Minutes of the public meeting of the Board of Trustees of the Incorporated Village of Hewlett Bay Park held on Thursday, March 2, 2023 at 5:30 PM at Village Hall, 30 Piermont Avenue, Hewlett New York 11557. Members of the public also were permitted to observe and participate. 1. Calling the Meeting to Order: Mayor Salomon called the meeting to order at 5:35pm 2. Roll Call: Present- Mayor Alex Salomon- Deputy Mayor Antonio Oliviero Trustee Michael Davidov Trustee Renee Zylberberg Village Clerk Michelle Blandino Village Attorney Brian Stolar Building Inspector Dennis Fromigia- Via Zoom Excused Trustee Jay Levy 3. Notice of Meeting – Nassau Herald: The Clerk reported that notice of the public meeting was emailed to the Nassau Herald, posted on the bulletin board outside of Village Hall and in the lobby of Village Hall and posted on the Village website. 4. Minutes- Minutes of the Meeting on January 12, 2023 On motion by Deputy Mayor Oliviero, seconded by Trustee Zylberberg, and approved unanimously carried the Board dispensed with the reading of the January 12, 2023 minutes as the Clerk had previously mailed such minutes and they are hereby approved. 5. Village Attorney RESOLVED, that the Mayor previously appointed, and the Board of Trustees approved the appointment, of Brian S. Stolar, as Village Attorney, to serve at the pleasure of the Mayor, and the services of such Village Attorney to be compensated pursuant to the retainer agreement with Brian S. Stolar, and it is further RESOLVED, that the appointment and approval shall continue, and it is further RESOLVED, that the Board of Trustees hereby retains Harris Beach, PLLC, as special counsel to the Village, effective March 2, 2023, for non-retainer legal services (including litigation matters or Village acquisition or sale of real estate) as may be required, the services of such special counsel to be compensated pursuant to a retainer agreement with such special counsel, at the same rates as are currently included in the retainer agreement with Meyer, Suozzi, English & Klein, P.C., and it is further RESOLVED, that the Mayor is authorized to execute the retainer agreement with Brian S. Stolar and Harris Beach, as special counsel, a copy of which will be on file with the Village, and to sign such other documents, as may be necessary, to effectuate such change in 6. Everit Avenue Paving Program/Puddling IFO 133 Everit Avenue The Board discussed 7. Memo received from Building Inspector for request from Mr & Mrs Abruzzo owners of 162 Cedar Avenue, for grade a grade change Tabled until April 17, 2023 at 5:30 PM. The Board directed the Building Department to have the applicant notify the adjacent neighbors to 162 Cedar Avenue using a form provided by the Village. .8 Annual Storm Water Report Proposal West Side Engineering $2000 ( not to exceed) Nelson Pope Engineers $2600 (not to exceed) On motion by Trustee Zylberberg, seconded by Deputy Mayor Oliviero and unanimously carried, the Board accepted the proposal for the Annual Storm Water Report from West Side Engineering at a fee not to exceed $2000 9. Speed Hump Analysis/ Nelson Pope Engineers The Board discussed 10. 2021 Tax Refund for Jack Lepper Parcel 42/191/6 2021 Assessment reduced from 2178 -1600 578 x 84.007 tax rate= $485.52 Refund On motion by Mayor Salomon, seconded by Trustee Davidov and unanimously approved, the Board directed the Treasurer to issue a refund check to Jack Lepper for a tax reduction on parcel 42/191/6 for the tax year 2021 in the amount $485.52 11. Election Update/ June 2023 The Clerk updated the Board 12. Reports A. Public Safety 1. Audit of Claims The Board discussed the claims. Upon confirmation from the Board that the items in such abstract represented the purchase of goods and services actually received and/or performed and that each item contained in the abstract was for a proper Village purpose, on motion duly made by Trustee Zylberberg, seconded by Mayor Salomon, and adopted unanimously, the Board authorized and directed the Village Treasurer pay the general fund claims in the total sum of $78,502.82 set forth in abstract #722 (copy of the abstract is on file in the Village office). 13.
