OFFICIAL PROCEEDINGS CITY OF HERREID, SOUTH DAKOTA November 8, 2021 The Herreid City Council was called to order by Council President Adrienne Dupper on the above date at 7:35pm at City Hall. The following members were present: K. Rossow, P. Weisbeck, A. Dupper, Lacy Fuehrer, and Mayor Weismantel with K. Haar attending via zoom. R. Rossow was absent. Also, present were: M. Neeley, Finance Officer (via zoom); R. Goehring, Maintenance Supervisor; Nick Deibert, Part Time; Orland Geigle, Prairie Pioneer; Mark Kroontje, City Attorney; Dick Werner, Pool Committee; Trevor Huffaker and George Smith, EngTech; and Kyle Jenson, Jensen’s Rock and Sand. Problem Resolution Forms-none Building Permits Moved by Weisbeck, seconded by Fuehrer to approve Justin Goehring’s building permit for a 26x36x9 garage at 301 2nd Ave E. Public Comments Heard that there was follow up to the complaint of vehicles parking at the North 400 block of the alley between Main and Elm. The school will be asked to remind students not to park there. Heard a resident had requested to stop paying garbage fees because they have contracted for a private dumpster. Council discussion was that all residents should pay garbage fees, regardless of dumpster status as the city contracts the service. No motion was made to change fee requirements. Herd that Carol Quenzer Shoquist has paid for the Cemetery’s web page/domain to 9-26-2024. At that time the perpetual care fund should be able to cover the cost of the website. Discussed truck parking on tower street. Council members will watch and talk with residents who park with full loads. Hear that an invitation was received for a 4-H recognition supper. Old Business: Marijuana Dispensary Ordinance-Kroontje to investigate and provide guidance. Animal Ordinance-Kroontje to provide updated information and guidance Pool Project- A draft proposal was reviewed with estimates to be updated and project bidding to begin soon. Sewer Project-moved by Dupper, seconded by Weisbeck, all members present voted aye, motion passed to sign documents to submit payment #9 to USRDA for review. Drainage-Heard that Tim Pudwill has installed some piping at 202 2nd Ave to alleviate drainage issues at the new twin homes at the 200 block of Ash St. SDDOT-no action Paving project-Heard from Kyle Jensen about costs of the paving project at 10th Ave and North Elm. Moved by K. Rossow, seconded by Dupper, all members present voted aye, motion passed to pay the 10-19-2021 Jensen’s invoice ($136,760.19) for the paving project. Paving project-Moved by K. Rossow seconded by Fuehrer, all members present voted aye, motion passed to approve: Resolution 2021-02 WHEREAS the City of Herreid has determined it is necessary to make assessments forlocal improvements on property adjoining or benefiting from the improvements . WHEREAS State law requires that City set the interest rate on such assessments by aseparate resolution. BE IT, HEREBY RESOLVED by the City of Herreid, Campbell County, South Dakota asfollows: The City of Herreid will charge interest at the rate of three percent (3%) per year. This Resolution shall take effect upon its passage and publication in accordance withSouth Dakota law. Adopted this 8th day of November, 2021. Supplemental appropriation-moved by Weisbeck seconded by K. Rossow all members present voted aye, motion passed to approve: Supplemental Appropriation Ordinance 2021-02 WHERE AS the City of Herreid did not make sufficient provisions in the Annual Appropriations Ordinance to provide for the cost of completing the North Paving Project. NOW THEREFORE BE IT ORDAINED, by the City of Herreid, South Dakota, that the following sum be appropriated to meet the obligation for the municipality. The funds will come from reserves. 101-4310-425 General Fund, Streets, Maintenance and Repair $125,801.87 Dated this 4th day of October, 2021 SD Dept of Legislative Audit-Heard that the 2020 Audit Report was accepted. New Business: Rubble Site and Yard Waste site inspections-Hear the inspections were passed. FO Neeley was asked to post the reports at City Hall. Liquor License Renewal-moved by Weisbeck, seconded by K. Rossow, all members present voted aye, motion passed to renew licenses for the Water Hole-Robert Weisbeck, Community Center-Kim Moser, Herreid Health and Variety-Mike Dosch. Heard the Unemployment tax rate for 2022 has been received with a small increase. Class Action Lawsuit notice-heard notice has been received that the city may be involved in a class action lawsuit agains Kimberly Clark Corporation for “flushable wipes”. Propane quotes-Heard quotes were received from Agetegra of $1.94/gallon and Slater Oil of $1.79/gallon. Moved by seconded by all members present voted aye motion passed to accept the Slater Oil bid for 2021/2022. Maintenance Report-Maintenance Goehring reported that he has been busy will focus on cleaning the streets and continuing to prepare for snow. Moved by Dupper, seconded by Weisbeck to send Maintenance Goehring to the SDTAT. Finance Report-Fund balances, expenditures, revenue accounts, sales tax receipts, and delinquent utility accounts were reviewed. Executive Session At 10:00PM Dupper moved, Fuehrer seconded to go into Executive Session pursuant to SDCL 1-25-2 (1) personnel. All members present voted aye; motion carried. At 10:35PM Mayor Gary Weismantel declared the council out of Executive Session. Moved by K. Rossow, seconded by Weisbeck, all members present voted aye to approve the following: Maintenance Goehring will receive $50 in cell phone reimbursement, effective December 1, 2021. The next regularly scheduled Council meeting will be Monday, December 6th at 7:30pm.
