Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work Session Meeting June 18, 2019 7:30 p.m. The Work Session Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on June 18, 2019. The meeting was called to order at 7:31 p.m. by Mayor Randall who asked the Municipal Clerk to read the open a public meeting statement: The Work Session Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”. Notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. CONSIDERATION OF MINUTES May 21, 2019 – Combined Meeting of the Mayor & Council RESOLUTION Resolution #19-62- Introduced by Councilman Shell A Resolution – Appointment of Fireman, Kevin James Zatorski WHEREAS, the Fire Department of the Borough of Ho-Ho-Kus, through its Chief, has recommended to the Mayor and Council the appointments of members as follows; and WHEREAS, Kevin James Zatorski passed his physical as required by the Borough; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus that Kevin James Zatorski is recommended to the New Jersey State Fireman's Association for membership. A motion was offered by Councilman Shell and seconded by Councilman Rorty to approve Resolution 19-62. Motion carried on a roll call vote – All present voting “Aye”. DEPARTMENT REPORTS - Reports are on file in the Municipal Clerk’s office: Police Report – May 2019 Court Report– May 2019 Library Report – June 2019 PUBLIC DISCUSSION Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your and to be recognized, come forward to the microphone and state your name and address for the record. Seeing none, the Mayor closed the meeting to the public. ADMINISTRATOR’S REPORT Administrator reported on the following; Fair Sharing Housing – Tom Toranto was going to join us tonight, however due to the absence of President Troast he is 1  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work Session Meeting June 18, 2019 7:30 p.m. schedule to come to the next meeting, June 25th, 2019 to finalize plans. Our plan is to have a shovel in the ground by June 2020. Rondale Towing – The owner of Rondale Towing now has an attorney who needs more time to prepare for the courtesy hearing regarding his dismissal from the Borough’s Official Towing List. The meeting will be scheduled for some time in September/October. NJDOT - The Borough received a NJDOT grant of $117,093 for the resurfacing a Lloyd Road. Bid opening came in today with the lowest bid being $131,861. Work to commence sometime late July early August. A resolution will be prepared for approval for next meeting to approve. Community Development Grant – The Borough had a $103,000 community development grant that was going to be used for our low income district where we were going to pave Carlton Avenue. Unfortunately after a recalculation of the low income requirements it was found Ho-Ho-Kus was no longer eligible. They asked us to submit another proposal for a senior project or handicap bathrooms. Mr. Jones will be applying to install a handicap bathroom upstairs in Borough Hall with this grant money that was received. Franklin Turnpike & Race Track Road – Milling and paving has been completed and the striping will be done shortly. Councilman Crossley added the Police force did an outstanding job with all the closed roads. Northwest Bergen Coop – We need to amend the resolution for the 2019 Resurfacing Program as the business entity that was awarded change its name or operates under a different name. Library update – The Borough and the Library are still working on the logistics on modifying their payments to the library. NJDEP Violations – The NJDEP did issue violations to the property owner of the bagel store on Franklin Turnpike for work he did on the property, which was not in compliance. Immaculate Heart Academy – Residents came in complaining about the work being done at the School during the weekend. Police were called; it was found they were allowed to work as it was during normal business hours. The school came in for a fence permit which was granted as the field is located in Ho-Ho-Kus. However, it was found they are also replacing the turf field; we issued a stop order on that project until our engineering signs off on the plans to make sure there are no soil/drainage issues to those residents. For the last 15 years they were supposed submit quarterly maintenance reports, however that was never enforced, moving forward Mr. Jones will require them to submit those reports to keep them on file. CORRESPONDENCE • NJDEP Clean Communities grants distribution for Municipalities/Counties for 2019 • NJDEP accepting Nominations thru July 26 for Annual Program to Honor those with extraordinary Commitment to Recycling. • NJDEP issues $712,500 in penalties against firms that operated illegal waste transfer-stations and marketed material as clean fill. • Township of Washington Planning Board Notice of Hearing on application – Immaculate Heart Academy was held June 6, 2019. • Northwest Bergen County Utilities Authority – 2020 Service Charges-Water Usage and EDU data due June 24, 2019. • Letter from a resident regarding speeding in her neighborhood – Race Track Road • Email from JoAnn Carroll – regarding a resident who rebuilt a wall that is located in the (ROW) Right of Way on borough Property. • ***Richard’s Run date changed to October 6th, 2019. (needs approval) ***A motion was offered by Councilman Shell and seconded by Councilman Rorty to approve the Richard’s Run date change to October 6th, 2019. Motion carried on a roll call vote – All present voting “Aye”. INTRODUCTION OF ORDINANCES to be placed on June 25, 2019 agenda • 2019-25 - AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 27 OF 2  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work Session Meeting June 18, 2019 7:30 p.m. THE CODE ENTITLED “FLOOD PLAIN MANAGEMENT” RESOLUTIONS REVIEW (to be placed on June 25, 2019 agenda) • Payment of bills – June • Support of Path to Progress • Authorizing Appointment of Municipal Representative to the BC Community Development Regional Committee • Liquor License renewals 2019/2020 • Chapter 159 Clean Communities Program • Amending Resolution 19-58 – Award of Contract-2019 Coop Resurfacing Program LIAISON REPORTS Recreation – Councilman Iannelli report the Football Association will be submitting plans for new sheds on the field. Library – No Report Board of Education – Mayor stated he attended the awards ceremony and was very impressed. Ambulance Corp. – will have report for next meeting Fire Department – will have report for next meeting Chamber of Commerce – Councilman Shell reported the Taste of Ho-Ho-Kus was a huge success and thanked everyone who attended. NEW BUSINESS MAYOR'S REMARKS Mayor suggested if Councilman Policastro cannot attend a library meeting, we need someone there in his absence. He also suggested we need to have an old business list moving forward until the item is determined that it has been resolved. CLOSED SESSION: On a motion by Councilman Crossley, seconded by Councilman Rorty, the Mayor and Council approved entering into Executive Session closed to the public. Motion Carried by voice vote – all present voting “Aye”. A Resolution - providing for a meeting not open to the public in accordance with the provisions of the New Jersey Open Public Meetings Act. NJSA 10:4-12 Whereas, the Borough Council of the Borough of Ho-Ho-Kus is subject to certain requirements of the Open Public Meetings Act, NJSA 10:4-6; and Whereas, the Open Public Meetings Act, NJSA 10:4-12 provides that an Executive Session not open to the public may be held for certain specified purposes when authorized by resolution; and Whereas, it is necessary for the Borough Council of the Borough of Ho-Ho-Kus to discuss in a session not open to the public certain matters relating to the item or items authorized by NJSA 10:4-12 (b) as follows: 7- Matters relating to litigation, negotiations and attorney-client privilege Rondale Towing Right of way on Borough Property Verizon/AT&T Cell Towers Now therefore, be it resolved by the Borough Council of the Borough of Ho-Ho-Kus assembled in public session on June 18, 2019 that an Executive Session closed to the public be and the same is hereby authorized for discussion of matters relating to the specified items designated above. 3  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Work Session Meeting June 18, 2019 7:30 p.m. Closed Session began at 8:10 p.m. and ended at 8:40 p.m. On a motion by Councilman Iannelli, seconded by Councilman Crossley, the meeting returned to open public session.
