Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Work/Public Meeting Minutes May 21, 2019 7:30 p.m. The Combined Work/Regular Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on May 21, 2019. The meeting was called to order at 7:31 p.m. by Mayor Randall asked the Municipal Clerk to read the open public meeting statement: The Combined Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE: Mayor Randall led those present in the salute to the American Flag. APPROVAL OF MINUTES A motion was offered by Councilman Rorty, seconded by Councilman Crossley to approve the minutes of April 23, 2019 Combined Work/Public Meeting and the April 23, 2019 Close Session Meeting. Motion carried on a roll call vote – all present voting “Ayes, with the exception of Councilman Shell who abstained. DEPARTMENT REPORTS Reports on file in the Clerk’s Office Police Report – April 2019 Court Report – April 2019 Library Report – May 2019 PUBLIC COMMENTS Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your hand to be recognized, come forward to the microphone and state your name and address for the record. Seeing none, Mayor closed the meeting to the public. ADMINISTRATOR REPORT Administrator reported on the following: Stigma Free – Launched our first initiative campaign at the County Fair on May 10th and will continue to spread awareness at all School and Town Events. Memorial Day Parade – Plans are in place, parade to step off at 10:30, follow by a service. Bergen County United Way – Schedule to attend the work session of the Mayor and Council on June 18th Correspondences - HHK Cub Pack 54 is requesting approval for their Annual Year-End Awards Ceremony at East Park. 2019 COOP Resurface Program - The preconstruction meeting is scheduled for May 30, 2019. Paving Project – The County is scheduled to begin paving Racetrack Road and Franklin Turnpike from Route 17 to the border on June 4th, 2019. For safety reasons it is required Franklin Road will be closed during that time. June 20th and 21st they will be milling and paving on Jacqueline Avenue. Paving is completed on Stone Ridge Lane and he is seeking DOT approval to go out to bid to pave Lloyd Road, which the municipality already received a grant to do this work. Train Station - NJ Transit and the NJ Department of Transportation will be in town this Thursday to review the measures they are going to take on Brookside as it has been determination that street will become a one-way with the traffic coming down from Ridgewood into Ho-Ho-Kus. CORRESPONDENCE • NBCUA Audit report – on file in the Clerk’s Office • NBCUA Public Hearing , May 21, 2019 on Connection Fees • Board of Chosen Freeholder Ordinance #19-10-Establishing a Fee Schedule for the American Dream Project in the Borough of East Rutherford. • Board of Chosen Freeholder Resolutions #423-19-Recognition of Child Abuse Prevention Month, #424-19-Recognition of National Volunteer Month, #425-19-Recognition of Animal Cruelty Prevention Month. • Resolution Rejecting hate within the Township of Rochelle Park & Closter. • Resolution to Oppose the Vegetative Management Response Act from River Vale, Fair Lawn & Closter. • Resolution Supporting the never forget the heroes: Permanent Authorization of the 9-11 Victims Compensation Act from the Borough of Arlington. • Board of Chosen Freeholders – Public Hearing, June 12, 2019 on Transportation Funding for Senior Citizen and Persons with Disabilities. • HHK Cub Pack 54 requesting approval for their Annual Year End Awards Ceremony, June 2nd. From 10:30 am to 12:30pm. Motion was offered by Council Shell and seconded by Councilman Rorty to approve the request for the HHK Cub Pack 54 Year End Awards Ceremony. ADOPTION OF ORDINANCES and PUBLI HEARING - None INTRODUCTION OF ORDINANCES - None CONSENT AGENDA RESOLUTIONS (19-57 thru 19-61) Resolution #19-57- Introduced by Councilman Rorty A Resolution – Payment of Bills WHEREAS, claims have been submitted to the Borough of Ho-Ho-Kus in the amount of $2,067,311.32; and WHEREAS, such claims have been listed according to Department and account number with corresponding vouchers to be reviewed and approved by the Mayor and Council; and, WHEREAS, the CFO has determined that the funds have been properly appropriated for such purposes and are available, in the Borough of Ho-Ho-Kus and that the claims specified on the schedule attached hereto, -2- following examination and approval by the Mayor and Council, be paid and checks issued accordingly; and, NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Ho-Ho-Kus that the claims totaling $2,067,311.32 be approved and ratified respectively Resolution #19-58- Introduced by Councilman Rorty A Resolution – Award of Contract-2019 COOP Resurfacing Program WHEREAS, the Borough of Ramsey, acting as lead agency for municipalities in the Northwest Bergen County Shared Services Group, has received bid results for the 2019 Resurfacing Program; and WHEREAS, Mike Fitzpatrick & Son, Inc., 18 Cozy Lake Road, Oakridge, N.J. 07438 is the lowest responsible, responsive bidder; and WHEREAS, the Borough plans to resurface Brookview Court, Chestnut Place, Fox Run, Gordon Road, Prescott Road, Right-of-Way (Hollywood to Ross); and WHEREAS, the Borough Engineer has recommended that the Borough award a contract to the aforesaid contractor wherein the Ho-Ho-Kus portion is $214,322.24; and WHEREAS, the Chief Financial Officer has certified that adequate funds have been duly budgeted and appropriated to pay for the contract; NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Ho-Ho-Kus, that a contract for resurfacing is hereby awarded to Mike Fitzpatrick & Son, Inc. in the amount of Two Hundred Fourteen Thousand, Three Hundred Twenty-Two Dollars and Twenty Four Cents ($214,322.24) for the base contract and Two Thousand Eighty Dollars and No Cents ($2,280.00) for required additional work, including pavement striping, traffic markings and concrete curb upon recommendation of the Borough Engineer; and BE IT FURTHER RESOLVED, that the Mayor and Municipal Clerk are authorized to sign a contract with the contractor following legal review Resolution #19-59- Introduced by Councilman Rorty A Resolution - Contingency Extension Agreement between Borough of HHK and- BCUW/Madeline Housing Partners WHEREAS, the Borough of Ho-Ho-Kus (“Borough”) and BCUW/Madeline Housing Partners, LLC (“Developer”) entered into a Transfer and Development Agreement for the property located at Brookside and First Street designated as Block 1015, Lots 1 and 2 on the Tax Assessment Map of the Borough, dated July 24, 2018, as amended (“Development Agreement”); and WHEREAS, Paragraph 6 of the Development Agreement has a contingency that expires on May 16, 2019 for the Developer to obtain final site plan approval for the project and a building permit and it has become apparent that Developer will not be prepared to provide the site plan approval and building permit by that date; and WHEREAS, it is in the best interests of the Borough and Developer to mutually agree to extend the May 16, 2019 deadline for an additional period until May 19, 2020; NOW, THEREFORE, BE IT RESOLVED by the Governing Body for good cause that it does hereby approve a Contingency Extension Agreement substantially in the form attached hereto; BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to sign such Contingency Extension Agreement following legal review. Resolution #19-60- Introduced by Councilman Rorty A Resolution - Forgiveness of Solid Waste 2nd Qtr. 2019 bill WHEREAS, 115 Jacquelin Ave., 11 Saddle Brook Drive, 524 Eastgate Road, 319 Ardmore, 806 West Saddle River Road, 61 Lloyd Road, 4 Brookview Ct., 109 Blauvelt Avenue are lots under construction, 23 Deerhill Road – 1st Qtr. & 2nd Qtr.; and WHEREAS, the above residential structures will be credited accordingly and then will be reviewed for the balance and -3- NOW THEREFORE, be it resolved that the bills in question be cancelled. Resolution #19-61- Introduced by Councilman Rorty A Resolution - Click It or Ticket WHEREAS, there were 565 motor vehicle fatalities in New Jersey in 2018; and WHEREAS, a large percentage of the motor vehicle occupants killed in traffic crashes were not wearing a seat belt; and WHEREAS, use of a seat belt remains the most effective way to avoid death or serious injury in a motor vehicle crash; and WHEREAS, the National Highway Traffic Safety Administration estimates that 405,000 lives were saved by safety belt usage nationally between 1975-2018; and WHEREAS, THE State of New Jersey will participate in the nationwide Click It or Ticket seat belt mobilization from May 20-June 2, 2019 in an effort to raise awareness and increase seat belt usage through a combination of high visibility enforcement and public education; and WHEREAS, the Division of Highway Traffic safety has set a goal of increasing the seat belt usage rate in the State of New Jersey from the current level of 94.47%; and WHEREAS, a further increase in seat belt usage in New Jersey will save lives on our roadways; and THEREFORE BE IT RESOLVED, that the Borough of Ho-Ho-Kus declares its support for the Click It or Ticket seat belt mobilization both locally and nationally from May 20 – June 2, 2019 and pledges to increase awareness of the mobilization and the benefits of seat belt use. A motion was offered by Councilman Rorty and seconded by Councilman Shell to approve Resolutions 19-57 through 19-61. Motion carried on a roll call vote – All present voting “Aye”. OLD BUSINESS - None LIAISON REPORTS Recreation – No Report Library – No Report Board of Education – No Report Ambulance Corp. – Councilman Crossley reported they are still looking for more members. Some Members attended the active shooters drill, The Ambulance Corp. will be marching in the parade and there will also be an ambulance on site. Carol Tyler president on the Ambulance Corp explained there are new legislations coming down the road that is going to make it more difficult for them to be who they are and leaves them open for liability. First item is Narcan which they are allowed to administer, however, once a patient is administered the drug and they come around they have the right to refuse other treatment. She explained the danger is 15/20 minutes the patience my crash again. Secondly, the NJ State Health Department has authorized a certain ambulance corps out of New York to start serving BLS in NJ even though they have no oversight locally. Unforantally people from the congregation will start calling from their own private ambulances at motor vehicles accidents, which means if there is an accident on Route 17 and refuse treatment from them, they have the right to wait for this private ambulance, and we have no right to say “no”. The only thing we can do is ask them to step out of their vehicle to go to the side of the road even depending on what condition they may be in. The feasibility of this is very limited. Lastly, Mayor questioned how they are doing with backing up other towns. Ms. Tyler responded they have been responding to many out of town calls, she explained they were in Waldwick again today. She stated we faced this about 10 years ago and suggested to the Mayor and Council to send a letter to the surrounding towns notifying them these members are payroll employees and reimbursement from these town may be necessary. Administrator Jones will follow up. Fire Department – No Report Chamber of Commerce –Taste of Ho-Ho-Kus is scheduled for Wednesday, June 5th from 6:30 to 9:00pm. -4- NEW BUSINESS - None MAYOR REMARKS Mayor stated we loss a resident in town in a sudden and tragic way, Bradley Post and asked for everyone to keep his family in their payers. Mayor acknowledged (5) young men of Troop 54’s who obtained their Eagle Scout; Trevor Berg Hintz, Connor James Courtney, Jonathan Ryan Sumner, Timothy Joseph O’Connor, Thomas Michael Finan, Jr. Mayor and Council send their congratulations and best wishes for continued success in future years. On a motion by Councilman Rorty, seconded by Councilman Crossley, the meeting was adjourned at 8:02 p.m. Motion Carried by voice vote – all present voting “Aye”.
