwarded to City Council for review and decision unless Planning Commission acts otherwise. All other items will receive final action by the Planning Commission unless otherwise noted. Appeals of final decisions by Planning Commission must be submitted to the Director of Community Development within nine (9) calendar days of notice to the City Clerk. If the ninth day falls on a City-observed holiday or a City Hall non-business day, the appeal period is extended to the next regular City working day. RECOMMENDATION: Recommended approval; to be heard by City Council on December 5, 2023 A) Amend a zone change/planned unit development to add a Master Plan Overlay, rezoning from CC-PUD (Community Commercial with Planned Unit Development Overlay) and CN-PUD (Neighborhood Commercial with Planned Unit Development Overlay) to CC-PUD-MP (Community Commercial with Planned Unit Development and Master Plan Overlays) and CN-PUD-MP (Neighborhood Commercial with Planned Unit Development and Master Plan Overlays), allow several CC zoning uses in the CN zoning district, and request waivers from the Development Code to: (d) reduce the minimum size of a master plan overlay from 50 acres to 5.1 acres, (e) waive separation requirements for two taverns, restaurant with bar(s), and restaurant uses to a religious assembly, and (f) waive the 2000- foot minimum tavern-to-tavern separation between existing and proposed taverns; and B) Amend a zone change to delete conditions of approval that: 1) remove the restrictions to the drive through pad site limiting the drive through to a coffee shop only, 2) remove the condition restricting the uses to CN uses only, and 3) remove condition limiting the hours of operation of the drive- through use; on 5.1 acres located on Lake Mead Parkway southeast of Keokuck Street approximately 530 feet east of De Marco Drive, in the Calico Ridge Planning Area.
