Town of Hertford Town Regular Session Minutes Monday, February 8, 2021 7:30 PM Town of Hertford Community Center The Town of Hertford’s Town Council held the Regular Session on Monday, February 8, 2021. Mayor Earnell Brown called the meeting to order at 7:30 pm. COUNCIL MEMBERS PRESENT Mayor Earnell Brown, Mayor Pro Tem Ashley Hodges, Councilman Frank Norman, Councilman Jackson, and Councilman Jerry Mimlitsch. STAFF PRESENT Town Manager Pamela Hurdle, Town Clerk LaShonda Cartwright, Attorney Ben Gallop, and Police Chief Dennis Brown. OTHERS PRESENT Barry Ford, Gracie Felton, Craig Riddick, Adam L Perry, Avery Lindsey, Josiah McClenney, Latoya Jernigan, Linda Wade Hall, Martina McClenney, Joel McClenney, Jaquan Sutton, Constance Jaklic, Shirley Casey, Jack Pardue, Susan Cyr, Matt Cyr, Kim Brinn, Tim Brinn, Todd French, Gilbert Vaughan, Frank Jaklic, Tony Riddick and Connie Brothers. The invocation was offered by Pastor Todd French of St. Paul AME Zion Church. Pledge of Allegiance was cited. Welcoming of new Town Clerk LaShonda Cartwright was done by Mayor Earnell Brown. ADJUSTMENT/APPROVAL OF AGENDA Mayor Brown asked if there were any adjustments to the agenda. Mayor Pro Tem Hodges moved to approve the agenda. Point of Order was called by Councilman Jackson about agenda changes, stating that only the Clerk can do the agenda and what the other members did was illegal. Only the Clerk can send out the agenda and there needs to be an adjustment to the agenda. Point of Order was called again by Councilman Jackson (you do not vote on a point of order). A discussion about the point of order between Councilman Jackson, Mayor Pro Tem Hodges, and Councilman Norman was discussed. Mayor Brown ruled to move to proceed and advised the information was sent to the Town Manager within the 24-hour timeframe that is required. Mayor Pro Tem Hodges moved to approve the agenda with two changes. Move budget amendment from Consent Agenda down to the end of New Business that was per Manager Hurdle’s recommendation and to remove from the agenda the first closed session item NC General Statue §143-318.11 (a)(7). Mayor Brown stated a motion is on the floor, and it has been seconded. Councilman Jackson said they put agenda items on the agenda, and it is removed if the other Councilman does not like them. Councilman Norman made the motion to appeal the decision of the Chair. Councilman Jackson seconded the motion. Mayor then stated no appeal. Councilman Norman stated he had an agenda item that was placed where he did not want it to be. He did not understand why agenda items could not be placed on the agenda, but the other agenda items could be placed on the agenda. He stated he gave his items way more than 24 hours. He stated that he wanted it to be placed on the record that he did ask for some items to be placed on the agenda. Councilman Norman stated that he wanted the Councilman concern items to be under New Business and the SBI investigation was not on the agenda and he wanted it up there. Mayor Brown asked for a motion. Pro Tem Hodges stated that he would accept as a friendly amendment part of what Councilman Norman suggested which was the Community Center items being moved from Councilman Concern to New Business. He does not agree to the SBI Investigation being put on the agenda. Councilman Jackson called Point of Order about the fact of there already being a motion out therefore another motion cannot be made. Mayor Brown called a point of order about the discussion being out of order and what they need to do is settle on an agenda and move on. Mayor Brown stated that the agenda that they had in hand is the agenda that they will follow. Mayor Brown stated to keep the closed session and move the budget amendment as well as Councilman Norman’s Community Center item as New Business. Councilman Norman called the point of order because he wanted the SBI investigation to be put on the agenda and that is what his argument is. Mayor Pro Tem Hodges offered a motion to approve the agenda with the changes of moving budget amendment from consent agenda to end of new business which will be a new item (g), moving Councilman Norman’s Community Center HVAC plumbing and roof to New Business item (h) and then deleting closed session NC General Statue §143-318.11 (a)(7) from the agenda. APPROVAL OF THE MINUTES Councilman Norman stated that he would like to make a motion that the SBI be added to the agenda. Councilman Jackson seconded the motion. Mayor ProTem Hodges stated that the motion is out of order because the agenda has already been accepted. Mayor Brown advised they would take a vote. Mayor Brown stated that she would like to thank the Town Clerk Mrs. Pam, Judy Bateman, and Sarah Mills. There were fifteen (15) sets of minutes to be done. Councilman Jackson called a point of order, telling the Mayor that she could not call names of personnel and their jobs. Mayor Brown then called for a two-minute recess. 8:01pm The meeting was called back into order by Mayor Brown. 8:03 pm Town Council Regular Session February 8, 2021 Page 2 of 11 Mayor Brown asked for approval of the minutes. Mayor Pro Tem Hodges moved to approve the minutes of 8/4/2020, 8/10/2020, 8/12/2020, and 1/4/2021 and table the approval of the remaining minutes until March 1st of the next regular session meeting. It was seconded by Councilman Mimlitsch. Councilman Norman then called for a point of order about the approval of the minutes and the fact that every Councilman has the right to speak and that they were being biased. Mayor Brown called for the vote to approve the minutes of 8/4/2020, 8/10/2020, 8/12/2020, and 1/4/2021 and table the approval of the remaining minutes until March 1st of the next regular session meeting. The motion was seconded by Councilman Mimlitsch. CONSENT AGENDA Councilman Jackson made a motion not to approve the Consent Agenda and Councilman Norman seconded. Councilman Mimlitsch asked if Councilman Jackson would take back the motion and would agree that it could be moved under new business. Councilman Jackson stated that he would agree to do that. Mayor Brown stated that they do not have to take a vote and they will be moving all the Items A through E from Consent Agenda to New Business. ANNOUNCEMENTS Manager Hurdle presented A. Starting February 3, 2021, Waste Industries will start trash pickup every Wednesday. All of Hertford's trash carts(90-gallon carts) will be emptied on Wednesday. Recycling pickup will remain on Thursday. Questions or concerns can be addressed by calling Water Industries/GFL at (252)264-2996. B. If you in need of a recycling cart, recycling tote, or receive information on recycling, please call the Utility Department (252)426-5311 or email utilities@townofhertfordnc.com. C. Please update your contact information to receive calls from our Emergency/Notification call service. River City CDC, a non-profit organization, has agreed to assist our young citizens to earn their GED. They are conducting GED classes, Landscaping, and Plumbing apprentice training and have offered to include our Hertford citizens. Classes are free for ages 16 to 24. Classes will be held in Elizabeth City, on Tuesday and Thursday, from 10:30 am to 1:30 pm. YOUTH BUILD, a component of River City CDC, will provide transportation for our young people, from Hertford to Elizabeth City and return. CITIZENS CONCERNS Mayor Brown stated that there is a five-minute time limit and they have up to thirty days to respond to these concerns. Councilman Jackson called the point of order and provided clarity on the fact that it is their policy that will try to respond to these concerns within thirty days but they do not have to. Kim Brinn- stated she would like for the Council to move forward on future business and concentrate on town business instead of acquisitions which accomplish nothing. Downgrading Council and the audience have no business being done, she called for national unity. She also advised us to continue to look out for our neighbors. Tim Brinn- Stated at the Monday 1, February County Commissioners meeting, the Commissioners decided by a unanimous approval to enter a contract with ZLS Services for the County pursued overdue tax properties. That was to be signed this month and will go into effect and become a standing contract between the County and ZLS Services. Also discussed was a need for County level Code Enforcement, that issue will be coming up and they will be following up on that doing the month of February. It will be followed up by the County Commissioners. Gracie Felton- Stated that she wanted to know what was going on with the SBI Investigation and that she did not like the acquisition that everyone was throwing blame. She does not like what the Council is doing right now. Each one of the Council needs to listen and they need to come together. She does not like the idea of not having the planning meeting. She also stated that does not like the idea of being blinded when she is a citizen. Linda Wade Hall- Stated she had concerns about the light bill and that she and everyone in the building are on disability and their light bill went up extremely. She wants them to consider it. Gilbert Vaughan- Stated that there has been an acquisition that private meetings are being held without all the Council being present. He wants to know if this is true or false. Frank E. Norman- Stated he is coming as a citizen and at this time he is not representing himself as a Councilperson. Things are going on in the town that is bias and unfair. He advised that Councilman Jackson as well as himself had items that were supposed to have been put on the agenda and the Mayor said they were never placed on the Agenda and the Agenda that she has does not have them up there. The Manager agreed that they were asked for and asked for on time. That means that somebody is not doing what they are supposed to do, or somebody is lying. Once an item gets on the Agenda it should not get hijacked by a majority. As a citizen, he thinks that they should follow the rules that they agree on. Councilman Jackson was berated for almost a complete hour and for the majority of the time that he was being berated Councilman was not even in the room and everybody was good with it but when the item is said about someone else it is a problem. He received Mrs. Brinn’s email and he wants to respond so it is on the record, if certain segments are doing wrong as a Councilperson, he is going to address it. Town Council Regular Session February 8, 2021 Page 4 of 11 Tony Riddick- Stated that on the record the previous lady that spoke on unity bashed his company years ago and because of that a company would not call him back. We should practice what we preach and what we speak about. The Council is extremely biased. They disregard Councilman Norman and Councilman Jackson and to him, they are very knowledgeable about policy and procedure. He is concerned about taking a drug test in Hertford to get a job and if there is speculation that someone on the Council is doing drugs that person should be dealt with. He does not want anyone from the Town making decisions if they are under the influence. The council should also have to take a drug test. Justice should not be blind. C- No one came forward. Hanit Buchannan- Stated that he did not sign up to speak and that he will give his cousin his other four minutes to speak. He is yielding his other four minutes to Mr. Riddick. Mr. Riddick-Stated that if anyone on the Council has issues with drugs, they should show some type of leniency and they should not attack that person. We do not need to go behind people's backs and talk. He still has not seen a plan under the Waterfront project that addresses the core of Hertford, the uptown area of Hertford where many people live. Call the citizens to the table and let them have input. The Council needs to find banking centers that work with the people in that area that will guarantee low-interest rates and allow people to stay in that area. Hitchwood (Adam Perry)- Stated that he had a question if they were familiar with the term “Common Ground”? Both times he came he heard arguments and it should be about the issues and maybe the citizens want to hear about some of the items being left out. Let the citizens pick out what they want to speak on. Quentin Jackson- Stated that he appreciated everyone coming to share their Council concerns. He has been witnessing the last three years and that the citizens are owed some answers. The Council people use to have enough integrity to talk and text after the meetings. He advised he asked the Council to come out to the work session and we are the highest-paid city employees. He stated that they should fulfill their campaign promises. He then stated that he got arrested a couple of times, and it cost him thousands of dollars to fight for him to sit back in his seat. Some of them condemned him and then he was acquitted. He understands the color of his skin plays a lot in this. It is so passionate between him and Councilman Norman because they have taken the classes and educated themselves on the rules and procedures. Look at the agenda items and decide which way to go. NEW BUSINESS Mayor Pro Tem Hodges made the motion to approve the Resolution of canceling non-budgetary Work Sessions. Councilman Mimlitsch seconded. Councilman Jackson called the point of order about canceling the Work Session and advised them to look at their Charter. He wants to know if this is something that needs to be written in their Charter and that he thinks they should have a public hearing and ask the people. Mayor Brown stated that she would like to rule on it because the agenda item was emailed to all the Council to read two days ago. Mayor Brown ruling on the motion was for Mayor Pro Tem Hodges to keep reading the resolution. Mayor Pro Tem Hodges made the motion to withdraw those three items A, B, and C. Town Manager- Zoom Agreement that expires April 1st. Councilman Norman made a motion to table this item until the next meeting in March. The motion was seconded by Councilman Jackson. Town Manager HHI- Dine, Drink, and Dance -Frank Bagley spoke on this subject and the Rotary club. The request is to host Dine, Drink, and Dance on Saturday, May 15th, or May 22nd, 6 pm-10 pm. Mr. Frank Jaklic spoke on behalf of the Rotary and HHI. Mr. Jaklic stated that because of contacting and getting vendors to commit to the event, he needs approval from the Council to go forward with the event. Councilman Norman will be willing to agree to this if it is stated on record that they are willing to go with the perimeters of Covid restrictions at that time. Councilman Jackson made the motion to go along with this with provisions that they go along with Town Manager about safety protocols and Mayor Pro Tem Hodges seconded. Town Manager -IT- RFP, RFP quotes were sent out in January and four quotes were received from different companies. Councilman Norman made the motion to table this until March and Mayor Pro Tem Hodges seconded. Town Manager -Budget Calendar, Motion by Councilman Norman to approve the budget calendar and seconded by Councilman Jackson. Town Manager-Fire Department Annual State Grant, the deadline for the application is March 1st. A motion to approve by Councilman Norman and seconded by Mayor Pro Tem Hodges to approve the Fire Department applying for the grant. Town Manager-Budget Amendment #3 was just received at the meeting. An explanation of the Budget was given by the Town Manager. Councilman Norman made a motion to pass Budget Amendment#3 and was seconded by Councilman Jackson. Town Manager-Police Department Bonus Ratification of Funds, Town Manager Hurdle, and Chief Brown agreed that the funds would come out of payroll. Manager Hurdle stated that the ratification was because the funds were previously passed by the Council and that line item does not have the efficient money. Motion made to accept by Councilman Jackson, seconded by Councilman Norman. Town Manager- Police Department Grant, Town Manager stated that this Grant is being used for the K9. Motion made by Councilman Jackson, seconded by Pro Tem Hodges. Councilman Mimlitsch Yay Councilman Norman Yay Councilman Jackson Yay Mayor Pro Tem Hodges Yay Mayor Brown Yay The vote was 5-0 Council voted to approve the Police Department Grant MAYOR/COUNCIL CONCERNS Mayor called for a five-minute break at 10:08 pm Mayor called the meeting back to order at 10:13 pm Town Council Regular Session February 8, 2021 Page 7 of 11 Councilman Norman-Community Center HVAC System, Plumbing and Roof, addressed the issues that are going on with the building. Leaking roof, Manager stated that she had the bids for that in the Council packets. In the bathrooms on their side in the wall somewhere they have a leaking pipe, and the water is coming up through the tiles. Between the last door and the kitchen going to the other room, there are some weak spots in the floor. Manager Hurdle stated that they do not have bids for those. The lights on the other side towards the back need to be put up. Councilman Norman has the light in the Janitor room. Councilman Jackson stated that this was already being taken care of. Mayor Pro Tem Hodges made a motion for the Manager to proceed forward with contracts. Manager Hurdle stated that we are not at a cost level where we have to do bids. Councilman Jackson stated that they needed to look at cost first. Councilman Mimlitsch stated that he was curious about the Shingles and the year of shingles being given and he wanted to know if the leaks and plumbing could be looked at by Public Works. Councilman Norman stated that Public Works had already been there, and they were the ones that suggested plumbing. Mayor stated that she thinks that this is something that needs to be tabled and that the Town Manager get the proper contractors in and that she does the assessment and comes back with what the cost would be, with recommendations on what needs to be fixed, and who is going to fix them and how much will it cost. Mayor Pro Tem Hodges stated that he thinks they need to do the roof and he moved that they direct the Manager to meet with contractors and make the determination and then come back to them and they make the decision at that time. Councilman Norman stated if the town were willing to take care of the roof, he would be willing to take care of the situation here. Councilman Norman seconded Mayor Pro Tem Hodges's motion. Councilman Norman stated the HVAC unit on the other side does not work and he made the motion to replace it. Councilman Jackson seconded. Councilman Norman-stated he asked the mayor if each one of them have a copy of the letter that she got and the Mayor advised she will email it tomorrow. He wants to have a conversation about the SBI taking their equipment. Councilman stated that Mayor Pro Tem Hodges had made a statement that no one can be moved from the council and he advised that is not true it can be done; it is very difficult, but it can be done. He wanted on the record “what censorship is the majority of the Council voting to say we disapprove of the action of a particular member on the governing board, it could be Councilman or Mayor”. Councilman Norman stated that he has been treated very unfairly. Town Council Regular Session February 8, 2021 Page 8 of 11 Councilman Mimlitsch-stated he does not have anything. Councilman Jackson- stated that he would like to increase the minimum wage for the Town personnel. He made the motion on a resolution that they would pay their employees no less than fifteen dollars an hour and for that to be added to the budget. Councilman Norman seconded. Councilman Mimlitsch asked about the pay study and what the Town had. He stated he thinks they should discuss and wait on making it a resolution until they know their budget numbers. Mayor Pro Tem Hodges echoed Councilman Mimlitsch's thoughts. He thinks it a good thing for sure. Councilman Norman stated that he does not think it is a scratch. He supports the resolution. The Mayor stated they paid Maps to give them a pay study. She wants the resolution to be based on the Town Managers' findings. She agrees that the employees deserve to receive a raise, but she thinks the way they do it should be factored into the process. Councilman Jackson withdrew his motion. Councilman Jackson-stated because they do not have the money to do hazard pay, he wanted to give each employee three additional vacation days. Manager Hurdle stated it is doable and you can also consider three extra personal days. They will give a total of four because they do get their birthday as a day. Pro Tem Hodges stated it is a great idea and it does benefit the employees and it is a great incentive. Councilman Jackson made the motion to give four days of personal leave to the employees. Councilman Norman seconded. The Town Manager state in the motion says three days plus the one (Birthday) giving four days total including a letter thanking the employees. Councilman Jackson made a motion to suspend the rules about going over his time-minute time limit and the placement of his agenda items and Councilman Norman seconded. Mayor Pro Tem Hodges called a point of order stating that they never voted on the motion to approve the three personal leave days. Councilman Jackson-stated he would like to make a motion to suspend the Waterfront project for sixty days because of an investigation going on. Councilman Norman seconded the motion. Mayor Pro Tem Hodges said he is going to vote against it because of the grant and its guidelines. The employees are suffering, and they need to do something about it. Manager Hurdle stated the employees lose the break due to the Clerk needing an office. We cannot socially distance because we are in close quarters. We have run out of file room. Manage Hurdle stated it needs to be talked about. Mayor Pro Tem Hodges stated that the layout wastes a lot of space. Councilman Norman stated that he concurs with Councilman Jackson and doing something a bit different. Councilman Mimlitsch stated using partitions and staying the budget. Councilman Jackson stated getting the Manager to look at prices. No motion was made. Councilman Jackson stated that he wants to get the housing project reapproved. The Housing Project will be a good thing for Hertford. Councilman Jackson stated that a couple of firefighters felt slighted by the Mayor when the gas leak occurred. They did not get any recognition in the paper. Councilman Jackson reached out to Manager Hurdle about Mr. Bill looking for an administrative person for public works and he does not want that to fall between the cracks. Councilman Jackson also stated that the audit has not been turned in and they need to discuss that. Councilman Jackson asked Manager Hurdle about the payment to the Fire Fighters on Wynne Fork Rd. Manager Hurdle stated that no formal claim has been completed yet and that is in the hands of Emergency Management. Councilman Jackson also states that St. Paul Church that sits on the corner of Dobbs St. was awarded a grant. He wanted to shout them out because of things that they have done for the town. Mayor stated she needs a motion to go into a close session about NC General Statue 143-318.11 (a)(6) Personnel. Motion seconded by Mayor Tem Hodges. Starting February 3, 2021, Waste Industries will start trash pickup on every Wednesday. All of Hertford trash carts(90-gallon carts) will be emptied on Wednesday. Recycling pickup will remain on Thursday. Questions or concerns can be addressed by calling Water Industries/GFL at (252)264-2996. 2. If you in need of a recycling cart, recycling tote or receive information on recycling, please call the Utility Department (252)426-5311 or email utilities@townofhertfordnc.com. 3. River City CDC, a non-profit organization, has agreed to assist our young citizens earn their GED. They are conducting GED classes, Landscaping and Plumbing apprentice training and has offered to include our Hertford citizens. Classes are free for ages 16 to 24. Classes will be held in Elizabeth City, on Tuesday and Thursday, from 10:30am to 1:30pm. YOUTH BUILD, a component of River City CDC, will provide transportation for our young people, from Hertford to Elizabeth City and return. Pickup locations: 9:30am Church Street and King Street 9:45am Wynne Fork Court, Bus Stop This program will start Tuesday February 2, 2021. Each speaker is asked to limit comments to 5 minutes. Please provide the clerk with copies of any handouts you have for the Council. Although the Council is interested in hearing your concerns, speakers should not expect action or deliberation on subject matter brought up during the Public Comment segment.
