4. PUBLIC HEARING (Youtube Link)
Request by HAB Properties LLC, to amend The Triangle Final Development Plan to add Retail
Goods Establishment, Restaurant, Carry Out, and Restaurant, Quick Service to the List of
Permitted Uses. The property is located at 593 New Shackle Island Road, on the west side of
New Shackle Island Road, and on the south side of Old Shackle Island Road, as identified by
Sumner County Tax Map 145 057.02.
The Public Hearing opened and closed at 6:41 PM as no one signed up to speak.
Request by Dean Jacobs to rezone 4.83 acres from Suburban Residential, Low Density (SR-1) to
General Commercial, Planned Development (GC-PD) and to make an amendment to the General
Framework Map of the Hendersonville Land Use and Transportation Plan to change the
character area designation of the property from Suburban Living to Suburban Center. This
property is located at 1065 Saundersville Road, on the north side of Vietnam Veterans Parkway,
and the west side of Saundersville Road, as identified on Sumner County Tax Map 146 004.02.

Elliott Electric is proposing construction of a new 15,000 square foot building for warehouse
/distribution uses. The building sits on 3.4 acres of split zoned General Commercial/Industrial off
Innovation Way. The building is to be constructed on the portion of the property in the Industrial
Zoning. The property to the east is zoned Industrial (ServPro). The vacant lot between this property
and New Shackle Island is zoned General Commercial. Additional screening has been required on the
west side in the event the adjacent property facing New Shackle Island does not develop quickly. To
the north (rear) is a multi-family residential planned development.

STAFF COMMENTS – PLANNING DEPARTMENT:
1. Buildings shall be oriented so that the main entrance faces the street on which is located and with a
hierarchy articulated with columns, pilaster, arches, or details such as special molding. Entryway
features such as porches, canopies or awnings can be used to help establish the hierarchy.
The added canopies are not significant enough to create a substantial front entryway. Work
with Planning staff to achieve an appropriate front façade appearance. Staff recommends the
use of an entry feature with a vaulted ceiling to meet this requirement: (see examples below):
2. Provide required zone change Type C landscape buffer for outside of draining area. Consider moving
to the western property boundary.
3. Address all previous landscape comments:
A. Update landscape plans to remove rip rap.
B. Include vegetative shrubbery on the areas with 2:1 slope.
C. Wrap building with foundation plantings on east elevation.
D. Provide screening on all sides where metal is used.
E. Instead of Fineline Holly, use trees that will be at least 20’ in height.

STAFF COMMENTS –PUBLIC WORKS:
1. Sheet C4.0
- Line 7-10 - What is the velocity of the stormwater leaving the headwall? Is outlet protection
needed to prevent erosion?
- Is there adequate separation from the invert elevation of the bioretention and the bedrock and
seasonally highway water table elevations? A minimum of 2’ of separation is required.
- There is extensive grading and proposed stormwater network shown within the "30' Stream
Buffer". Please address the following: 1. Is this area a stream as determined by an HD? 2. If
stream is present please provide a 15' minimum/ 30' average stream buffer measured from top
of bank free from disturbance and stormwater infrastructure. 3. If stormwater infrastructure still
must be installed within the stream buffer please provide an ARAP NOC for outfall/intake
structures. 4. Please note that all proposed grading not associated with the outlet structure
(ARAP NOC) will need to be removed from the stream buffer.
- Could a headwall be used at structure 9 to provide more capacity and be less concern for
clogging?
- Channel grading does not reflect a 3:1 side slope. Revise.
- Provide parallel curb ramp detail for ADA ramp
- Connect downspouts to underground storm pipe to eliminate water crossing sidewalk.
- Underground pipe along north side of building has 0% slope. Revise to prove at least 0.5%

- Show perforated pipe connecting outlet structure
- Show depth of the underdrain and how 12" of internal water storage will be provided in
accordance with the WQTV table and the Tennessee Permanent Stormwater Design Guidance
Manual.
- Positive drainage is not being provided for the 6" perforated pipe within the bioretention area.
The proposed 6" perforated pipe has an invert between 503.75' and 503.25', however, the
outlet of the bioretention area is at an elevation of 504'. Please specify the inlet elevation of the
underdrain and the slope of the underdrain.
- Provide a minimum 6" of freeboard between the top of bank and emergency spillway in
accordance with the Tennessee Permanent Stormwater Management and Design Guidance
Manual.

prevent erosion.
- Is the pond cut being used to bring any portion of the site to grade? Cut for the pond could be

be cut to get to invert elevation of bioretention area consider showing intermediate grading of a
sediment trap at the invert elevation of the bioretention area.
- The limits of disturbance should not include the stream buffer except for any ARAP covered

- If this area is not a stream, please provide an appropriate sediment control measure around the
existing headwall to protect against sediment leaving the property.
- If this area is a stream please remove proposed filter ring.

1. IFC 2018 912.2.1 - Provide Sprinkler system FDC on street (address) side of building. ACTION: FDC
needs to be in an approved location on the street side of building.
2. NFPA 2016 6.4.5.4* Fire department connections shall be located not more than 100 ft (30.5 m)
from the nearest Fire hydrant connected to an approved water supply.
3. IFC 2018 503.2.4 -Turning Radius: Provide a truck turning template using the Hendersonville Fire
Department template. ACTION: Provide truck turning template on one page, in a single series of
movements, include possible obstructions from landscape plan.
4. Hendersonville Subdivision Regulations 3.7.2.1 – Fire hydrants shall be supplied by not less than a
six (6) inch diameter main installed on a looped system, or not less than an eight (8) inch diameter

STAFF REPORT
This is a vacant 4.84-acre site located at the intersection of Saundersville Road and Wyncrest Way. It is
zoned SR-1 (Suburban Residential Low-Density). The Wyncrest residential subdivision (SR-1) is to the
west and north-west. Southview Office Plaza (Office - Planned Development) is located to the north. To
the east is a vacant parcel zoned Neighborhood Commercial (NC). To the south-east is a General
Commercial Planned Development, which includes Go Store It and a future fuel service station, which
would be located at the south-east corner of the Saundersville Rd/Avondale Rd intersection. The
Highway 386 on/off ramp is located to the south.
The future land use plan shows the subject lot as Suburban Living. The proposed uses are not
compatible with the existing land use. The applicant is proposing to amend the land use plan to
change the character area to Suburban Center, which would be compatible with the proposed uses.

EXISTING ZONING
The proposed development consists of two lots. The north lot (1.99 ac) is a proposed Circle K fuel
service station. The south lot (2.85 ac) is a proposed hotel (Hilton-brand, per the developer). Access to
the site will be via a full-access off of Wyncrest Way and a full-access off of Saundersville Rd (but see
Public Works staff comment below regarding this proposed entry point). Proposed uses would be
restricted to Hotel and Motor Vehicle Service Station/Fuel Center.

A minimum 20 foot width landscape buffer is required and proposed along the west property line
common to the Wyncrest residential subdivision.
Conceptual building elevations have been provided of the proposed hotel and fuel station. While the
applicant has made some changes to bring the architecture and materials closer to building design
requirements, there are still significant improvements that need to be made. Due to the close proximity
of these buildings to residential development, and the request for planned development rezoning, staff
recommends that the proposed architecture and materials should exceed the minimum standards set
by the zoning ordinance. See Planning staff comment #2 below, which shows images of some hotels
that provide a higher level of design.

In addition, for Planned Development rezonings:
2. Generally, the proposed hotel architecture and exterior materials are not in compliance with the city's
basic building design standards. And, since you are requesting a planned development zoning, the

architecture and materials should exceed the minimums established by the base design standards.
This should be extensively redesigned, with particular focus paid to significant horizontal and vertical
articulation, roof linen articulation, establishment of an accentuated ground floor elevation,
transitioning to a middle and then top. Front entry should be accentuated. Cornice work should be
provided. Images below show better articulation, floor hierarchy and glazing and should be used as a
starting point for design development.
3. The fuel station building elevations should be modified to provide better vertical articulation,
watertable consistency on all sides of building, parapet wall screening of roof top units; glazing should
wrap around to both sides of building. Canopy columns should be brick to ceiling; colors should be
muted earth tones.
4. Provide a list of proposed allowed uses: Hotel, Motor Vehicle Service Station/Fuel Center
5. Electric service to each lot shall be underground. Provide NES-approved electric service plan.
6. Staff recommends that the planned development include the following signage restrictions: Building
wall signage should be limited to channel letters – no cabinet signs. There should be no signage on
building walls facing the residential subdivision. Ground signage should be limited to the
Saundersville Rd frontage only – no signage on Wyncrest Way.
7. Show 20 ft landscape buffer along west property line. Buffer shall be generally exclusive of any
proposed drainage swales or structures.
8. Due to proximity of nearby residences, additional restrictions (above those outlined in the zoning
ordinance) may be placed on parking lot and canopy lighting at site plan stage.

1. 1. Response to comments #4 implies staff acceptance of right-in/right-out on Saundersville Road.
To clarify, Public Works is not in favor of an additional access to Saundersville Road. As discussed
with the engineer, the applicant/engineer could disagree with staff comments, present their case,
and provide substantiation to the Planning Commission.

STAFF COMMENTS – FIRE DEPARTMENT:
1. IFC 2018 503.2.4 -Turning Radius: Provide a truck turning template using the Hendersonville Fire
Department template.
2. IFC 2018 D105.2 – Aerial fire apparatus access roads shall have a minimum unobstructed width of
26’, exclusive of shoulders, in the immediate vicinity of the building or portion thereof. ACTION: All
access roadway area needs to be 26 feet minimum.
3. Hendersonville Subdivision Regulations 3.7.2.1 – For commercial districts or commercial
subdivisions, there shall be one (1) or more hydrants at each street intersection depending on the
required fire flow, with intermediate hydrants so that they are not over three hundred (300) feet
apart. ACTION: Additional hydrants are needed on this property. These should be placed in
approved locations.
4. IFC 2018 D104.1 – Buildings exceeding 30 feet or three stories in height. Buildings or facilities
exceeding 30 feet (9144 mm) or three stories in height shall have not fewer than two means of fire
apparatus access for each structure. ACTION: Meet standards per IFC 2018 D104.1 – Buildings
exceeding 30 feet or three stories in height have 2 or more fire access means.
5. IFC 2018 D105.3 - Proximity to building. One or more of the required access routes meeting this
condition shall be located not less than 15 feet (4572 mm) and not greater than 30 feet (9144 mm)
from the building and shall be positioned parallel to one entire side of the building. The side of the
building on which the aerial fire apparatus access road is positioned shall be approved by the fire
code official.

Director Free stated Development Impact Fees are in the process of being reviewed by the Board of
Mayor and Aldermen. There is going to be a worksession on Tuesday, March 12, 2024, at 6PM. At
the Tuesday, March 12, 2024, Board of Mayor and Aldermen meeting, there was going to be the
first reading of the passing of Development Impact Fees. Director Free stated there was going to
be a discussion about the Zoning Enforcement Process at the General Committee Meeting on
March 12, 2024.
Director Free announced the TBN Music City PDP was approved by the Board of Mayor and
Aldermen. Director Free stated that several departments over the next 4 to 6 months would be
working on a 10-year transportation plan. Director Free stated Tim Altizer was doing well and looks
forward to being back at the Planning Commission meetings soon.

This is a vacant 4.84-acre site located at the intersection of Saundersville Road and Wyncrest Way. It is
zoned SR-1 (Suburban Residential Low-Density). The Wyncrest residential subdivision (SR-1) is to the
west and north-west. Southview Office Plaza (Office - Planned Development) is located to the north. To
the east is a vacant parcel zoned Neighborhood Commercial (NC). To the south-east is a General
Commercial Planned Development, which includes Go Store It and a future fuel service station, which

would be located at the south-east corner of the Saundersville Rd/Avondale Rd intersection. The
Highway 386 on/off ramp is located to the south.
The future land use plan shows the subject lot as Suburban Living. The proposed uses are not
compatible with the existing land use. The applicant is proposing to amend the land use plan to
change the character area to Suburban Center, which would be compatible with the proposed
uses.

EXISTING ZONING
The proposed development consists of two lots. The north lot (1.99 ac) is a proposed Circle K fuel
service station. The south lot (2.85 ac) is a proposed hotel (Hilton-brand, per the developer).
Access to the site will be via a full-access off of Wyncrest Way and a full-access off of

Saundersville Rd (but see Public Works staff comment below regarding this proposed entry point).
Proposed uses would be restricted to Hotel and Motor Vehicle Service Station/Fuel Center.
A minimum 20 foot width landscape buffer is required and proposed along the west property line
common to the Wyncrest residential subdivision.
Conceptual building elevations have been provided of the proposed hotel and fuel station. While
the applicant has made some changes to bring the architecture and materials closer to building
design requirements, there are still significant improvements that need to be made. Due to the
close proximity of these buildings to residential development, and the request for planned
development rezoning, staff recommends that the proposed architecture and materials should
exceed the minimum standards set by the zoning ordinance. See Planning staff comment #2
below, which shows images of some hotels that provide a higher level of design.

2. Generally, the proposed hotel architecture and exterior materials are not in compliance with the
city's basic building design standards. And, since you are requesting a planned development
zoning, the architecture and materials should exceed the minimums established by the base design
standards. This should be extensively redesigned, with particular focus paid to significant
horizontal and vertical articulation, roof linen articulation, establishment of an accentuated ground
floor elevation, transitioning to a middle and then top. Front entry should be accentuated. Cornice
work should be provided. Images below show better articulation, floor hierarchy and glazing and
should be used as a starting point for design development.
3. The fuel station building elevations should be modified to provide better vertical articulation,
watertable consistency on all sides of building, parapet wall screening of roof top units; glazing
should wrap around to both sides of building. Canopy columns should be brick to ceiling; colors
should be muted earth tones.
4. Provide a list of proposed allowed uses: Hotel, Motor Vehicle Service Station/Fuel Center
5. Electric service to each lot shall be underground. Provide NES-approved electric service plan.
6. Staff recommends that the planned development include the following signage restrictions:
Building wall signage should be limited to channel letters – no cabinet signs. There should be no
signage on building walls facing the residential subdivision. Ground signage should be limited to
the Saundersville Rd frontage only – no signage on Wyncrest Way.
7. Show 20 ft landscape buffer along west property line. Buffer shall be generally exclusive of any
proposed drainage swales or structures.
8. Due to proximity of nearby residences, additional restrictions (above those outlined in the zoning
ordinance) may be placed on parking lot and canopy lighting at site plan stage.

To clarify, Public Works is not in favor of an additional access to Saundersville Road. As discussed
with the engineer, the applicant/engineer could disagree with staff comments, present their case,
and provide substantiation to the Planning Commission.

1. IFC 2018 503.2.4 -Turning Radius: Provide a truck turning template using the Hendersonville Fire
Department template.
2. IFC 2018 D105.2 – Aerial fire apparatus access roads shall have a minimum unobstructed width
of 26’, exclusive of shoulders, in the immediate vicinity of the building or portion thereof. ACTION:
All access roadway area needs to be 26 feet minimum.
3. Hendersonville Subdivision Regulations 3.7.2.1 – For commercial districts or commercial
subdivisions, there shall be one (1) or more hydrants at each street intersection depending on
the required fire flow, with intermediate hydrants so that they are not over three hundred (300)
feet apart. ACTION: Additional hydrants are needed on this property. These should be placed in
approved locations.
4. IFC 2018 D104.1 – Buildings exceeding 30 feet or three stories in height. Buildings or facilities
exceeding 30 feet (9144 mm) or three stories in height shall have not fewer than two means of
fire apparatus access for each structure. ACTION: Meet standards per IFC 2018 D104.1 –
Buildings exceeding 30 feet or three stories in height have 2 or more fire access means.
5. IFC 2018 D105.3 - Proximity to building. One or more of the required access routes meeting this
condition shall be located not less than 15 feet (4572 mm) and not greater than 30 feet (9144
mm) from the building and shall be positioned parallel to one entire side of the building. The side
of the building on which the aerial fire apparatus access road is positioned shall be approved by
the fire code official.
6. NFPA 2016 6.4.5.4* Fire department connections shall be located not more than 100 ft (30.5 m)
from the nearest Fire hydrant connected to an approved water supply.

Elliott Electric is proposing construction of a new 15,000 square foot building for
warehouse/distribution uses. The building sits on 3.4 acres of split zoned General
Commercial/Industrial off Innovation Way. The building is to be constructed on the portion of the
property in the Industrial Zoning. The property to the east is zoned Industrial (ServPro). The
vacant lot between this property and New Shackle Island is zoned General Commercial.
Additional screening has been required on the west side in the event the adjacent property facing
New Shackle Island does not develop quickly. To the north (rear) is a multi-family residential
planned development.

1. Buildings shall be oriented so that the main entrance faces the street on which is located and with
a hierarchy articulated with columns, pilaster, arches, or details such as special molding.
Entryway features such as porches, canopies or awnings can be used to help establish the
hierarchy.
The added canopies are not significant enough to create a substantial front entryway. Work with
Planning staff to achieve an appropriate front façade appearance. Staff recommends the use of an
entry feature with a vaulted ceiling to meet this requirement: (see examples below):

moving to the western property boundary.

- Line 7-10 - What is the velocity of the stormwater leaving the headwall? Is outlet protection
needed to prevent erosion?
- Is there adequate separation from the invert elevation of the bioretention and the bedrock
and seasonally highway water table elevations? A minimum of 2’ of separation is required.
- There is extensive grading and proposed stormwater network shown within the "30' Stream
Buffer". Please address the following: 1. Is this area a stream as determined by an HD? 2. If

stream is present please provide a 15' minimum/ 30' average stream buffer measured from
top of bank free from disturbance and stormwater infrastructure. 3. If stormwater
infrastructure still must be installed within the stream buffer please provide an ARAP NOC for
outfall/intake structures. 4. Please note that all proposed grading not associated with the
outlet structure (ARAP NOC) will need to be removed from the stream buffer.
- Could a headwall be used at structure 9 to provide more capacity and be less concern for
clogging?
- Channel grading does not reflect a 3:1 side slope. Revise.
- Provide parallel curb ramp detail for ADA ramp
- Connect downspouts to underground storm pipe to eliminate water crossing sidewalk.

The proposed 6" perforated pipe has an invert between 503.75' and 503.25', however, the
outlet of the bioretention area is at an elevation of 504'. Please specify the inlet elevation of
the underdrain and the slope of the underdrain.
- Provide a minimum 6" of freeboard between the top of bank and emergency spillway in
accordance with the Tennessee Permanent Stormwater Management and Design Guidance
Manual.

the existing headwall to protect against sediment leaving the property.
